A local law in relation to permits and licenses for
vehicles transporting refuse into town refuse disposal
areas and penalties for offenses
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Chapter 48 of the Code of the Town of Southold is hereby amended
as follows: (additions are indicated by underline; deletions by
[brackets]).
The word "REFUSE" set forth in §48-1 thereof is hereby amended
to read as follows:
REFUSE - Any human, [or] animal or vegetable refuse, offal,
swill, cesspool and/or septic waste, sewage, garbage, paper,
ashes, junk, trash, rubbish, waste, of whatever material
composed, discarded machinery or parts thereof, discarded
vehicles or parts thereof and an unlicensed motor vehicle
parked, stored or standing outside an enclosed building in
an inoperative condition for more than thirty (30) days.
II. The term "REFUSE DISPOSAL AREA" set forth in ~48-1 thereof
is hereby amended to read as follows:
REFUSE DISPOSAL AREA - The sanitary landfill site owned and
operated by the Town of Southold located north of County Route
48 at Cutchogue, New York, and any premises designated by
the Town Board as [the] a refuse disposal area of [this] the
town for the disposal of--refuse by the residents of [this]
the town.
III. Subdivision C of §48-3 thereof is amended to read as follows:
No vehicle shall be permitted to transport refuse into
any refuse disposal area maintained by the Town of
Southold unless such vehicle displays a valid [parking]
permit and/or license issued pursuant to the provisions
of [~48-3 of the Code of the Town of Southold.] this
chapter.
IV. ~48-4 and ~48-5 thereof are renumbered ~48-5 and ~48-6
respectively.
V. A new §48-4 is added thereto, to read as follows:
~48-4 Permit and License Fees.
A.
The fees for the issuance of permits and/or licenses
for vehicles transporting refuse into any refuse disposal
area maintained by the Town of Southold shall be as follows:
(1) parking permit - For non-commercial vehicles of
less than one ton capacity owned by a resident
and/or taxpayer of the Town of Southold and
transporting only household refuse, provided that
such vehicle displays a valid parking permit issued
pursuant to the provisions of §65-3 of the Code
of the Town of Southold.

$.50 (fifty cent) Per Load Fee - For each non-
commercial vehicle of less than one ton capacity,
which possesses not permit.
$15. Per Load Fee - For each single axle truck which
does not possess a permit.

B. Issuance and Duration of Permits and/or Licenses.
Ail permits and/or licenses provided for in this chapter
shall be issued by the Town Clerk. All annual permits
(including those previously issued) shall expire OhO
year from the date of the issuance thereof
C. Refund of Fees.
In the event that the Town Clerk has heretofore issued
permits for vehicles transporting refuse into the town
landsite at Cutchogue, and the fees paid therefor exceed
the fees provided for herein, the Town Clerk is hereby
authorized to refund such excess fees to the holders
of such permits and/or licenses
D. Amendment of Fees.
Notwithstanding any of the provisions hereof, the Town
Board may, by resolution, change, modify or repeal any
of the fees set forth in ~48-4 hereof. ~
VI. This local law shall take effect upon its filing with the
Secretary of State.

and licenses for vehicles transporting refuse into Town refuse disposal areas and
penalties for offenses. Councilwoman Cochran will you---
COUNCILWOMAN COCHRAN: Mr. Supervisor, I prefer not to repesent this Local
Law since it relates to dump fees and I am not supportive of the dump fees.
SUPERVISOR MURPHY: The notice will be read by Councilman Townsend.
COUNCILMAN TOWNSEND: "Public Notice is hereby given that there has been
presented to the Town Board of the Town of Southold, Suffolk County, New York,
on the 11th day of September, 1984, a Local Law entitled,"A Local Law in relation
to permits and licenses for vehicles transporting refuse into town refuse disposal
areas and penalties for offenses," which reads as follows, to wit:

interested persons during business hours. Notice is further given that the Town
Board of the Town of Southold will hold a public hearing on the aforesaid Local Law
at the Southold Town Hall, Main Road, Southold, New York, on the 9th day of
October, 1984, at 8:15 P.M., at which time all interested persons will be heard.

COUNCIl_MAN TOWNSEND: This refers to the fees for various si~e trucks of
a commercial nature and farm nature to use the landfill, which was put into
effect by resolution in slightly different form than in this Local Law. We've
had--this has been the subject of other hearings. The law has been revised
as a result of those hearings wherein there have been several changes made to
it, including the reduction in the cost of a commercial pick-up from $50.00 to

$25.00. A new classification of Farm Vehicles which makes the fee for farm
vehicles of all sizes $25.00. It provides for a refund of fees that were paid
as a result of the previous resolution on the books wherein $50.00 was charged
to commercial contractors with a pick-up truck. I guess that covers about most
of the remaining changes.
There has been an affidavit of publication from The Long Island Traveler-
Watchman and The Suffolk Times and usual notice of the Town Clerk saying it
has been put on the Town Clerk's Bulletin Board.
SUPERVISOR MURPHY: Thank you, Joseph. At this time I would like to ask

HEARING ON LOCAL LAW
PUBLIC NOTICE is hereby
given that there has been
presented to the Town Board
of the Town of Southold,
Suffolk County, New York, on
the llth day of September,
1984, a Local Law entitled, "A
Local Law in relation to
permits and licenses for ve-
hicles transporting refuse into
town refuse disposal areas and
penalties for offenses," which
reads as follows, to wit:
BE IT ENACTED by the
Town Board of the Town of
Southold as follows:
Chapter 48 of the Code of the
Town of Southold is hereby
amended as follows: (additions
are indicated in bold; dele-
tions by ]brackets]).
I. The word "REFUSE" set
forth in §48-1 thereof is hereby
amended to read as follows:
REFUSE - Any EInman, [or]
animal or vegetable refuse,
offal, swill, cesspool nnd/nr
septic waste, sewage, gar-
bage, paper, ashes, junk,
trash, rubbish, wastu, of what-
ever material, composed, dis-
carded machinery or parts
thereof, discarded vehicles or
parts thereof and an un-
licensed motor vehicle parked,
stored or standing outside an
,enclosed building in an inoper-
ative condition for more than
thirty (30) days.
II. The term "REFUSE DIS-
POSAL AREA" set forth in
§48-1 thereof is hereby amend-
ed to read as follows:
REFUSE DISPOSAL AREA-
The sanlt&ry landfill site own-
ed And operated by the Town
of Santhold located north of
County Route 48 ut Cut-
chogue, New York, and any
premises designated /by the
Town Board as [the] n refuse
disposal area of [this] the town
for the disposal of refuse by
the residents of (this] the
town,
III. Subdivision C of §48-3
thereof is amended to read as
follows:
C. No vehicle shall be
permitted to transport refuse
into any refuse disposal area
maintained by the Town of
Southold unless such vehicle
displays a valid [parking]
permit and/or license issued
pursuant to the provisions of
[§48-3 of the Code of the Town
of Southold.] this chapter.
IV. §48-4 and §48-5 thereof
are renumbered §48-5 and
§48-6 respectively.
V. a new §48-4 is added
thereto, to read as follows:

A. The fees for the Isauanco
of permits and/or licenses for
vehicles lrensperting refuse
into any refuse disposal area
maintained by the Town of
Southold shnll be as foflows:
(1) Parking permit. For non.
COmmercial vehicles of less
than one ton capacity owned
by a resident and/or te~payer
of the Town of Southold and
~msporting only household
refuse, prevlded that such
vehicle displays a valid park.

Code of the Town of Southoid.
(2) $.50 (fifty cents) Per
Load Fee - For each non.com.
merclal vehicle of less than
