TOWN OF SOUTHOLD~ SUFFOLK
COUNTY~ NEW YORK
A local law to change the term of office of the town clerk from two years
to four ye ars.
BE IT ENACTED by the Town Board of the Town of Southold, Suffolk
County~ New York, as follows:
Section 1. The term of office of Lhe town clerk shall be four years.
Section 2. This local law shall supersede section twenty-four of the town
law, insofar as it is inconsistent with such section.
Section 3. A proposition for the approval of this local law shall be sub-
mitred to the electors of the town of Southold si the general election to be held in
November, nineteen hundred eighty-one, and this local law shall become operative
only if approved by the affirmative vote of a majority of the qualified electors
voting upon such proposition.
Section 4. If this local law is approved by the affirmative vote of a majority
of the qualified electors of the town voting thereon at said general election~ this
local law shall become and be effective immediately.

PUBLIC REARING ON A PROPOSED LOCAL LAW, ENTITLED "A LOCAL LAW TO
CHANGE THE TERM OF OFFICE OF THE TOWN CLERK FROM TWO YEARS TO FOUR
YEARS", 3:30 o'clock P.M., July 22, 1981, Southold Town Hall, Main
Road, Southold, New York.
SUPERVISOR FELL: At this time I will opening the hearing for any-
body that wishes to speak. The legal notice w.ill be read by
Councilman Murdock.
COUNCILMAN MURDOCK: Notice of Public Rearing. Public .Notice is
hereby given that there has been presented to the Town Board of the
To~m of Southold, Suffolk County, New York, on the 7th day of July,
1981, a Local Law entitled '.'A Local Law to change the term of office
of the town clerk from two years to four years". Said Local Law
reads as follows:
Be it enacted by the Town Board of the Town of Southold, Suffolk
County, New York, as follows:
Section 1. The term of office of the town clerk shall be four
years.
Section 2. This local law shall supersede section twenty-four
of the town law, insofar as it is inconsistent with such section.
Section 3. A proposition for the approval of this local shall
be submitted to the electors of the town of So'uthold at the general
election to be held in November, nineteen hundred eighty-one, and
this local'law shall become operative only if approved by the affirm-
ative vote of a majority of the qualified electors voting upon such
proposition.
Section 4. If thi~ local law is approved by the. affirmative
vote of a majority of the qualified electors of the town voting
thereon at said general election, this local ]aw shall become and
be effective immediately.
Copies of said Local Law are available at the Office of the
Town CIerk to any interested persons during business hours.
Notice is further given that the Town Board of the Town of
Southold will hold a public hearing on the aforesaid Local Law at
the Southold Town Hall, Main Road, Southold, New York, on the 22nd
day of July, 1981, at 3:30 o'clock P.M., at which time all interested
persons will be heard.

I have a notice of publication by Troy Gustavson on behalf
of the Suffolk Times. Notice from Judith Terry, the Town.Clerk,
that the notice was published on the Town Clerk's Bulletin Board.
SUPERVISOR FELL: Do you have a.ll three of them, Town Clerk's
Bulletin Board, Suffolk Times and ~attituck Watchman?
TOWN CLERK TERRY: It was published in the Traveler, I just haven't
received the affidavit, but the Suffolk Times is the legal paper

of the Town. It was published in both, they just have not given
me the affidavit from the Traveler.
SUPERVISOR PELL: The hearing will continue with the extension of
the town clerk's term from two to four years. I have on file a
letter from former town clerk Albert W. Richmond who desires to
see the term extended. I have a letter from Lester M. Albertson,
former Supervisor of Southold Town saying.he would like to see it
extended. I have a letter from Irene J. Pendzick, President of
the Suffolk County Clerk's Association saying their association
of Ten Town Clerk's unanimously would like to see it extended to
four years. Those letters I have on file~with this.
At this time I will open the floor to anybody who wishes to
speak in favor of extending the presenf term of town clerk from
two years to fou.r years, realizing this will be put up for a town-
wide vote in November. Anybody wish to speak in favor of?
MRS. SHIRLEY CROCKER, Greenport: I think in view of fhe impQrtance
of the town clerk's job, I think it will enhance the continuity of
the job and town government both.
SUPERVISOR PELL: Thank you, Mrs. Crocker. Anybody else wish to speak
in favor of the change from two to four years?
MR. WILLIAM GRAHAM, Southold: I would like to see it extended, but
I don't think I can add anything more than Mrs. Crocker.
SUPERVISOR PELL: Thank you, Mr. Graham. Mr. Homan.
MR. JAMES HOMAN, Cutchogue: Mr. Supervisor and Board. Having had
a little experience in this particular area, I feel the complexities
of the office as such that a two year time hardley allows enough
time for a new person to get. their feet wet and be fully aware of
all the documents and dufies of the office of town clerk. I would
like to voice my support for the Town Board's pleasure in having
this go to a four year term. I apologize 'for my appearance but I
wanted to time to come here.
SUPERVISOR PELL: Thank you, Jim. Jim Homan. Anybody else wish
to speak in favor of the extension of the term? (no response)
Does anybody wish to speak in opposition to the extension of
the term to the four years? (no response)
Does.anybody wish to speak at all on the subject? (no response).
If not, I wil~ declare the hearing closed and return to the
original Town Board meeting.

On December 18, 1980 I wrote to your offices to advise you
of the terms of the various offices of the Town of Southold to be
elected at the ~ovember 3, 1981 election (copy attached).
In this letter I advised that the Town Clerk's term would be
two years.
On July 24, 1981 I submitted to you a proposed proposition
(Local Law No.5 - 1981) to be included on the ballot for the
November election (copy attached). If this proposition receives
the favorable approval of the electors of the Town, then the term
of office of the Town Clerk elected at the November 3, 1981 election
will be four years commencing on January 1, 1982.
Accordingly I wish this letter to be considered as an amendment
to my December 18, 1980 notification, to the extent of providing that
the term of office of the Town Clerk elected in November 1981 will be
two years if the proposition does not pass and will be four years if
the proposition does pass.
Please acknowledge receipt of this letter.

ABSTRACT OF LOCAL LAW NO.5, 1981
TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK
1. Local Law No.5, 1981, is entitled "A Local Law to change the term of
office of the Tovm Clerk from two years to four years. "
2. The purpose of said Local Law is to supercede, in its application to the
Town of Southold, section twenty-four of the Town Law to provide that the term of
office of the Town Clerk shall be four years.
3. The effect of such Local Law is that if the same shall be approved by the
affirmative vote of a majority of the qualified electors of the Town of Southold voting
upon a proposition therefor at the general election to be held on November 3, 1981,

LEGAL NOTICE
NOTICE OF HEARING
PUBLIC NOTICE is hereby given that there has been presented
to the Town Board of the Town of Southold, Suffolk County, New
York, on the 7th day of July, 1981, a Local Law, entitled, "A
Local Law to change the term of office of the town clerk from
two years to four years".
Said Local Law reads as follows:
BE IT ENACTED by the Town Board of the Town of Southold,
Suffolk County, New York, as follows:
Section 1. The term of office of the town clerk shall be
four years.
Section 2.
This local law shall supersede section twenty-
four of the town law. insofar as it is inconsistent with such
section.
Section 3. A proposition for the approval of this local law
shall be submitted to the electors of the town of Southold at the
general election to be held in November. nineteen hundred eig-hty-
one, and this local law shall become operative only if annroved
by the affirmative vote of a majority of the Qualified electors
voting upon such proposition.
Section 4. If this local law is aporoved by the affirmative
vote of a majority of the qualified electors of the town voting
thereon at said general election, this local law shall become
and be effective immediately.
Copies of said Local Law are available at the Office of the
Town Clerk to any interested persons during business hours.
NOTICE IS FURTHER GIVEN that the Town Board of the Town of
Southold will hold a public hearing on the aforesaid Local Law at
the Southold Town Hall, Main Road, Southold. New York, on the 22n
day of July, 1981, at 3:30 o'clock P.M., at which time all
interested persons will be heard.

Town Attorney Tasker is drafting a proposed Local Law to
fit Southold Town. It would be very helpful if a resolution
authorizing a public hearing were adopted at the July 7th
meeting, so a public hearing can be held by July 21st and
if agreeable, adoption before the end of July.

The Towns of Babylon, Brookhaven, East Hampton, Huntington, Riverhead,
Shelter Island and Southampton, so far, have begun steps for adoption
of a similar Local Law for a four year term for Town Clerk.

Two years ago, the term of office for the non-legis-
lative position of Tax Receiver was changed from two years
to four years. There are bills in committee in the State
Legislature changing the Town clerks' term of office, b4t
we are advised that Home Rule, with mandatory referendum,
is the most ideal procedure, reflecting the people's will.
Support of the various Town Boards has been indicated,
and to have the referendum on the November ballot, time
element requires passage of a Local Law resolution and Public
Hearing during the month of July.
We sincerely believe that extension of the term of
office for the town clerks' position would be beneficial to
the continuity of town government. Hopefully, you will
support this request and have the citizens decide the issue
in November.

A local law providing for a four year term of office for the
town clerk.
Be it enacted by the town board of the town of y ~d, as
follows:
Section 1. Section ~.~enn~tYY--ffoour of the town law, in its appli-
cation to the town of~, is hereby amended to read as
follows:
I 24. Terms of office. All elective officers other than town
councilmen, justices of the peace, receivers of taxes and assessors
and. in the town of . the town clerk shall hold their
respective offices for two years. The terms of office of the r,
town councilmen first elected after this chapter shall take effect
and of the town councilmen first elected in a town which shall
have changed its classification from that of a town of the second
class to that of a town of the first class, shall be two years
each for two town councilmen and four years each for two town
councilmen, and thereafter at each biennial town election there
shall be elected two town councilmen for terms of four years each.
The terms of office of the justices of the peace and elective
receivers of taxes and assessments and. in the town of
the town clerk shall be four years. The terms of office of the
assessors, when elected, shall be two years for one assessor and
four years each for two assessors; when appointed, two years,
except as provided by section twenty-two-a of this chapter. The
term of each elective officer, except collector and justice of
the peace to fill a vacancy, shall begin on the first day of
January next succeeding the election at which he was elected.
Each collector and justice of the peace to fill a vacancy shall
take office illllllediately after his election upon qualifying as
prescribed by law, The town clerk, the town superinte~dent of
_highways, the receiver of taxes and assessments, the town engineer
and the tOWn attorney, whenever appointed, shall hold their
respective offices until the first day of January next succeeding
the first biennial town election held after the time of thail:;

appointment. All other appointed officers and employees shall

Notwithstanding the foregoing provisions of this section and
the provisions of subdivision six of section twenty of this
chapter, the term of office of town clerks and town superintendents
of highways in towns in the cOunties of Erie, Niagara, Dutchess
and Yates shall be four years; provided. that the electors of any
such towns have approved a proposition to increase such term to
four years at a mandatory referendum.
