RE: Interim Permit to Operate Hazardous/Toxic Storage Facility
Annexed hereto, please find a copy of a June 5, 1991 letter from John A.
Gladysz in response to my May 31, 1991 letter. Evidently, the County is
understaffed and unable to issue the permanent permit as per our request. It
does not appear, however, that the County has any problem in issuing the permit,
that it is just a matter of time before we get one. For that reason, I can see no
reason why we should delay payment to Agway Energy Products. By copy of this
memorandum to Ray Jacobs, I am requesting that he advise you if he is in
agreement with same.

Dear Mr. Gladysz:
Enclosed herewith, please find copies of three (3) interim permits issued to
the Town of Southold to operate hazardous/toxic material storage facilities
located within the Town. As you will note, one of the interim permits was issued
on January 23, 1991 and the other two on February 14, 1991 . To date, we have
not received the formal permit to operate and request that you kindly advise us as
to when we might expect to receive it. In addition, if there is any conditions
with which we have not yet complied or if there is any problem in issuing the
permit, we would appreciate knowing same.
Please be further advised that we have been withholding payment to Agway
Energy Products, the entity which performed the work with respect to this interim
permit, until such time as we are assured that their work is in compliance with
all applicable rules and regulations. So that we may not delay payment any
longer, your prompt attention to this matter is, therefore, respectfully requested.
Should you have any questions, please feel free to contact me.

Dear Judy,
I am sending this letter to you with hopes that you can help me resolve
the matter of not yet receiving payment of $23,994.00 for the work
we did for the town as approved by the town bid.
I have gone to Suffolk County Department of Health Services, and I
am enclosing copies of the permits that allow you to operate. These
systems have been in operation for months, and we still are awaiting
payment. I am also enclosing copies of the bid showing approval for
the amount that was billed to the town.
The work that was done is in compliance with all the rules and regulations
set forth by Suffolk County and the Town of Southold. I would appreciate
it if you would look into this matter and see what the hold up for payment
is. I am also enclosing a check dated 7-31-90 that you fowarded to the
County for a registration fee for the police department fuel tanks. I
was told this was already taken care of and was asked to return this
to you.
Please look into this matter and advise me if you would. Thank you
for your cooperation.

Products of Riverhead file with the Town Clerk, prior to the
commencement of the project, a Performance Bond in the amount of
$23,994.00 as surety for the faithful performance of the installation of
the aforesaid Fueling Systems, said bond subject to the approval of the
Town Attorney.

defined,who has not been paid in full before the expiration of a period of ninety (90) days after the date on which the last of such
claimant's work or labor was done or performed,or materials were furnished by such claimant, may sue on this bond for the use
of such claimant, prosecute the suit to final judgment for such sum or sums as may be justly due claimant, and have execution
thereon. The Owner shall not be liable for the payment of any costs or expenses of any such suit.
3. No suit or action shall be commenced hereunder by any claimant:
(a) Unless claimant,other than one having a direct contract with the Principal, shall have given written notice to any
two of the following:The Principal, the Owner,or the Surety above named, within ninety (90)days after such claimant did
or performed the last of the work or labor, or furnished the last of the materials for which said claim is made, stating with
substantial accuracy the amount claimed and the name of the party to whom the materials were furnished, or for whom the
work or labor was done or performed. Such notice shall be served by mailing the same by registered mail or certified mail,
postage prepaid, in an envelope addressed to the Principal, Owner or Surety, at any place where an office is regularly main-
tained for the transaction of business,or served in any manner in which legal process may be served in the state in which the
aforesaid project is located, save that such service need not be made by a public officer.
(b) After the expiration of one (1) year following the date on which Principal ceased work on said Contract, it being
understood,however,that if any limitation embodied in this bond is prohibited by any law controlling the construction hereof
such limitation shall be deemed to be amended so as to be equal to the minimum period of limitation permitted by such law.
(c) Other than in a state court of competent jurisdiction in and for the county or other political subdivision of the state
in which the project,or any part thereof,is situated,or in the United States District Court for the district in which the project,
or any part thereof, is situated, and not elsewhere.
4. The amount of this bond shall be reduced by and to the extent of any payment or payments made in good faith here-
under, inclusive of the payment by Surety of mechanics' liens which may be filed of record against said improvement, whether or
not claim for the amount of such lien be presented under and against this bond.

shall promptly and faithfully perform said contract, then this obligation shall be null and void; otherwise

between such bidder and Owner, and make available as work progresses (even though there should be
a default or a succession of defaults under the contract or contracts of completion arranged under this
paragraph) sufficient funds to pay the cost of completion less the balance of the contract price; but not
exceeding, including other costs and damages for which the Surety may be liable hereunder, the amount
set forth in the first paragraph hereof. The term "balance of the contract price," as used in this para-

One 2500 gallon tank, 7 gauge with 4 - 2" openings.
One Suffolk County approved bault: 22' x 8' x 218" made of 3/16 metal with primer and
finish coat of paint to bring up to a total of 16 mils. Will hold 110% capacity of the tank.
One Suffolk County approved alarm system.
One roof attached to the vault.

Bids are sought for materials and labor with respect to the installation of fueling systems
for the Southold Town Police Department, Southold Town Landfill Area, Southold Town
Highway Department:
Police Department
One 2500 gallon tank, 7 gauge with 4 - 2" openings.
One Suffolk County approved bault: 22' x 8' x 218" made of 3/16 metal with primer and
finish coat of paint to bring up to a total of 16 mils. Will hold 110% capacity of the tank.
One Suffolk County approved alarm system.
One roof attached to the vault.
One 1820 William Wilson pump with filter and auto nozzle, or equal.
One cement pad 25' x 10' x 6" reinforced concrete 3000 pound tested cement.
Landfill Area
One Suffolk County approved vault with roof: 12' x 6' x 28" with primer and finish
coat of paint to bring up to a total of 16 mils.
One cement pad 6' x 14' x 6" reinforced concrete 3000 tested cement
One Suffolk County approved alarm system.
Highway Department
Three Suffolk County approved vaults with roofs: 12' x 6' x 28" with primer and finish
coat of paint to bring up to a total of 16 mils.
