A Local Law to amend C. hapter 92 of the Codes of the Town of Southold in
relation to traffic regulations.
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Article IV of Chapter 92 of the Code of the Town of Southold is hereby
antended as follows:
I. By amending Section 92-41 thereof by adding thereto the following:

DEPUTY SUPERVISOR MURPHY: In the absence of Supervisor Bill
Pell who has a death in the family, I'd like to open this public
hearing and I'll ask Councilman Nickles to read the notice.
COUNCILMAN NICKLES: Public notice is hereby given that there
has been presented to the Town Board of the Town of Southold~
Suffolk County, New York, on the 23rd day of June, 1981, a Local
Law entitled "A Local Law to amend Chapter 92 of the Codes of
the Town of Southold in relation to traffic regulations". Said
Local Law reads as follows:
Article IV of Chapter 92 of the Code of the Town of Southold
is hereby amended as follows'
I. By amending Section 92-41 thereof by adding thereto the
following:

I have notice from the Town Clerk that it was posted on her
Town Clerk':s Bulletin Board. I have affidavit from the'publisher
of The Suffolk Times that it was published on July 2nd.
DEPUTY SUPERVISOR MURPHY: Thank you, John. Is there anyone in
the audience who would like to speak in favor of this ordinance?
PHILIP BARTH, 725 Terry Lane, Southold, New York: I am just
adjacent to the park on the same side as the park. I'm in favor
of this resolution because, having lived at the location that I
just stated for five years it has been one source of irritation
in the evening because what we have there is the youngsters
gathering and drinking beer and carrying on until sometimes
2:00 - 3:00 o'clock in the morning. I feel-- and if you go
there the next day 5o the parking lot you'll find a thing
strewn with beer bottles, broken glass and I think that some-
thing like this will at least keep that element of the youngsters
from carrying on that way. At least give the residents of that
area some peace and quiet.

FRANK LEKICH, Southold; New York: I am also in favor of both
of the sections of this law. In the Terry Lane part of ~t the
commissioners of the park district had a meeting and we had a
complaint from the residents around the park and the park district
commissioners decided that they would close the parks from dusk
to dawn to try to eliminate some of this noise situation, parking
situation, vandalism situation. It's unfortunate that this has
to be done but no other steps that we could have taken at the
time so consequently we took those steps. No, I--we don't really
have anything to do with the parking on Terry Lane according to
~his law but I don't know whether it was Bill Albertson that
spoke to the Supervisor and it was decided that instead of park-
ing lot, if we took them out of the parking lot they would park
around the area, so that's why that was done. As far as the two
hour parking limit on the lot across from the post office, that's
going to be a tremendous asset to those people that have to make
a quick sto'p at the post office. I've seen people, and it's
happened to myself, go into the parking lot, look for a place
just to make a quick stop and have to go out again and look for
another parking area to park. Now, that's entering and leaving
the highway twice, which is rather dangerous and what not. And
that's simply because people use that to park their car for the
full day. I have seen that lot used as a car pool by Plum Island
workers who leave their cars there all day, get into another car
that picks them up, go to Plum Island and at 5 'o'clock or whatever
time, they come back and pick up their car. There's no objection
to anything like that if they would use one of the other parking
lots. We have a lot as you know behind the Mattituck Auto Parts,
behind the church, behind the firehouse and by Ch~nam's Restaurant,
so those parking lots I don't think anybody would object, but that
.particular parking lot across from the post office should, be
primarily used for a quick stop to the post office because the
post office has no other parking. So I think this is going to

help the residents who just want to make that quick stop. So
I am in favor of both of these sections of this .law. Thank you.
DEPUTY SUPERVISOR MURPHY: Thank you, Frank. Is there anyone
else who would like to speak in favor?
JOHN DECARLO, Terry Lane, Southold, New York: I would just like
to say that I too have been more or less troubled by the noise
and what goes on at the Wharf House, in the evenings especially.
Hopefully by passing this ordinance it will limit the parking
and the noise and the general harassment that.the residents in
that area have to put up with. A lot of people don't understand
what goes on down there. I would invite any of you to spend an
evening there. Before this dusk to dawn resolution was passed
there was very little we could do to get the teenagers or whomever
it is out of that area and with the passage of this resolution it
has helped an awful lot as far as getting the police department,
who did cooperate as much as they can, to get these children out
of there. Just the whole cleanliness of the beach has improved
since this has been enforced and by passing this resolution to
the ordinance of restricting the parking, I think it will also
help in that respect.
DEPUTY SUPERVISOR MURPHY: Thank you, John. Is there anyone else
in the audience who would like to speak in favor of this ordinance?
Anyone who would like to speak in opposition to it? Anyone like to
speak at all? John Nickles.
COUNCILMAN NICKLES: I'm not sure, but I want to make sure that
it is clear that this traffic regulations that we are taling
about today do not pertain to the park district property which
is opposite your house, Mr. DeCarlo. It only pertains in front
of your house that there will be no parking from 10:00 P.M. to
7:00 A.M. and further east down towards Mr. Barth's, that again
would be a no parking .from 10:00 P.M. to 7:00 A.M. My under-
standing, however, is that this proposed ordinance is in response
to the park district peop,le, specifically a letter that pointed
out to the Town Board wherein they have passed this resolution
closing the park area from dusk to dawn. It is my understanding
that even though the conditions may have improved there in the
park district, that the mere passage of a resolution by the park
commissioners does not.provide any teeth, or law so to speak,
for the Town Police to enforce. The Town Attorney can correct
me if I'm wrong, i.~ there are persons parking in the park district
after dusk, 'they ~an only be asked to move by our Town Police.
If there is a complaint by a park commissioner and he wishes to
come down there and have a complaint of trespa.~s b~ougkt'!'against
these individuals and that can be pursued, ~ut I' don~t ~elieve
that the police can act without the assistance of the park
commiss~oners~ Whereas, if we pass these parking taw~ on Terry
Lane and Hobart and a police officer should.observe a car there
he can give a summons. He cannot summons or ticket, 'if you will,
those people parked contrary to the park commissioner's reso~ution~
So I spoke, to Bill Albertson, a park commissioner, and-to Walter
Cain and advised them that they should pass a.locat law~ They
are a municipal entity £~n itself, so to s~eak, and if they wished

to have the Town Police enforce what they may envision as a
regulation but'be enacted as a local law ~or that park district,
it would not take a park commissioner there on the scene to bring
a trespass. Is that about right?
TOWN ATTORNEY TASKER: That's about right.
COUNCILMAN NICKLES: So, I've asked the park commissioners to
please consider passing their own local law. They would have
to go through the same process that we are. Cause a notice to
be published in the paper, hold a public hearing and I believe
they probably have to file it with the Secretary of State.
TOWN 'ATTORNEY TASKER: The only difference. They can enact
their regulations but they have to be done with the form and
manner as though you were passing a law. In other words, their
regulations can carry no penalty unless the proper procedures
are followed. That is, you've got to hold a hearing on it on
notice before it can have any penal effect. But it won't be by
local law. They can enact their regulations. Same force and
effect.
FRANK LEKICH: Well, ~f I may speak. We will follow that
procedure. We did hear from Dan Winters and he said that if
there should be any occasion to contact us to chance anyone
out, that he would do so, but he would have to contact one of
us in the meantime and the commissioners are willing to appear
whenever they are questioned. But if this is what is needed,
a local law-- Now, I understand that that should be passed even
though that is a private piece of land, is that correct? That's
private property.
TOWN ATTORNEY TASKER: Park district property?
FRANK LEKICH: Isn't that considered private?
TOWN ATTORNEY TASKER: No, it's public.

TOWN ATTORNEY TASKER: No, it's publicly owned.

Different boundaries ~n the Town.
COUNCILMAN NICKLES: The same as a school district. Publicly
owned, but by a small entity as opposed to the whole town.
FPukNK LEKICH: Ail right, we'll certainly--- we have a meeting
coming up this coming Monday night at the Wharf House and if '
any of you gentlemen, ladies wish to attend you are perfectly
welcome, of course, And we will have it on o~r agenda. 7:00
P.M.

District and several years ago we had rules and regulations drawn
up by Dick Lark and if you'd like a copy of them-- it did help us
quite a bit.
FRANK LEKICH: Good. I believe Bill Albertson spoke to Rudy
Bruer who represents us, represents the park district, but I'll
bring that to his attention.
DEPUTY SUPERVISOR MURPHY: Sure, be glad to help you. Anyone else
who would like to speak on the matter?
PHILIP BARTH: Could I just ask a question? In the meantime, before
the park .district passes their regulations, the procedure would
then be that i~ there is a complaint you can request lhat those
parties leave. They can't be punished insofar as getting a ticket
or any other type of punishment, but they can be asked to leave.
Now, what if they refuse to leave?
DEPUTY SUPERVISOR MURPHY: I don't think you have the power. The
park commissioners would have the power.
PHILIP BARTH: I'm saying, if they go there then they would be
trespassing, is thai it?
COUNCILMAN NICKLES: If the park commissioner came there on a
complaint and there were people there parking after their regula-
tions say they shouldn't be parked, and he asks them to leave,
and they didn't leave, then I think they would be guilty of
trespassing. The mere fact that they were there when you arrived
there, I don't know that they would be---would they be guilty of
trespass?
TOWN ATTORNEY TAS'KER: I don't know.
COUNCILMAN NICKLES: The way I understand trespass, you're not
guilty of. trespassing until someone tells you to leave and then
you are guilty i£ you refuse to leave. Whether that applies to
park district .property I don't know.
DEPUTY SUPERVISOR MURPHY: Anyone else? If not, I move that
this hearing be closed. We will reserve decision.
