Town Board of the Town of Southold as indicated by underline; deletions by §101-145 of Chapter 100 of the code of the Town of Southold (Zoning) is hereby amended to read as follows: §100-145 - Penalties for offenses. For each offense against any of the provisions of this chapter or any regulations made pursuant thereto, or failure to comply with a written notice or order of [the] any Building Inspector within the time fixed for compliance therewith, the owner, occupant, builder, architect, contractor or their agents or any other person who commits, takes part or assists in the commission of any such offense or who shall fail to comply with a written order or notice of lthe] any Building inspector shall, upon a first conviction thereof, be guilty of a violation punishable by a fine of not exceeding [fifty] five hundred dollars [($50.)] or imprisonment for a period not to exceed [six (6) months] fifteen (15) da.yS., or both. IN THE MATTER OF A PROPOSED LOCAL LAW ENTITLED, "A LOCAL LAW IN REALTION TO PENALTIES FOR VIOLATIONS OF THE SOUTHOLD TOWN ZONING CODE. Present: Supervisor Francis J. Murphy Councilman Joseph L. Tasker SUPERVISOR MURPHY: This is a hearing on a Local Law to amend the Zoning Code. The notice will be read by Councilman Stoutenburgh. COUNCILMAN STOUTENBURGH: "Public Notice is hereby given that there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 28th day of February, 1984, a Local Law entitled, "A Local Law in relation to penalties for violations of the Southold Town Zoning Code," which roads as follows, to wit: BE IT ENACTED by the Town Board of the Town of Southold as follows: (Additions indicated by underline; deletions by [brackets]). Notice is further given that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, Main Road, Southold, New York, on the 24th day of April, 1984, at which time all interested persons will be heard. I have an affidavit from The Suffolk Times, the Long Island Traveler- Watchman, and from Judy Terry that this has been posted on the Town'Clerk's Bulletin Board. I have a letter here from the Planning Board, dated April 4, 1984: "A quorum of the Planning Board met at Town Hall following field inspections on March 30, 1984 and the following action was taken: Resolved that the Southold Town Planning Board recommend approval of the two proposed Local Law amend- ments entitled "A Local Law in relation to penalties for violations of the Southold Town Zoning Code" and "Local Law to Amend the Zoning Code in relation to the computation of the number of lots in a Cluster Development." And it's from Henry Raynor, Chairman of the Southold Town Planning Board. I also have a notice that all the surrounding Towns and Villages have been notified and receipt from each has been filed. There is also a letter from the Suffolk County Department of Planning, dated March 6, 1984, which reads as follows: Pursuant to the requirements of Page 3- Public Hea~ .g - Local Law In relation to penalties for violations of the Zoning Code Sections 1323 and 1332 of the Suffolk County Charter, the above referenced application which has been submitted to the Suffolk County Planning Commission is considered to be a matter for local determination. A decision of local deter- mination should not be construed as either an approval or disapproval." SUPERVISOR MURPHY: Thank you, Paul. You've heard the reading of the Local Law in relation to penalties for violations of the Southold Town Zoning Code. Is there anyone who would like to speak in favor of this proposed Zoning change? MR. JOSEPH DUNNE, Southold: I'd just like to ask a question. Maybe I read this wrong. JUSTICE EDWARDS: He read hearing number twelve instead of eleven. MR. DUNNE: This is a Local Law to amend the Zoning Code in relation to the computation of the number of lots in a Cluster Development." TOWN CLERK TERRY: That's right. He read the last hearing, rather than the one before it. JUSTICE EDWARDS: We're out of step. MR. DUNNE: Pardon? TOWN ATTORNEY TASKER: That will be the next hearing. MR. DUNNE: Okay, I'm sorry. TOWN CLERK TERRY: They were just read out of order. SUPERVISOR MURPHY: Is there anyone would like to speak or make any comments on this? Ruth Oliva? MRS. RUTH OLIVA, President, North Fork Environmental Council: Yes, I'd just like to say that tt~e NFEC is certainly totally in favor of these changed penalties. It's just been too long that contractors have been getting away with destroying the bluffs or messing up the roads and interfering with things and we think it's time that it was done. SUPERVISOR MURPHY: Thank you. Is there anyone else would like to make a comment on this proposed Local Law? Joe? MR. DUNNE: I mean, I heard that. The contractor doesn't do anything a customer doesn't want him to do. I just want to say that. A contractor only does what he's assigned to do by the customer. MR. BARTH: You better not do it if it's against the law. MR. DUNNE: That's what I mean, the customer might say do it. SUPERVISOR MURPHY: Thank you.
