PROPERTY FACTSMESCRIPTION: Subject parcel is located in the R40 Zone district, it is non-conforming containing 30,000 sq. ft. It is improved with a two story single family dwelling. It has 140.78 feet of frontage on Marina Lane, 215.01 feet along the northern property line, 138.29 feet along the eastern property line and 215.00 along the southern property line as shown on the site plan dated December 15, 2013 prepared by Robert C. Tast, Architect, based on a survey prepared by Young&Young dated Nov. 27, 2001. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's April 10, 2014 Notice of Disapproval based on an application for building permit to construct an accessory garage, at; 1)proposed location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variance to construct an accessory one story 20'X20' garage in the side yard,where the code requires a rear yard location. ADDITIONAL INFORMATION: During the hearing, the applicant stated that it would be more expensive to either construct an accessory garage in the code conforming rear yard or to attach a garage to the easterly side of his house. The applicant also testified that the proposed non-conforming side yard location for an accessory garage would be more convenient to the front door entry of his home than an accessory garage in his rear yard, per code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 5, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 2 of 2—July 30,2014 ZBA#7652—DiVito SCTM#1000-35-8-5.9 1. Town Law 4267-b(3)(b)(1). Grant of the variance will cause a detriment to the immediate neighborhood, which is comprised of similar size lots, improved with single family homes and attached garages, including the subject parcel. Within the immediate neighborhood (Marina Lane) only one property has a detached garage in a side yard. This property, which is adjacent to the subject property, is a corner lot with two front yards, and was granted a variance for the non-conforming location in 2000. Additionally, the dwelling on this adjacent property does not have an attached garage and the configuration of the dwelling in the middle of the property reduced the rear yard significantly. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has sufficient room in the conforming rear yard to locate an accessory garage. 3. Town Law 4267-b(3)(b)(3). The variance requested herein is mathematically substantial, representing 100% relief from present code requirements. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the Neighborhood. However, the Board notes that granting relief to construct an accessory garage in a non-conforming side yard location when a code conforming rear yard location is feasible, would set a precedent that could result in the undesirable increase of greater nonconformity on Marina Lane and throughout the Town. Therefore, the relief requested by the applicant is contrary to the obligation of the Board to grant relief only when no reasonable alternative exists. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Denial of the requested relief is the minimum action necessary and adequate to preserve and protect the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Dantes, and duly carried,to DENY the variance as applied for, and shown on the site plan dated December 15, 2013 prepared by Robert C. Tast,Architect, based on a survey prepared by Young&Young dated Nov. 27, 2001. Vote of the Board: Ayes: Members Weisman (Chairperson), Schneider, Horning, Goehringer, Dantes. I simply want to put the proposed garage in front of them. I implore the board to again consider that the relief I am requesting is less than that granted to my adjacent neighbor 15 years ago when he built his stand alone garage,as is visible on my site plan. He is 35 ft from the front property line, I will be 50 ft. He is 24x24x20, I am building 20x2Ox17.5.Where I am proposing to build is least visible to property owners west,south and east of the structure. In my backyard it would be visible to all of these surrounding property owners. I would like to also remind the board that none of the property owners that were notified,came to the June 5"'hearing to object to my request for this variance. I personally spoke to 6 of them and they have no objections.The other 2 do not live in the neighborhood.
