IN THE MATTER OF A PROPOSED LOCAL LAW ENTITLED, "A LOCAL LAW IN RELATION TO ACCESSORY APARTMENTS IN EXISTING DWELLINGS. Present: Supervisor Francis J. Murphy Justice Raymond W. Tasker SUPERVISOR MURPHY: This is the second public hearing that's scheduled tonight, and it's another proposed Local Law to amend the Accessory Apartment law. COUNCILMAN PENNY: "Public Notice is hereby given that there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 22nd day of April, 1986, a Local Law entitled, "A Local Law in relation to Accessory Apart- ments in,existing dwellings", which reads as follows, to wit: BE IT ENACTED by the Town Board of the Town of Southold as follows: Chapter 100-30B, Subsection (15) as added by Local Law No. 1 - 1986, is amended by addin~ a new paragraph thereto to be paragraph (p) to read as follows: (p) Applroval by the Suffolk County Department of Health Services of the water_ st~l~lol¥ and sewa~le disposal systems. Co'p~e~ of said L~cal Law are available in the Office of the Town Clerk to any intereste~l persons during business hours. NOTICE IS FURTHER GIVEN that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, Main Road, Sauthold, New York, on the 20th day of May, 1986, at 8:05 o'clock P.M., at which time all interested persons will be heard. We have affidavits of publication from The Suffolk Times and one from The Long Island Traveler-Watchman, and it was posted on the Town Clerk's Bulletin Board. We also have correspondence from the Planning Board which says, "Resolved that the Southold Town Planning Board is in favor of the proposed Local Law entitled, "A Local Law in relation to accessory apartments in existing dwellings" which would amend Local Law No. 1 1986, to include approval by the Suffolk County Department of Health Services of the water supply and sewage disposal systems. We also have a letter form the County Planning Department, dated May 12, 1986, a decisioin of local determination should not be construed as either...it's a matter of Ioca~ determination. SUPERVI~SOR MURPHY: Thank you, George. You've heard the official reading of the notice. Anyone like to speak in opposition to this proposed Local Law? (No response.) Anyone like to make any comment at all to the Town Board? (No response.) Any Town Board members? COUNCILMAN STOUTENBURGH: I might just add that most of these Local Law-- or all of them--go through the County first, and this is where--to get their input, and what came back was that the Health Department felt that they should be involved and so that's why this Town Board has taken on the change or the addition.
