A Local Law in relation to Zoning Code fees
BE iT ENACTED by the Town Board of the Town of Southold as follows:
(additions indicated by underline; deletions by [brackets].)
Chapter 100 (Zoning) of the Code of the Town of Southold is hereby
amended as follows:
Section 100-124 thereof is amended to read as follows:
100-124. Fees
All applications to the Board of Appeals for any relief herein shall
be accompanied by a fee of [fifty] seventy-five dollars [(550.)] (575.)
Section 100-135 thereof is amended to read as follows:
100-135. Fees
All applications to the Planning Board for approval of site development
plans shall be accompanied by a fee of [fifty] one hundred dollars [(550.)]

Subsection (1) of Subdivision J (Permit fees) of Section 100-141 thereof
is amended to read as follows:
J. Permit fees.
(1)
The following fees shall be paid upon the filing of an application
with the Building Inspector for a building permit, which fees
shall be paid into the general fund if the application is approved
or returned to the applicant if the application is denied:
(a) Single-family dwellings:

This Local Law shall take effect upon its filing with the secretary of
State.

SUPERVISOR MURPHY: This is a public hearing on a proposed Local Law relative
to Zoning Code fees. The public notice will be read by Councilman Townsend.
COUNCILMAN TOWNSEND: I will open the hearing by reading the legal notice that
appeared in the local papers. "Public Notice is hereby given that there has been
presented to the Town Board of the Town of Southold, Suffolk County, New York,
on the 5th day of December, 1984, a Local Law entitled, "A Local Law in relation
to Zoning Code fees," which reads as follows, to wit:

Notice is further given that the Town Board of the Town of Southold will hold
a public hearing on the aforesaid Local Law at the Southold Town Hall, Main Road,
Southold, New York, on the 8th day of January, 1985, at 8:00 P.M., at which time
all interested persons will be given an opportunity to be heard.

The reason we're doing this is increasing costs. The Planning services we
now use have generated not only much more productive procedures in the Planning
Board, but also more costs and so we're trying to put those burdens where they
belong, basically on the applicants that use those services, and keep them off the
taxpayers shoulders. So that's why we're increasing the fees.
We have an affidavit of publication from The Long Island Traveler-Watchman
and from The Suffolk Times and notice that the public notice was placed on the
Town Clerk's Bulletin Board by Judith Terry.
We have a communication from the Planning Board from Southold Town resolving
that they recommend to the Town Board approval of the proposed Local Law providing
for the amendments of the Zoning Code fees.
We have a letter from the County of Suffolk, Department of Planning saying
it's a matter for local determination.
SUPERVISOR MURPHY: Thank you, Joe. You've heard the official reading of
the notice. Is there anyone here who would like to speak on behalf of this
Local Law? (No response.) Is there anyone here would like to speak in opposition
to this proposed Local Law? (No response.) Is there anyone would like to make
