A Local Law to amend Chapter 100 (Zoning) of the
Southold Town Code in relation to Area and Yard
regulations.
BE IT ENACTED by the Town Board of the Town of Southold as
follows:
Chapter 100 of the Southold Town Code (Zoning) is hereby amended as follows:
I. Section 100-31 thereof is hereby amended to read as follows:
Section 100-31 - Bulk and Parking Requirements
No building or premises shall be used and no building or part'
thereof shall be erected or altered in the A Residential and
Agricultural District unless the same conforms to the following Bulk
and Parking requirements, to wit:
A. In the case of a lot held in single and separate ownership prior
to Nove~nber 23, 1971 and thereafter, with an area of less titan
forty thousand (40,000 sq. ft.) square feet, a single family
dwelling may be constructed thereon, provided that the
requirements of Column A of the Bulk and Parking Schedule
incorporated into this Chapter are complied with.
B. The Bulk and Parking requirements for single family dwellings
as set forth in Column A-40 of the Bulk and Parking Schedule
incorporated into this chapter shall apply to the following lots,
to wit:
(1) All lots shown on Major and Minor subdivision maps which
were granted final approval by the Planning Board
subsequent to November 23, 1971 and prio.- to May 20,
1983.
(2) All lots shown on Major subdivision maps upon which the
Planning Board has held a hearing for preliminary map
approval prior to May 20, 1983.
(3) All lots shown on Minor subdivision maps that have been
granted sketch plan approval by the Planning Board prior
to May 20, 1983.
(4) All lots setoff or created by approval of the Planning
Board subsequent to November 23, 1971 and prior to May
20, 1983.
C. The Bulk and Parking requirements for single family dwellings
set forth in Column A-80 of the Bulk and Parking Schedule
incorporated into this chapter shall apply to the following lots,
to wit:.
(1) All lots shown on Minor subdivision maps which have been
granted sketch plan- approval by the Planning Board on or
after May 20, 1983.
(2) All lots shown on Major subdivision maps upon which the
Planning Board has held a hearing for preliminary map
approval on or after May 20, 1983.
(3) All lots setoff or created by approval of the Planning
Board on or after May 20, 1983.
The Bulk and Parking requirements for two family dwellings set
forth in Column A-160 of the Bulk and Parking Schedule
incorporated in this chapter sh&]l apply to the following lots, to
wit:
(1) All lots shown on Minor subdivision maps which have been
granted sketch plan approval by the Planning Board on or
after May 20, 1983.
(2) All lots shown on Major subdivision maps upon which the
Planning Board has held a hearing for preliminary approval
on or after May 20, 1983.
(3) All lots setoff or created by Approval of the Planning
Board on or after May 20, 1983.
II. Section 100-34 thereof is repealed.
III. The "Bulk and Parking Schedule" applicable to the "A" 'Residential and
Agricultural Districts is amended to read as follows, to wit:

SUPERVISOR PELL: I'd like to call the hearing to order, the hearing
to amend Chapter 100 of the Southold Town Code in relation to area
and yard regulations. The public notice will be read or explained
by Councilman Nickles.
COUNCILMAN NICKLES: Unless anyone objects I would like to waive the
reading of the public notice. It is quite lengthy.and will take some
time. (No objection.) I would like to explain what it.is and then
we'll have public input on it. Basically what is involved is this
is the result of the two acre upzoning and we have to put the Code
in order as it'relates to two acre lots, which basically deals with
front yard requirement, side yard requirements, rear yards and set-
offs from the street. When we initially passed the two acre zoning
which required an 80~000 square foot lot, we had in a frontage require-
ment of 200 feet, but after some discussion, after the hearing on
the two acre zoning, we decided that.200 feet by basically would be
400 foot was rather unwieldy and we've come up with an amendment to
our Zoning Code which would require 175 foot minimum lot width and
a minimum depth of 250. Also part of this Local Law is that we'll
be embodying into this new law the existing 40,000 square foot, or
one acre~ front~ rear and side yard requirements. There's also a
provision in here for older lots~ less than one acre, which deals
with front yards, side yards, rear yards and etcetera. Basically
what the Town Board is trying to do in this endeavor is to resolve
problems that existed in the past of lots that existed in the Town
prior to one acre zoning, which often have to come up before the
Zoning Board of Appeals in their pro forma type application and
they cost time~ they cost money and it ties up our Zoning Board.

When the Town went to one acre zoning from half acre zoning we had
the same situation that the half acre lots had to conform to one
acre lots in terms of side yards, front yards, so we're trying to
eliminate that process through the Zoning Board, between the two
acre lots~ the one acre lots and less than one acre lots so that
when people come in to utilize their property they will not have
a lot of bureaucratic red-tape and basically what entails here and
if you have questions I'm sure that the Town Board will try to
answer them for you. I would add that it was published in The
Suffolk Times and the Long Island Traveler, according to law, on
July 21, 1983--we have a££idavits. We have a letter from our
Planning Board recommending approval. We have a letter from the
Su££olk County Planning Commission which says it is of local
jurisdiction, and an affidavit from the Town Clerk that it was
posted on the Town Clerk's Bulletin Board.
SUPERVISOR PELL: Thank you. You've heard the explanation by
Councilman Nickles. At ~hls time the Board would like to hear
from any citizens that would like to speak in favor of this
proposal.
COUNCILMAN NICKLES: I'll just add one other thing that's quite
important. It deals also with the exemptions of major subdivisions
and minor subdivisions that were created between November 23rd,
1971, which is when one acre zoning was instituted, and May 23rd,
1983 when the two acre zoning became law. And that basically--the
criteria for that is minor subdivisions that had received sketch
plan approval will be exempt from the two acre zoning and major
subdivisions, which is four lots or more--or more than iour lots
I should say--that were created between November 23rd, 1971 and
May 23rd, 1983 will be exempt provided they had preliminary hearing.
Ii there is any other Board member feels I left out something speak
SUPERVISOR PELL: As I was saying before, anybody wish to speak in
favor of this amendment to our Town Code to go to two acre zoning~
now is the time to do it. The Board is seeking input from the
people.
COUNCILMAN NZCKLES: We've already gone to the two acre zoning. This
is just the mechanics of it.
ABIGAIL WICKHAM, Attorney, Mattituck: The legislation proposed is
very important to remedy the many inequities which were inherent
in the blanket two acre zoning recently passed and I do.support it
to the extent that it addresses those inequities. However, there
do remain inequities unremedied by this law. Specifically, on behalf
of my client, Constantine Georgiopoulos, I would like to urge that
the Board must immediately consider and adopt legislation to protect
an individual who has done everything necessary on his part to be
eligible for a public hearing on major subidivision application many
months before llay 20th, 1983, but did not have a hearing scheduled
for reasons beyond his control. Those applicants who do not fall
within this proposed law may nevertheless have expended considerable
time and money and have made considerable progress in pursuing a
subdivision and yet suddenly be left without recourse within the

Town itsel£. Many technical inequities may be addressed by .the
Zoning Board of Appeals, but the question of where one stands on
the rezoning process in its entirety should be resolved by the
Board. Thank you.
SUPERVISOR PELL: Thank you. Mrs. Jean Tiedke.
MRS. JEAN TIEDKE, Southold: I am speaking for the League of Women
Voters and we do support the two acre zonin~ but I do not recall
ever hearing a figure of how much acreage is involved. Can you
enlighten us on that?
COUNCILMAN NICKLES: Total acreage?
MRS. TIEDKE: Yes. The vacant acreage, what percentage of the
vacant acreage in Town is involved?
COUNCILMAN NICKLES: A little over 14,000 acres.
MRS. TIEDKE: Which is what percentage?
COUNCILMAN NICKLES: Well, you have 34,000 acres in the Town,
so it would be one third.
MRS. TIEDKE: How many vacant acres?
COUNCILMAN NICKLES: How many vacant acres, land without maps
overlaying.
MRS. TIEDKE: Unbuilt on.
COUNCILMAN NICKLES: I don"t know what the total area in the
Town that is unbuilt on, but the total area according to RPPW,
which is our planning consultant, is approximately 14,000 acres
and those 14,000 acres is net land, it does not have a subdivision
map already overlaying it or some other kind of development or
existing development from 1640. This is land after they deducted
the Suffolk County Farmland, wetlands and other undevelopable lands.
So the area basically that we're talking about is in the vicinity of
14,000 and a couple hundred acres.
MRS. TIEDKE: Thank you.

COUNCILMAN NICKLES: I think that the people are aware it's impossible
to legislate for every instance and the Town Board today discussed
the formation of a review board, which is not a new idea, we've been
discussing it early on in the two acre proposal, but shortly the
Town Board will be getting together with representatives from the
Zoning Board and the Planning Board to come up with. a review board,
which will probably be the Town Board to sit and review people that
may wish to submit their properties for exemption because of difficult

circumstances they may have occurred in processing their subdivision.
In other words, we're going to provide relief, but the Town still
has to decide what the criteria and what the guidelines are going
to be. It will be a Local Law~ and we'll have to go through all the
Local Law process in terms of re£erring out the Local Law to the
various planning.commissions for their review, public notice, public
hearing and then a decision will be made.
