AUGUST 12, 1986

IN THE MATTER OF A PROPOSED LOCAL LAW ENTITLED, "A LOCAL LAW IN
RELATION TO STOP INTERSECTIONS" (Sterling Place, ChampHn Place, Greenport)

SUPERVISOR MURPHY: The first hearing is a proposed "Local Law in relation to
stop intersections", to be read by Councilman Penny.
COUNCILMAN PENNY: "Legal Notice, Notice of Public Hearing on Local Law. Public
Notice is hereby given that there has been presented to the Town Board of the Town
of Southold, Suffolk County, New York, on the 29th day of July, 1986, a Local Law
entitled, "^ Local Law in relation to Stop Intersections."
Notice is further given that the Town Board of the Town of Southold will hold
a public hearing on the aforesaid Local Law at the Southold Town Hall, Main Road,
Southold, New York, on the 12th day of August, 1986, at 8:00 o'clock P.M., at which
time all inte,rested persons will be heard.
This proposed Local Law reads as follows, to wit:

Watchman, an affidavit of publication by The Suffolk Times. There are no communications.
SUPERVISOR MURPHY: Thank you, George. We've heard the official reading. Is
there anyone who would like to comment on the this Local Law in the audience? Please
give your name.
DAN GRATTAN: My name's Dan Grattan. I live on Champlin Place in Greenport.
Right now I have over 30 names of everyone that lives on Champlin Place that is
in favor of this stop sign, and Frank, I guess you're aware that we had the police
and everybody down and did their survey, and they're all in favor for it. All I'm
saying is we're in favor of it.
SUPERVISOR MURPHY: Okay, is there anyone else would like to comment? Sir.
EDWARD H£LINSKI: My name is Edward Helinski. I've lived here 65 years in this
Township. I've lived 40 years in this one place, right on the corner of Champlin
Place, and we've had already one person killed just a little bit to the north of
that because of the traffic that's gone through there. We have a bus stop right
there, but the bus stop, the stop sign's on one side. I mean across that way.
And I have had people come by there, I've hollered at them and everything like
that. Tried to stop them from going---all they do is put their finger up their
nose and wave at you, and they're going through there like a thoroughfare. Years
ago when Al Martocchia was in your position, we had a four-way stop sign there.
That was good. My wife was almost killed once up there on that same corner, and
that's why I said, you got to have four-way. Especially where there is right now
we have a lot of young kids there. Like Mr. Grattan, he has. Mr. Chester
couldn't maike it. He's up in Buffalo, and there is I think 27 young children there,
and all we have to do--you people--you're going to wonder what happened when one
of those kids gets killed because of the stupidity of us not having---how much an
effort ~is there to put another stop sign on each corner, back and forth and across?
SUPERVISOR MURPHY: Thank you.
COUNCILMAN SCHONDEBARE: This is four-way.
SUPERVISOR MURPHY; This is the four-way that we're talking about.
EDWARD HELINSKI: That's right, sir. It's going to a four-way. We want it.
We want it four-way, like it was originally.
TOWN CLERK TERRY: This is what it's going to do.
SUPERVISOR MURPHY: That's what we're doing here.
EDWARD HELINSKI: Yes, that's right.
SUPERVISOR MURPHY; Is there anyone else like to comment to the Town Board?
Yes, ma'am.
SA/I_Y GRATTAN: I'm the mother of many of the children that they've talked about.
The mothers sent me.. There are approximately 57 children and two more arriving,
which will make 59. I was raised on the block. When I was there there was only
Sparky Coyle's daughter and Arlene Gladding's daughter to play with. Now there
is so many lovely children. On our block alone, which is just a four square block

there's 57. On our street alone, not counting grandchildren that come to play and
visit, there is over quite a lot. Bobby has five, Mrs. Cisterino has four boys. Their
grandchildren come. There's three more. And now we have on our side we have
two. And then next has fifteen with small children, babies and infants, and we have
now more coming there from the down the corner we have more children. This past
year we had a complaint from a Mrs. Skrezec. She had called the school because she
complained she could not see the children at the bus stop when the bus stopped when
the children arrive, because they can't see because of Rouses where the intersection
meets. This is the main problem. It's all hours of the night. We have registered
complaints of this high reckless speeding. They start at one end of the corner and
they continuously go right to the end. Why in God's name they don't go into the
cemetery we don't know. Truman Cook has registered complaints. Mr. Kalin, Bob
Kalin has complained. He's up all hours of the night. The high speeding. It's
tearing through. They've even gone through hedges. We have had no cooperation
and we want something done for the simple reason that we're afraid for the children.
Last weekend we had a car spin when they had a blockade set up for one guy around
the corner from us who was having a family dispute. He successfully had wheeled
around the corner. A girl from New Jersey slammed on her breaks. Missed two
children on a bike. That was it. Sends chilis up your spine. There's too many
children. We want a four-way stop. That's just a simple request. Thank you.
SUPERVISOR MURPHY: Thank you. Is there anyone else would like to address the
Town Board? Mr. Tuthill.
LAWRENCE TUTHILL: I'd like to say I'm opposed to it. I'm a Civil Engineer. First
of all I'm not against children, but a four-way stop sign is essentially against the
Uniform Traffic Code. I believe there are other remedies for stopping this. I think
if you"re going to break the law in one way by putting a four-way stop sign there, I
think the minimum speed limit there allowed by the Town is 30 miles per hour. I would
rather see the speed limit lowered. There are other possibilities of not allowing park-
ing on Champlin on either one side or the other. I notice now that the people in the
area are not parking on Champlin place, which is a great help to people, because
normalling in traveling back and forth the cars have to--there is not enough rooms
for cars being parked on both sides, and you must wait for a car to pass by before
you can travel through. I admit there's a tremendous amount of traffic there in the
summertime, I mean with over the Gull Pond area, wherever, there's about 50 to 100
homes, and yet during the school season we only have about five children going to
school there. We have the Sterling Harbor Marina, which has a tremendous amount
of what you call "light ships" and the fact that these people just live there on their
boats during the summertime and there's a immense of traffic there. I must commend
the people there for not--just recently so they have not been parking on Champlin
Place and it's open so that you now can see through there. Until just recently or
so we were--I mean it was dangerous to drive on the road because of people parking
on both sides of the road and this immense amount of children there. With no one
parking on the road, I mean, it's somewhat a lot safer. The second thing is if this
four-way stop sign is put in it would be a tendency to run traffic rather than its
normal route to go to Greenport, they will run through Atlantic and down Manor
Place, which is probably would be quicker then the other way. So I think the speed
limit should be reduced and if the State Law says no, I don't see why we can't to
to our State Senator and State Assemblyman and ask them-- in an area like this,
which is very critical, let the speed limit be reduced, maybe even down to 15 or
20 miles an hour for the protection of these children. They come first. I mean,
quite often on this road we have to stop and wait while they're playing a ball game,
for them to move off the street. I mean, I think most people are will to do this,
but the fact of it is that one of the reasons they wanted the stop sign before there

there's a car overturned. There is a downhill going in the westerly direction, and
most places this wouldn't be a problem, but on our area in Long Island it's so flat
people are not used to stopping on a down-grade, and if you have any conditions of
ice it creates a tremendous problem, and also trying to stop there at this same inter-
section and going up the hill during ice. I think we have other alternatives rather
than stop signs. The speed limit right now is 35 miles an hour. It doesn't take one
very long- within probably two telephone poles -I just tried it this morning with my
old truck. I can get up to 35 miles an hour in two telephone poles, so that if they
stop they're still within the block and get up to 35 miles an hour. So I don't believe
that this would stop the speed limit, because the people- some of these new cars they
have--expensive cars at the Sterling Harbor group or so could easily reach the 35 mile
an hour' speed limit in the interim proportions, and the starting of the cars and people
with mufflers, bad mufflers, you have excessive noise. I think there are other alternatives
to this than going against the Uniform Traffic Code. Thank you.
SUPERVISOR MURPHY: Thank you. Is there anyone else would like to address the
Town Board? If not, I would just like to comment that as Larry said, the Town Board
cannot change speed limits. We have to receive, if anyone is interested in doing that,
we have to receive a petition, request, whatever, and it's passed to the Police Depart-
ment and then on to New York State Traffic and they will come out and do a survey,
but they are not too likely to lower the speed limit. We've had areas just as bad where
a lot of children are living on, and we've tried to get them lowers, and in fact you're
lucky to have 35. Most of them they go to 40, and we have a terrible time fighting
with them. If not, are there ....
COUNCILMAN SCHONDEBARE: Let me ask a question, Frank. Bob, I realize this
is the spur of the moment, and you haven't had a chance to look this up, but do
you have any knowledge of anything in the Vehicle and Traffic Law that says you
cannot have four-way stop signs?
TOWN ATTORNEY TASKER: No.
COUNCILMAN SCHONDEBARE: Thank you.
COUNCILWOMAN COCHRAN: We have one up by Soundview -I've seen them all over.
COUNCILMAN PENNY: Frank, I'd just like to make a comment, and this specifically
to the mothers in the area. If you think this is going to be the sole answer as far
as protection of your kids, I just want to warn you, if anything needs--four-way
stops prevent accidents, but the chance of one car coming from one direction at any
time is inevitable. We have a four-way stop by me and I'll tell you, it's just prevented
accidents, but the people still burn through it. There are so many offenders. I'm
just warning you. Just tell the kids this is not the only answer. Stop, look and
listen.
SALLY GRATTAN: This was an area of senior citizens. Now we have hardly any
senior citizens. Now we have children. Which is a lot different than before. The
racing goes on all night. I work one shift. Danny works another shift. It goes on
all night. It's no let up. It's a regular party.
EDWARD HELINSKI: May I address you again on this? We have, in Greenport, right
in Third and Center Street, I believe it is, a four-way traffic sign. They have a
playground there, and a big bunch of people hanging around there. Young people
and all, and the people obey those signs. They come right to the stop like nobody's
business. But down here, like Larry said, lower the speed limit. The speed limit
is 35 now and people are kiting through there at 50 and 60. That stop sign and

stating that 35 limit don't mean nothing.
SUPERVISOR MURPHY: I know Danny has had speed traps down there.
EDWARD HELINSKI: Yes.
COUNCILWOMAN COCHRAN:

It's been proven that it does slow down traffic in

and it has worked.
COUNCILWOMAN COCHRAN: Your four way stop will slow them down too.
