Edwards Honorable Councilmembers: The undersigned is legal representative for Standard Law Enforcement Supply Co. of Albertson , New York. It is most unfortunate that I am forced to correspond with you at this time . Hopefully , this letter will be of some assistance regarding not only the plight of my client , but will also serve to inform the Chief of Police of protocol versus mandates of the competitive bidding process in your Town. My client , a major supplier of police uniforms and equipment in the Northeast , has bid the police uniform contract in your Town in 1988 and most recently last week . In 1988 , my client qualified in every respect for the bid . Manno TTniform, a competing entity , did not submit complete and/or complying samples with its bid . The Town of Southold bid for year 1938 clearly required all samples to be supplied with bid submission : "Failure to submit samples of all items with bid proposal shall be cause for rejection." In spite of this clear , mandatory directive and rlanno Uniforms' blatent disregard for same , Chief Winters allowed the bid to qualify at the bid opening . This was cone by the chief irrespective of my client ' s sales manager r1r . Greg Moser ' s strenuous objection to same at the time . Additionally , oversize charges imposed by tlanno' s bid in their 1988 proposal were permitted to be deleted in order to make them low bidder . Without this assistance on behalf of the Town, wherein the bid was unilaterally altered after submission , my client was the low bidder . I corressponded with the town in December of last year regarding this matter . Ply client ' s objection to the procedure followed in 1988 went unheeded. This year , the bid package which my client received , did not contain a non-collusive certificate . My client followed directions of all bid mandates as required by the Town of Southhold . As specific samples were required at the bid opening , all were submitted in full compliance . As my client has a number of stores and actively bids in many states , it is not unusual that a specific bid does not mandate submission of this specific document , as well as other documents . Southhold Town for example , did not require bid deposits , bid bonds , contract supply bonds , letters of reference , etc as other towns , villages and municipalities do. The requests in this bid which my client received were addressed and complied with in total . At the bid opening , my client was the lowest bidder . Notwithstanding the non-collusive form not being attached to the bid , the Town Clerk of Southhold gave a form to my client to execute at the bid opening . The correction of this technical omission should be acceptable as: 1) The omission was not my client' s fault . 2) It serves the best interests of your community to award this contract to the lowest bidder . 3) 1988 precedent aforementioned dictates that this is the only fair and consistent thing to do. However , Chief Winter ' s strenuous objection disallowed our executed form to be handed to the Town Clerk . The Chief , without consulting the Town Counsel or anyone •else , made the unilateral determination that my client did not qualify. When Mr . Moser , who again was present at the opening , reminded the Chief of his liberal treatment of ilanno' s non-compliance with bid procedures last year , the Chief_ retorted that samples are not legal documents and are thereby not as concerning at a bid .opening . State law does not mandate that this specific document he submitted with the bid . If deviations on strict issues of compliance are ignored by the Chief to the favor of another bidder , then why wasn' t my client allowed to simply sign a certificate at the opening as given to him by the Town Clerk? Chief Winters' strenuous ogjection , disallowing our form to be included gave firs . Terry little alternative but to return the form to my client at the bid opening . Subsequently, firs. Terry suggested my clients' concerns be expressed to Town Board . As it is unknown to me if Chief Winters is an attorney, my client feels that the benefit of this decision should be to the Town Board . Ply client requests that the non-collusive affidavit which was executed in witness of the Chief and the Town Clerk be permitted to be submitted with our bid response so that Standard Law, the lowest bidder, will be awarded the contract . GENERAL CONDITIONS AND REQUIREMENTS: A. No bids will be considered from individuals, firms or corporations in bank- ruptcy or in the hands of a receiver. B. A substitute for the product specified will be considered when the terms "or equal" are used. The bidder must submit with the bid satisfactory proof that any substitute offered is equal to the standard specified. C. All bids will be F.O.B. destination and include inside delivery. D. No charge shall be made for boxing or packing. E. If any bidder does not fully understand the specifications or conditions here, or is in doubt as to the intentions of the same, he shall satisfy himself by inquiry in writing before bidding. After the contract has been entered into, the interpretations of the specifications by the Town of Southold shall be binding. II. SUBMITTAL OF BID: A. The bidder shall furnish all the data required on the quantity and specification sheets. B. The bid shall be submitted sealed, clearly marked, "POLICE UNIFORM BID" on the outside of the container. III . A. The Town Board of the Town of Southold reserves the right to reject any or all bids which do not comply with the invitation to bidders, the specifications, instructions to bidders, or other herein contained require- ments to waive any informality in bids, and to accept the bid which it deems most favorable to the interests of the Town of Southold, New York. B. it is understood and agreed that the acceptance of the foregoing bid by the Town of Southold shall thereby constitute a contract between the Town of Southold and the bidder, comprising in its entirety the invitation to bidders, the specifications, the requirements, the instructions to bidders, the terms and conditions, the bid and the acceptance of the bid by the Town of Southold. IV. A. The prices herein should not include any excise taxes and/or sales taxes imposed by any state or municipal government. B. The bidder hereby proposes to furnish all the necessary uniforms, clothes, linings, buttons, braids and all other materials and labor to complete the uniform requirements at and for the price named, according to the specifi- cations that are contained herein and as required by the Town of Southold, New York. C. All bids will be submitted as per "Unit Price", per shirt, trousers, etc. D. All garments shall be tailored to each individual to insure proper fit. The necessary measurements and fittings as required are to be made at a time and place as designated by the Chief of Police. E. Any and all necessary adjustments and alterations shall be made within one week as not to inconvenience the Town of Southold Police Department. F. The contractor shall thoroughly inspect the finished garment, etc. , for compliance with the Town of Southold specifications prior to inspection by the Chief of Police, and prior to delivery to the Town of Southold Police Department for final inspection. All materials and workmanship contracted for and ordered under this bid will be subject to acceptance or rjection by the Town of Southold after inspection and/or tests to determine whether or not the materials and work performed by the contractormeet the requirements set forth in the invitation and specifications. J. The Town of Southold will furnish an official emblem to be sewn on the left shoulder of each winter shirt, summer shirt, blouses, jackets, etc. Rank insignia, when required, will be furnished and sewn on by the successful bidder. K. Delivery will be a major factor as consideration in award of this bid. L. Failure of the contractor to supply uniforms as stated within the conditions herein shall result in procurement of items from another source with the additional monies incurred by the Town of Southold charged back to the contractor. DESIGN : Shall be made on a uniform pattern, having a plain front with straight side pockets, a watch pocket, 1" belt loops and two back pockets, with one billy pocket below rear hip pockets. POCKETS: The front pocket opening will be a minimum 62" and be 6" deep from the bottom of the opening. Pockets shall be stitched, turned, and re-stitched. There shall be a non-woven interlining fused to the front pocket facing to give additional stability and strength to the pocket. The inside front pocket facing shall be a separate piece of self material finishing no less than 14" wide. The back pockets will have a minimum opening of 5.2111 and be6" deep. They shall be made with a Reese PW automatic machine and finished on the outside with an exposed top and bottom cord. The left pocket shall have a tab to button. The watch pocket, located approx- imately 3" to the front of the right side seam at the waistband, shall have an approximate opening of 2-3/4" and shall be 3" deep. The front pockets and watch pocket shall each have a straight bartack and each back pocket shall be bartacked with a triangular bartacking machine. POCKETING: All pocketing shall be black, 65% Polyester/35o Cotton with a minimum thread count of 68 x 54. The weight shall be 2.60 yds. /lb. WAISTBAND: The waistband shall be 2" wide and shall be closed with a crush- proof hook and eye, the eye being bartacked for stability. The waistband curtain, attached with a rocap machine, shall have Snugtex and be made of black, 65% Polyester/35o Cotton. Banrol waistband stiffener, 3/4" in width, shall be sewn into the waist- band on the front of the trouser from side seam to side seam. The trousers are to be made with a continuous closed waistband. The waistband shall be set on and shall be stitched below the lower edge through the outer fabric and the waistband curtain. INSIDE TRIM: The right fly and crotch linings shall be the same fabric and color as the waistband curtain. There shall be a non-woven, interlining fused to the fly facing to give additional stability and strength to the pocket. The right fly lining shall be sewn to the left fly below the zipper. The crotch lining shall be serged to each front. A separate french fly made of the outer fabric shall be sewn to the inside right fly. -14- BELT LOOPS: There should be a minimum of 5 belt loops on waist sizes 28, 29, 30, and a minimum of 7 on all sizes over 30. Each loop is to be lined and 1" wide, with stitching on the face side 1 /8" from each edge. Except for the back loop which shall be tacked on, all loops shall be sewn into the bottom of the waistband and into the rocap. They shall accommodate a 1-5/6" belt. ZIPPER: The trousers shall be closed with a molded nylon memory lock zipper and have a brass bottom stop at the base of the zipper chain. A straight bartack shall be sewn through from the out- side of the garment to the inside at the bottom of the fly. It shall be sewn through the zipper tape, the right and left fly and the right fly lining. The right and left fly shall be joined by an additional bartack located below the bottom zipper stop on the inside of the trouser. CREASING: The front and rear crease in the trouser legs must incorporate a permanent modified silicone crease produced by the "Lintrak System". SEAMING: The entire trouser is to be seamed with Polyester core or 100% Polyester spun thread. The seat seam shall be stitched with a tandem needle seat seaming machine. SIZE TAG: The trouser shall have a sewn in label giving care instructions and an outside waistband label which shall be marked with lot number, size, fiber content and WPL number. A permanent size label shall be sewn inside on the hip pocket. FINISHING AND PRESSING: All loose threads shall be removed. Trousers must be pressed completely and properly with the side seam, inseam, and seat seam pressed open. POCKETS: The front pocket opening will be a minimum 6" and be 6" deep from the bottom of the opening. They shall be stitched, turned, and restitched. The inside front pocket facing shall be a separate piece of self material finishing no less than 14" wide. The back pockets will have a minimum opening of 52" and be 6" deep. They shall be made with a Reese PW automatic machine and finished on the outside with an exposed top and bottom cord. The left pocket shall have a tab to button. The drop watch pocket, located approx- imately 12" to the front of the right side seam and 14" below the waistband shall have an approximate opening of 2-3/4" and shall be 3" deep. The front pockets and drop watch pocket shall each have a straight bartack and each back pocket shall be bartacked with a triangular bartacking machine. POCKETING: All pocketing shall be black, 65% Polyester/35o Cotton with a minimum threat count of 68 x 54. The weight shall be 2.60 yds. /lb. WAISTBAND: The waistband shall be 2" wide and shall be closed with a crush- proof hook and eye, the eye being bartacked for stability. The waistband curtain, attached with a rocap machine, shall have Snug- tex and be made of black, 65% Polyester/35o Cotton. No-roll waist- band stiffener, 3/4" in width, shall be sewn into the waistband on the front of the trouser from side seam to side seam. The trousers are to be made with a continuous closed waistband. The waistband shall be set on and shall be stitched below the lower edge through the outer fabric and the waistband curtain. INSIDE TRIM: The right fly and crotch linings shall be the same fabric and color as the waistband curtain. The right fly lining shall be sewn to the left fly below the zipper. The crotch lining shall be serged to each front. A separate french fly made of the outer fabric shall be sewn to the inside right fly. -16- BELT LOOPS: There should be a minimum of 5 belt loops on waist sizes 28, 29, 30, and a minimum of 7 on all sizes over 30. Each loop is to be 3/4" wide, of double thickness, and stitched on the face side with a 2 needle machine. Except for the back loop which shall be tacked on, all loops shall be sewn into the bottom of the waistband and into the rocap. They shall accommodate a 1-5/8" belt. ZIPPER: The trousers shall be closed with a Talon Omni nylon #42 memory lock zipper and have a brass bottom stop at the base of the zipper chain. A straight bartack shall be sewn through from the outside of the garment to the inside at the bottom of the fly. It shall be sewn through the zipper tape, the right and left fly and the right fly lining. The right and left fly shall be joined by an additional bartack located below the bottom zipper stop on the inside of the trouser. SEAMING: The entire trouser is to be seamed with Polyester core or 100% Polyseter spun thread. The seat seam shalt be stitched with a tandem needle seat seaming machine. SIZE TAG: The trouser shall have a sewn-in label giving care instructions and an outside waistband label which shall be marked with lot number, size, fiber content and WPL number. FINISHING AND PRESSING: All loose threads shall be removed. Trousers must be pressed completely and properly with the side seam, inseam, and seat seam pressed open. There must be a Texpak clip attached to the top fly of the finished trousers. TROUSERS - TROPICAL Same style as All Year Trousers, fabric to be 55% Dacron Polyester/45o Rayon.
