THIS DEED made the 22
da of MARCH , 1996, by and between
EDWARD J. HENNESSEY, ESQ. , as Referee, with offices located at 4
Annette Lane, East Moriches, NY 11940, the duly appointed referee
in the action hereinafter mentioned, as party of the first part,
AND
CLIFFORD C. CORNELL, SR. , residing at 325 Willow Point Road,
P � Southold New York 11971, as party of the second part,
WITNESSETH, the party of the first part, the Referee appointed in
an action entitled and between North Fork Bank as plaintiff and
Peter J. DeGutierrez-Mahoney, et al. , as defendants, under Index
No. 95-03399, foreclosing certain mortgages, as consolidated and
extended, by Consolidation and Extension Agreement dated 04/21/89,
recorded in the Suffolk County Clerk' s Office on 05/10/89 in Liber
15510 mp 53, in pursuance of a Judgment of Foreclosure and Sale
dated 12/08/95 and entered on 12/29/95 in the Supreme Court of the
State of New York, County of Suffolk; AND
IN CONSIDERATION of the sum of Sixty-three Thousand One and 00/100
( $63,001.00) Dollars, paid by the party of the second part, being
the highest sum bid at the sale under said Judgment, does hereby
convey and grant unto the party of the second part, the following
real property:
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being at
Peconic, Town of Southold, County of Suffolk, and State of New
York, being more particularly bounded and described as follows:
BEGINNING at a point on the southwesterly side of Carroll Avenue
where same is intersected by the southeasterly side of land now or
formerly of Levi Paul Lindsey and Mazie Lindsey; said point being
distant 134 feet southeasterly as measured along the southwesterly
side of Carroll Avenue from the southeasterly side of land of the
Long Island Railroad Company;
THENCE South 32 degrees 50 minutes 10 seconds east along the
southwesterly side of Carroll Avenue 84 feet to land now or
formerly of Julia O. Bell;
THENCE along said land of Bell, South 55 degrees 05 minutes 20
seconds West 178 feet;
THENCE North 32 degrees 50 minutes 10 seconds West 84 feet to the
aforesaid land of Lindsey;

THENCE along said land of Lindsey, North 55 degrees 05 minutes 20
seconds East 178 feet to the southwesterly side of Carroll Avenue
at the point or place of BEGINNING.
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above-described premises to the center lines thereof; TOGETHER
with appurtenances and all the estate and rights of the party of
the first part in and to said premises and TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part
forever.
The word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed
this deed the day and year first above written.
