SOUTHOLD TOWN BOARD

IN THE MATTER OF A PROPOSED LOC AL LAW IN RELATION TO AREA AND YARD
REQUIREMENTS OF LOTS ON SUBDIVISION MAPS APPROVED PRIOR TO MAY 20,
1983.

SUPERVISOR PELL: This is a public hearing on a proposed Local Law
on area and yard requirements. Councilman Murdock will read the legal
notice.
COUNCILMAN MURDOCK: "Public notice is hereby given that there has
been presented to the Town Board of the Town of SOuthold, Suffolk
County, New York, on the 20th day of September, 1983, a Local Law,
entitled, "A Local Law in relation to Area and Yard requirements of
lots on Subdivision Maps approved prior to May 20, 1983," which reads
as follows, to wit: Chapter 100 of the Southold Town Code (Zoning)
is hereby amended as follows:
I. Section 100-31 B(1) thereof is hereby amended to read as
follows:
(1) All ots shown on Major and Minor subdivision maps which
were granted final approval by the Planning Board prior to May 20,
1983.
II. This Local Law shall take effect immediately.
Copies of said Local Law are available in the OFfice of the Town
Clerk to any interested persons during business hours. Notice is
further given that the Town Board of the Town of Southold will hold
a public hearing on the aforesaid Local Law at the Southold Town Hall,
Main Road, Southold, New York, on the 4th day of October, 1983, at
8:00 o'clock P.M., at which time all interested persons will be heard.

the Long Island Traveler-Watchman, and notice of publication by Joan
W. Gustavson on behalf of The Suffolk Times. I have a notice by
Judith T. Terry that the notice was posted on the Town Clerk's Bulletin
Board.

There is a letter from the Southold Town Planning Board to the
Town Clerk: "Dear Mrs. Terry: The following action was taken by
the Southold Town Planning Board, Monday, September 12, 1983: Resolved
that the Southold Town Planning Board accept as submitted the proposed
Local Law to Amend Chapter 100 (Zoning) of the Southold Town Code
in Relation to ARea and Yard requirements of lots on Subdivision Maps
approved prior to May 20, 1983. Signed~ Henry E. Raynor, Chairman,
Southold Town Planning Board."
There is a letter from the Suffolk County Department of Planning
to the Town Clerk: "Gentlemen: Pursuant to the requirements of Section
1323 to 1332 of the Suffolk County Charter, the above referenced applica-
tion which has been submitted to the Suffolk County Planning Commission
is considered to be a matter for local determination. A decision
of local determination should not be construed as either an approval
or disapproval."
SUPERVISOR PELL: Thank you. You've heard the reading of the public
notice. Does anybody wish to speak in favor of this Local Law? (No
response.) Does anybody wish to speak in opposition to it? Mr.
John Wickham.
MR. JOHN WICKHAM, Cutchogue, New York: Gentlemen of the Town Board
and Mrs. Terry. You'll recall that Local Law No. 9 set forth a
procedure for some subdivisions which were in process and had been
in process for some time. Some developers acting on Local Law No.
9 have gone ahead, gotten in touch with the Planning Board and are
in process. I find it difficult to find any reason for this amend-
ment. You're striking out the procedure setforth in Local Law No.
9. I would be pleased to have Somebody on the Town Board tell us
why it is necessary to strike out the procedure setforth in Local
Law No. 9.
SUPERVISOR PELL: I think you are addressing the next hearing. We
are---
COUNCILMAN TOWNSEND: Which one do you intend to be addressing, the
one where we set up the appeals procedure?
MR. WICKHAM: Actually Local Law No. 9 sets forth a procedure for
some in-process subdivisions--cases before the Planning Board. This
hearing right this minute is on an amendment which would strike out
that procedure that is set up .... '
COUNCILMAN MURDOCK: This is just in relationship to side yards and
front yards.
MR. WICKHAM: And in that section you set up a procedure for some
exemptions, actually.
COUNCILMAN MURDOCK: We're not changing the exemptions, John, we're
just changing the side yard and front yard requirements.

COUNCILMAN NICKLES: John, you're confused, I think, because we did
the public hearings out of sequence. The one I think you're addressing--
the one that Mr. Murdock read relates to bulk and side yard requirements
in relation to area and yard requirements on lots on subdivision maps.
You've talking about relief from the bulk and parking requirements,
aren't you?
MR. WICKHAM: No, Section--unless I am mistaken--Will the attorney
please read it.
TOWN ATTORNEY TASKER: The change is to change Section 100-31 (B) I
to read: "All lots shown on a Major or Minor Subdivision maps which'
were granted final approval by the Planning Board prior to May 20,
1983. It did read, before this change, "Subsequent to 1971 and prior
to May 20, 1Q83. We just dropped out the beginning date. The reason
for it was that the intention was to exempt from the two acre zoning
lots on maps that the Planning Board had approved which had 40,000
square feet of area. We assume that none of the maps that were approved
by the Planning Board prior to 1971, when we went to one acre, we
assumed that they did not approve any of those prior to that time.
After we passed that change, we found that in fact in May of 1971
the Planning Board did approve a map with 40,000 square foot lot area
even though at that time the Zoning Code did not require 40,000 square
feet. So that would not have been granted the exemption. The intention
was to give it an exemption. The idea was when we took the first
Local Law No. 9 was to exempt from the two acre zoning all subdivision
maps which the Planning Board had granted approval which had at least
one acre lots on it. That was the intent. When we drafted it we
assumed that only the 40,000 square foot lots would only be maps approved
by the Planning Board after 1971 and prior to 1983. We found that
after we had enacted it that in fact before 1971 the Planning Board
had approved maps with 40,000 square foot lots and they were intended
to have been exempt, but they were not because we put that beginning
date of 1971. We're just, by this change, taking that 1971 date out,
so that therefore any map previously approved by the Planning Board
which had at least 40,000 square feet of !oh areas on them would be
exempt from two acre zoning. That was the original intent and this
is just to correct it to carry out that intent.
MR. GEORGE TUMANOFF: John and I are involved together in trying to
subdivide the. Hansen farm in Mattituck. I think the confusion, Mr.
Pell, is whether the Local Law which you have now accurately identified
cancels out, replaces, or make inoperative Local Law No. 9, which
as I understood it recognized that properties such as ours, which
had been in process, and had received a preliminary hearing, and as
a matter of fact, preliminary approval, would, under the one acre
zoning, would continue under the one acre zone. So the real question
asked Mr. Tasker is whether this amendment negates any part of Local
Law No. 9 as it now stands?
COUNCILMAN NICKLES: Just expands it.
TOWN ATTORNEY TASKER: Let me read the section as it is in Local Law
No. 9, the same section, Section 100-131 B. "All lots shown on a
major or minor subdivision mhps which were granted final approval
by the Planning Board subsequent to November 23rd, 1971.and prior

to May 20, 1983. That's Local Law No. 9. We changed that by striking
out November 23rd, '71.
MR. TUMANOFF: May I ask a question? Could you continue with Local
Law No. 9, because it also refers to all lots on maps which received
preliminary hearing---
TOWN ATTORNEY TASKER: That was the first thing. Let me start again.
MR. TUMANOFF: Would y6u please, because this is---
TOWN ATTOP~NEY TASKER: I will read the entire changes that were made
by Local Law No. 9. "Section 131 is amended to read as follows:
No building or premises shall be used and no building or part thereof
shall be altered in the "A" Residential and Agricultural District
unless the same conforms to the following bulk and parking requirements
to wit: A. In the case of a lot held in single and separate ownership
prior to November 23rd, 1971 and thereafter, with an area of less
than 40,000 square feet, a single family dwelling may be constructed
thereon, provided that the requirements of column A of the Bulk and
Parking Schedule incorporated in this chapter are complied with."
That requires no minimum area. "B. The bulk and parking requirements
for a single family dwelling, as shown in column A-40 of the Bulk
and Parking Schedule incorporated in this chapter shall be applied
to the following lo%s, to wit: 1. All lots shown on a major or minor
subdivision maps which were granted final approval by the Planning
Board subsequent to November 23rd, 1971, and prior to May 20th, 1983.
2. All lots shown on a major subdivision maps upon which the Planning
Board has held a hearing for preliminary approval prior to May 20th,
1983. 3. All lots shown on a minor subdivision maps that have been
granted sketch approval by the Planning Board prior to May '20th, 1983.
4. All lots setoff or created by approval of the Planning Board sub-
sequent to November 23rd, 1971, and prior to May 20th, 1983." All
of those, those four categories, 20,000 square feet---
MR. TUMANOFF: And they all remain in effect?
TOWN ATTORNEY TASKER: Yes. We're not changing any of them. We just
changed the first one by striking out the beginning date of the approval.
Do you want me to read the rest?
MR. TUMANOFF: No, because I think I know it refers to A-80, but it
seemed as though you were replacing lots on maps that had received
preliminary hearing with only maps that had received final approval.
You are not replacing---
TOWN ATTORNEY TASKER: That section, 13!_has two parts, A part and
B part. B part has four parts to it. We only changed one of those
parts by striking that beginning date.
MR. TUMANOFF: A. part ....
TOWN ATTORNEY TASKER: A. was never touched. B-2, 3 and 4 were never
touched. It was just B-1 that we changed.

MR. TUMANOFF: Our question is answered. I'll repeat this, if you
don't mind, Mr. Pell. That particular section of Local Law No. 9,
which allows A-40, Bulk and Parking for lots on maps that received
a preliminary hearing prior to this date, still stands.
TOWN ATTORNEY TASKER: Yes, that hasn!t been changed.
MR. TUMANOFF: Thank you very, I'm sorry to have taken your time.
COUNCILMAN NICKLES: I think Mr. Wickbam can relate to the fact. in
1970, I believe it was, the Suffolk County Board of Health mandated
one acre lots prior to Southold Town adopting a one acre zoning ordinance,
and we had drafted the Local Law based on the fact when we adopted
one acre zoning, and we overlooked the fact that the Planning Board
had created one acre zoning prior to that because of the administrative
regulations of the Suffolk County Board of Health and all we're trying
to do is not penalize somebody with a one acre lot that was already
pre-existing.
MR. TUMANOFF: That wasn't our problem, our problem was.
SUPERVISOR PELL: Anybody else wish to speak in opposition to this?
(No response.) Anybody wish to be heard at all on this proposed Local
Law change? (No response.) If not, we declare the hearing closed.
