ONLOCALLAW
NOTICE is hereby given that
there has been presented to the
Town Board of the Town of
Southold on the 13th day of
September, 1976. a Local Law
entitled "A Local Law in relation
to permitting games of chance in
the Town of Southold".
Said Local Law provides that it
shall be lawful for any authorized
organization as defined by Article
9-A of the General Municipal Law
upon obtaining a permit therefor
to conduct games of chance within
the territorial limits of the Town of
Southold. subject to the provisions
of this local law and Article 9-A of
the General Municipal Law; pro-
hibits games of chance to be
conducted within any leased
premises if the rental is to be paid
on the basis of a percentage of
receipts from the operation of such
game; requires that supplies and
equipment used in the conduct of
such games shall be obtained from
a licensed supplier or an authoriz-
ed organization: requires that the
entire net proceeds of any game of
chance shall be devoted exclusive-
ly to the lawful purposes of the
organization; provides that no
prize shall exceed the sum or value
ot'$100.O0 and that no wager shall
exceed $10.00, and that no series
of prizes on any occasion shall
aggregate more than $1,000,00;
provides that only bona fide
members O~ any .organization, its
auxiliary or affiliated, organization
shall, participate in the manage-
ment or operation of such games:
provides that no perSon shall
recede any remuneratio~ for

A Local Law in relation to permitting games of 'chance in the Town of
Southold.
Be it enacted by the Town Board of the Town of Southold as follows:
I. Chapter 30 of the Code of the Town of Southold is hereby amended by adding
a new Article thereto, to be Article II to read as follows:
ARTICLE II
GAMES OF CHANCE
Section 30-20 Definitions.
The words and phrases used in this Article shall, for the purpose of this
Article have the meanings respectively ascribed to them by Article 9-A of
the General Municipal Law.
Section 30-21 Games of Chance.
It shall be lawful for any authorized organization, as defined in Section 186
of Article 9-A of the General Municipal Law, upon obtaining the required license
therefor, to 'conduct games of chance within the territorial limits of the Town of
Southold, subject to the provisions of this article and Article 9-A of the General
Municipal Law.
Section 30-22 Restrictions.
The conduct of games of chance authorized by this Article shall be subject to
the following restrictions:
A. No person, f~rm, association, corporation or organization,
other than a licensee under the provisions of Article 9-A of the
General Municipal Law, shall conduct such game or shall lease or
otherwise make available for conducting games of chance a hall or
other premises for any consideration whatsoever, direct or indirect,
except as provided in section one hundred ninety of Article 9-A of the
General Municipal Law.
B. No game of chance shall be held, operated or conducted on or
w~thin any leased premises if rental under such lease is to be paid,
wholly or partly, on the basis of a percentage of the receipts or net
profits derived from the operation of such ~ame.
C. No authorized organization licensed under the provisions of
Article 9-A of the General Municipal Law shall purchase or receive
any supplies or equipment specifically designed or adapted for use in
the conduct of games of chance from other than a supplier licensed by
the board or from another authorized organization.
D. The entire net proceeds oi any game of chance and of
rental shall be exclusively devoted to the lawful purposes of the
organization permitted to conduct the same.
E. No prize shall exceed the sum or value of one hundred dollars
in any operation or conducting of a single game of chance as provided
in section one hundred eighty-six of Article 9-A of the General
Municipal Law. No single wager shall exceed ten dollars.
F. 1~o series of prizes on any one occasion of games of chance
shall aggregate more than one thousand dollars as provided in
section one hundred eighty-six of Article 9-A of the General Municipal
Law.
G. No person except a bona fide member of any such organization,
its auxiliary or affiliated organization, shall participate in the manage-
ment or operation of such game, as set forth in section one hundred
ninety-five-c of Article 9-A of the General Municipal Law.
H. No person shall receive any remuneration for participating in
the management or operation of any such game.
I. The unauthorized conduct of a game of chance shall constitute
and be punishable as a misdemeanor.
Section 30-23 Approval by Electors.
This Local Law shall not become operative or effective unless and until it shall
have been approved by a major~ty of the electors voting on a proposition submitted
at a general or special election held within the Town of Southold who are qualified
to vote for officers of the Town of Southold.
II. This local law shall take effect immediately.

Public Hearing was opened at 3:40 p.m. by Supervisor
Martocchia. Councilman Homart read the Notice of Hearing and
presented proof of publication from the Long Island Traveler-
Watchman. There was also presented a duly notarized affidavit
that the notice has been posted on the Tow~ Clerk's Bulletin
Board.
Supervisor: You have heard the reading of the proposed local
law, the advertisement in the proper local papers, the official
paper and the alternate paper, the Suffolk Times, that it was
posted in the Town Clerk's Office. Does anyone wish to speak
on that proposed local law, in favor? Anyone wish to speak in
opposition to that proposed local law? Hearing none, is there
any discussion at all on this proposed law? HearLng none, has
everyone had the opportunity to speak?
Bob Seh indicated he was in favor.
Supervisor: Does anyone else wish to speak? Any further
discussion necessary on this proposed law? Hearing none, the
hearing will be called to a close and the Board will make a
determination very shortly and, if the Board goes along with
it, it will be on the ballot in November.
