SET HEARINGS Treasure Island Cove & LLC/Domeluca, LLC - This proposed Lot Line Modification transfers 1.38 acres from SCTM#1000-23-1-2.3 to SCTM#1000-23-1-2.5 and transfers 0.85 acres from SCTM#1000-23-1-2.4 to SCTM#1000-23-1-2.6. Lot 2.3 will decrease in size from 1.38 acres to 0.00 acres, Lot 2.5 will increase from 0.88 acres to 2.26 acres, Lot 2.4 will decrease from 0.85 acres to 0.00 acres and Lot 2.6 will increase from 1.20 acres to 2.05 acres located in the R-80 Zoning District. Sendlewski, Architect-Planner with two conditions; and WHEREAS, pursuant to Section 240-42 C, the Planning Board mandated cluster development of this parcel in order to preserve the scenic viewshed off of Oregon Road, a designated town scenic roadway; and WHEREAS, on October 15, 2013, the agent submitted the Preliminary Plat Application; and WHEREAS, on November 4, 2013, the Planning Board reviewed the application and found that all conditions of Conditional Sketch Plan Approval have been met, found the Preliminary Plat Application complete and set the Preliminary Public Hearing for December 16, 2013; and WHEREAS, on November 8, 2013, referrals were sent to the Suffolk County Department of Health Services, Suffolk County Planning Commission, LWRP Coordinator and Cutchogue Fire Department; and Cutchogue Business Center Page Two July 8, 2014 WHEREAS, on November 12, 2013, a referral was sent to the Office of the Town Engineer for review of the Preliminary Road and Drainage Plans; and WHEREAS, on December 16, 2013, the Preliminary Plat Hearing was held and closed; and WHEREAS, on December 23, 2013, the Suffolk County Planning Commission responded to the referral request stating that this is a decision of local determination with a comment that "The right-of-way should be 50 feet wide and suitable for future dedication"; and WHEREAS, on January 8, 2014, the Office of the Town Engineer reviewed the Preliminary Plat and found that a significant amount of re-grading was proposed. The amount of re-grading would be considered mining under the Town Code and, as such, the Engineering Office proposed to set up a meeting with the applicant to discuss alternate grading plans for the site; and WHEREAS, on January 9, 2014, the Cutchogue Fire Department responded to the referral request stating that there is no problem with the proposed subdivision; and WHEREAS, on February 4, 2014, the Engineering Office sent a memorandum to the Planning Board describing the meeting held with the applicant to discuss re-grading of the site. After review of the plan, the applicant agreed to limit the amount of grading to the subdivision roads and that any further grading of the site would be dealt with during the Site Plan review of each individual future site; and WHEREAS, on February 7, 2014, the Town of Southold Local Waterfront Revitalization Program (LWRP) Coordinator reviewed this application, and has recommended the proposed project be found consistent with the policies of the Southold Town LWRP; and WHEREAS, on February 10, 2014, the Planning Board reviewed the application at their Work Session and requested revisions to be made to the Preliminary Road and Drainage Plan and the Preliminary Plat. The Board also requested the property to be staked to review in the field the exact locations of the Open Space Easement and proposed placement of the lots; and WHEREAS, on March 28, 2014, the agent submitted the revised Preliminary Road and Drainage Plan and the revised Preliminary Plat; and WHEREAS, on March 31, 2014, a referral was sent to the Office of the Town Engineer to review the revised Preliminary Road and Drainage Plan; and WHEREAS on April 2, 2014, the Office of the Town Engineer reviewed the Preliminary Road and Drainage Plan and recommended to the Planning Board that revisions be made; and WHEREAS, the agent requested that the application not be reviewed with the Planning Board during April and May because of scheduling conflicts with the agent and applicant; and WHEREAS, on June 16, 2014, the Planning Board reviewed the application and found that all requirements of the Preliminary Plat have been met, with some conditions necessary for the Cutchogue Business Center Page Three July 8, 2014 Final Plat Application, pursuant to Section 240-17 Technical Requirements of the Southold Town Code; and WHEREAS, the Planning Board performed a coordinated review of this Unlisted Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act (SEQRA); be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold LWRP; and be it further RESOLVED, that the Southold Town Planning Board hereby declares Lead Agency status for the SEQRA review of this unlisted action; and be it further RESOLVED, that the Southold Town Planning Board, pursuant to SEQRA, hereby makes a determination of non-significance for the proposed action and grants a Negative Declaration; and be it further RESOLVED, that the Southold Town Planning Board hereby grants Conditional Preliminary Plat Approval upon the map entitled "Preliminary Plat for the Clustered Standard Subdivision", dated February 8, 2002 and last revised March 17, 2014, prepared by Martin Donald Hand, Licensed Land Surveyor, with ten (10) conditions: 1. Submission of all requirements pursuant to §240-20 Final Submission and §240-21 Technical requirement of the Southold Town Code; 2. Establish reasonable setbacks for Lots 2-5 to accommodate light industrial uses; 3. The Final Road and Drainage Plan must include the following: a) All requirements of the Final Road and Drainage Plan pursuant to Section 240-21 Technical Requirements; b) Label the Road and Drainage Plan "The Final Road and Drainage Plan for the Clustered Standard Subdivision of...."; c) All proposed open space must be labeled as "Open Space Conservation Easement"; d) Remove the three (3) proposed street lights as shown on the south side of the 50' right-of-way; e) The five (5) proposed leaching pools located on the south side of proposed Lots 3 & 4 must be re-located within the proposed 50' right-of-way; f) The two (2) proposed leaching pools for the temporary road must be located in the proposed 40' right-of-way where the 60' contour re-grading line is shown on the Preliminary Road and Drainage Plan; Cutchogue Business Center Page Four July 8, 2014 g) Show that all temporary and future road construction radiuses allow for clear 90 degree turning lanes; h) Reconfigure the Open Space Conservation Easement on proposed Lot 2 by reducing the width on the western side from 60' to 40', and adding a 20' wide area against Cox Lane to preserve the existing trees as a buffer against the road; and i) Show the proposed 10 Evergreen Street Trees (6 Evergreen Trees to be located on proposed Lot 3 and 4 Evergreen Trees to be located on proposed Lot 4) on the north side of the 50' right-of-way (S 59 degrees 53 feet 31 inches E). 4. The Final Plat must include the following: a) All requirements pursuant to 240-21 B Technical Requirements; b) The Final Plat must be titled "Final Plat for the Clustered Standard Subdivision of..."; c) Reconfigure the Open Space Conservation Easement on proposed Lot 2 by reducing the width on the western side from 60' to 40', and adding a 20' wide area against Cox Lane to preserve the existing trees as a buffer against the road. 5. Submission of a Letter of Water Availability from the Suffolk County Water Authority; 6. Submission of a Draft Road and Maintenance Agreement and Cross Access Easements; 7. Submission of Draft Covenants and Restrictions (a template will be provided by the Planning Department) with the following clauses (please note that not all clauses that will be required are outlined below): a) The trees on the southeastern property boundary must be preserved and integrated in any future site planning as buffers to the greatest extent practicable. b) Require the use of native, drought-tolerant plants in landscaping; c) The required planting of Evergreen Street Trees on Lots 3 & 4 are deferred for this subdivision until Lot 3 and 4 applies for site plan approval and further review by the Planning Board. At the time of Site Plan approval, 10 street trees (6 to be planted on proposed Lot 3 and 4 to be planted on proposed Lot 4) must be located on the north side of the 50' right-of-way to meet Southold Town Code Section 161-44 and shall be planted and maintained into perpetuity"; Cutchogue Business Center Page Five July 8, 2014 d) Prior to a Certificate of Occupancy, the final road as approved by the Planning Board shall be completed as designed. 8. Reasons Supporting This Determination: An Environmental Assessment Form has been submitted and reviewed. The determination was based upon the following: Negative Declaration Page Two July 7, 2014 Impact on Land Property soils consist of Haven Loam (HaA and HaB) with slopes ranging from 0-6 percent. Limitations are described as slight for home sites or sewage disposal fields. The parcel is currently cleared and has been graded in the past. A road and drainage plan has been submitted by the applicant on 3/28/14. Storm water is proposed to be controlled on site via subsurface disposal. Therefore, the proposed action is not expected to result in a significant adverse impact on land. Impact of Water 1. Water Supply Public water is currently supplied to parcel via a 12" public water main in Cox Lane. The subdivision creates 5 lots. One of the lots is currently improved with light industrial uses (Lot 1) and four lots (Lots 2-5) are vacant. The action of subdividing the parcel will not require the use of water above the current usage. The uses for Lots 2 -5 are currently unknown and, therefore, the water usage cannot be accurately calculated at this time. A letter of"Water Availability" has not been submitted. 2. Sanitary Disposal In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow patterns and water quality. The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. The allowable nitrogen bearing flow for the total 6.097 acre parcel is 3,658.20 gpd. Total sanitary flow committed to the light industrial uses currently on Lot 1 equal 1,545.50 gpd. The remaining flow available for future uses on the 6.097 acre parcel is 2,112.70 gpd. The proposed application conforms to Article VI of the Suffolk County Sanitary Code and would not be expected to adversely affect groundwater quality provided properly functioning systems are designed and installed. 3. Ground or Surface Water Quality or Quantity Two test holes indicate that water was 12' and 18' feet below grade. The existing storm water drainage patterns will be impacted resulting from the grading and development of the site. A Road and Drainage Plan has been submitted by the Negative Declaration Page Three July 7, 2014 applicant on 3/28/14. Storm water is proposed to be controlled on site by surface drains and subsurface pools. The proposed drainage plan meets the requirements of Chapter 236 Stormwater Management, is adequate to capture run-off from a 2" rainfall. Therefore, potential impacts from storm water run-off are expected to be low. No substantial impact to groundwater is expected to occur if the project is implemented as planned. 4. Flooding The proposed improvements are located within FEMA Flood Zone X; areas identified as areas of moderate or minimal hazard from the principal source of flood in the area, therefore, the potential impacts from threat of flooding are low. Impact on Air No substantial adverse change in existing air quality is expected to occur. Impact on Plants and Animals No rare or threatened plants or animals have been recorded on site or within the vicinity of the site. With the exception of Lot 1 (which is improved), the parcel has been disturbed through clearing and grading in the past. Due to the level of disturbance, the potential occurrence of rare or threatened plants or animals on site is low. No significant removal or destruction of large quantities of vegetation will occur. Correspondingly, no substantial interference with the movement of any resident or migratory fish or wildlife species nor impacts to a significant habitat area will occur. Impact on Agricultural Land Resources With the exception of Lot 1 (which is improved), the parcel is fallow and not currently in agricultural production, therefore, no adverse impacts to agricultural lands will occur. Further, the parcel is not located within an Agricultural District. Impact on Aesthetic Resources Oregon Road, which runs to the northwest of the property, has been identified as one of the most scenic roadways in the Town of Southold. Recognizing that the property is zoned Light Industrial (LI) and the future build out is expected to be industrial/commercial, there is a need to buffer the mass and intensity of the built environment from the agricultural uses and scenic views from Oregon Road. The Planning Board is requiring that the future uses on the parcel be screened from Oregon Road via the creation of a 40' wide vegetated buffer with rows of evergreen Negative Declaration Page Four July 7, 2014 trees on Lots 2 and 3 protected by a Conservation Easement. A 20' Conservation Easement placed over the existing landscaping will create a vegetation buffer to screen improvements on Lot 2. Lot 1 is improved and the use is screened from Cox Lane by existing landscaping. Therefore, the proposed improvements will not substantially adversely impact the current view shed and/or aesthetic resources. No substantial adverse impacts to aesthetic resources are expected to occur. Impact on Historical and Archeological Resources The New York Department of State GIS - Public Access Map was referenced for occurrence of archeo-sensitive areas on site. The area is not included and identified as an archeo-sensitive site. Therefore, no impacts are expected to occur to archeological resources on the parcel. Impact on Open Space and Recreation No significant impacts to public open space or recreational areas will occur as a result of this action. Impact on Critical Areas The proposed action is not located within a New York State Department of Environmental Conservation Critical Environmental Area. Impact on Transportation Lot 1 is improved with uses permitted in the Light Industrial Zone and 90 parking spaces are proposed. Truck circulation and radius of intersections have been sufficiently designed. Access to the parcel is proposed via a curb-cut providing ingress and egress to Oregon Road and a second curb cut (main entrance) on Cox Lane. An internal roadway connecting the intersections circulates traffic through the site. Vehicle traffic exiting the site onto Oregon Road will be directed to by signage to the traffic light, controlled intersection at Cox Lane and County Route 48. The future industrial/commercial uses and the traffic accessing the lots are unknown at this time. Additional mitigation to control traffic may be necessary in the future if a high traffic generating use is required. Impact of Energy No major change in the use of either the quantity or type of energy will occur. Impact on Public Health No creation of a hazard to human health is expected to occur. No substantial increase in solid waste production, leaching or drainage problems is expected to occur if the proposed action is implemented as planned. Impact on Growth, Character of Community or Neighborhood Proposed lighting will meet Dark Sky Standards, be contained on-site and not trespass onto adjacent parcels. The parcel is zoned Light Industrial. Parcels to the south and east are also zoned Light Industrial. Parcels to the north and west are zoned Agricultural Conservation and the parcels to the north are improved with single family residences. The subdivision has been designed to minimize known impacts. Further, the proposed action conforms to zoning and the purpose of the Light Industrial Zoning District. and WHEREAS, on July 13, 2012, the Southold Town Engineer reviewed the above-referenced application and required additional information and revisions to the Site Plan; and WHEREAS, on July 23, 2012, the Town of Southold LWRP Coordinator reviewed the above- referenced project and determined the proposed project to be consistent with Southold Town LWRP policies; and William Goggins Page Three July 8, 2014 WHEREAS, on July 25, 2012, the Southold Town Engineer reviewed the above-referenced application and determined that the proposed drainage meets the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on August 14, 2012, the Planning Board pursuant to SEQRA, made a determination of non-significance for the proposed action and granted a Negative Declaration; and WHEREAS, on December 17, 2012, the Suffolk County Department of Health Services (SCDHS) denied the requested variance for three (3) dwelling units at 850 sq. ft., 850 sq. ft. and 486 sq. ft. because it required a variance to the Wastewater Code that was greater than double the density for septic flow for the subject site; and WHEREAS, following the December 17, 2012 SCDHS' decision described above, the applicant informed the Planning Board that the proposal for three (3) dwelling units at 850 sq. ft., 850 sq. ft. and 486 sq. ft. would be abandoned and a revised Site Plan proposal would be forthcoming; and WHEREAS, on March 26, 2013, the Town Board of the Town of Southold amended Resolution 2012-382 to transfer 0.62 sanitary flow credits from the Town's TDR Bank to 13200 Main Road Corp. for its' proposed development of a single affordable unit in a multiple dwelling unit for the proposed development at SCTM#1000-114-11-9.1 and that the applicant shall receive a Sanitary Flow Credit Certificate, which shall not be signed by the Supervisor and released by the Town Clerk to the applicant until (i) the covenants and restrictions required by Town Code §117-9 have been filed and such filing has been approved by the Town Attorney, (ii) the applicant provides confirmation of the number of sanitary flow credits required by SCDHS, (iii) the applicant provides the Town Clerk with a SCDHS approval, and (iv) the applicant pays per credit sale price established by the Town Board to the Town Clerk; and WHEREAS, on May 2, 2013, the Suffolk County Department of Health Services (SCDHS) granted Approval Reference #C10-12-0003 for a mixed use building for double density at 373 gallons per day with 0.62 sanitary flow credits transferred from the Southold TDR Bank filed under Liber D12726 Page 373; and WHEREAS, on June 5, 2013, the applicant submitted a revised Notice of Disapproval to the Planning Board for a permit to convert a dwelling into two apartments at 600 sq. ft. each and a 785 sq. ft. non-medical office; and WHEREAS, on September 9, 2013, the Southold Town Zoning Board of Appeals (ZBA) reviewed the request for an Area Variance to convert the dwelling into two apartments and office space with the apartments comprising more than 40% of the principal building. The ZBA subsequently granted the Area Variance as applied for as recorded in their File#6677 subject to the following one (1) condition: William Goggins Page Four July 8, 2014 1. Obtain Site Plan Approval from the Planning Board; and WHEREAS, on June 2, 2014, the New York State Department of Transportation (NYSDOT) issued Highway Work Permit#20141031873 to "construct and permanently maintain a home business driveway on the s/s/o NYS Rt. 25 between MMS 1534-1535 as per attached plans and specifications. All work shall be to current NYSDOT standards/specifications and shall be to the satisfaction of the resident engineer"; and WHEREAS, on July 7, 2014, the Southold Town Chief Building Inspector reviewed and certified conversion of an existing 2,187 sq. ft. single family dwelling to include two one- bedroom apartment units at 600 sq. ft. each and an 785 sq. ft. office as a permitted use in the Hamlet Business (HB) Zoning District pursuant to ZBA Decision File#6677; and WHEREAS, on July 7, 2014, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280— Site Plan Approval of the Town of Southold, have been met; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board grants Approval to the Site Plan entitled "Alterations to 13200 Main Road, Mattituck", prepared by James J. Deerkoski, P.E., dated January 30, 2012 and authorizes the Chairman to endorse the Site Plan. Please also note the following requirements in the Southold Town Code relating to Site Plans: 1.
