for the demolition or relocation of buildings
BE IT ENACTED by the Town Board of the Town of Southold as follows:

I. Section 100-141J(g) (fees) of the Code of the Town of Southold is
amended to read as follows:
(g) Demolition and/or removal and/or relocation of any building: [one

This Local Law shall take effect upon its filing with the Secretary of

IN THE MATTER OF A PROPOSED LOCAL LAW ENTITLED, "A LOCAL LAW IN
RELATION TO FEES FOR THE DEMOLITION OR RELOCATION OF BUILDINGS.

SUPERVISOR MURPHY: The first hearing is on a Local Law concerning the
demolition and relocation of buildings, to be read by Jay Schondebare.
COUNCILMAN SCHONDEBARE: "Public Notice is hereby given that there has been
presented to the Town Board of the Town of Southold, Suffolk County, New York,
on the 22nd day of April, 1986, a Local Law entitled, "A Local Law in relation to
the fees for the demolition or relocation of buildings," which reads as follows, to
wit:
BE IT ENACTED by the Town Board of the Town of Southold as follows:
(additions indicated by underline; deletions by [brackets]).
I. Section 100-141J(g) (fees) of the Code of the Town of Southold is amended to
read as follows:
(g) Demolition and/or removal and/or relocation of any building: [one hundred
dollars ($100.)] Ten ($10.) dollars minimum, and five ($.05) cents for
each sc~uare foot in excess of three hundred (300) square feet of floor area.
Ii. This Local Law shall take effect upon its filing with the Secretary of State.
Copies of said Local Law are available in the Office of the Town Clerk to any
interested persons during business hours.
NOTICE IS FURTHER GIVEN that the Town Board of the Town of Southold
will hold a public hearing on the aforesaid Local Law at the Southold Town Hall,
Main Road, Southold, New York, on the 20th day of May, 1986, at 8:00 o'clock
P.M.,. at which time all interested persons will be heard.

I've got an affidavit of publication by The Suffolk Times. An affidavit that
the notice was published on the Town Clerk's Bulletin Board. The Town Clerk
has also received an affidavit of publication from The Long Island Traveler-Watchman.
We have a letter from the Planning Board, dated May 6, 1986, signed by Bennett
Orlowski, which says: "Resolved that the Southold Town Planning Board is in favor
of the proposed Local Law..."
We have a transmittal from the Department of Planning of the County of Suffolk
which indicates that it's a matter of local determination, dated April 24, 1986.

Demolition and/or relocation fees
SUPERVISOR MURPHY: Thank you, Jay. You've heard the official reading. The
purpose of this Local Law, I might add, we've had an awful lot of buildings that
we would like to have taken down, and rather than charge the people excessive
fees, that we would like their cooperation in taking these buildings down to make
Southold Town a better looking place. Is there anyone here who would like to
speak in favor of this Local Law? (No response.) Anyone like to speak in opposition
to this change? (No response.) Anyone like to make any comments at all? Jean?
MRS. JEAN TIEDKE: There are quite a few buildings, I imagine, that would fall
under this new law. Is there any way that the Town could acquire those that are
in fair shape and rehabilitate them?
SUPERVISOR MURPHY: Most of them are on private property. We don't know if
they're for sale. If any are historic, I think, if anyone hear of any I think have
a presentation to the Town Board and we would consider.
MRS. TIEDKE: Well, some of them probably could be rehabed enough to be turned
over for affordable housing perhaps.
SUPERVISOR MURPHY: If you happen to know where they are---most of them are
private owned, private property.
MRS,. TIEDKE: I understand that, but how long can a person abandor~ a house
that's going to fall down eventually? Is there any law that says within three years---
SUPERVISOR MURPHY: When it gets to a certain condition they are cited by the
Building Inspector as an unsafe building.
MRS. TIEDKE: And then what happens?
SUPERVISOR MURPHY: Then they're made to take it down if we find it.

SUPERVISOR MURPHY: The Orient Point Inn was a good example.
MRS. TI£DKE: It certainly was. Is there any possibility of getting to those owners
before that point is reached, that they are absolutely unsafe?
SUPERVISOR MURPHY: Sure.
MRS. TIEDKE: I think it might help some of the housing problems.
SUPERVISOR MURPHY: Very good idea. Anyone like to make any other comments?
(No response.) If not, I'll close this hearing.
