residing at c/o 230 Columbia Road, Southold, New York,
party of the second part,
WITNESSETH,that the party of the first part, in consideration of ten dollars and other valuable consideration paid
by the party of the second part, does hereby'remise, release and quitclaim unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land,situate, lying and being in the underwater land in Schoolhouse Creek,
New Suffolk, New York adjacent to property owned by the parties of the first part on Schoolhouse Creek and
described on the Suffolk County Tax Map as 1000-117.00-05.00-046.003 and property owned by the party of the
second part on Schoolhouse Creek and described on the Suffolk County Tax Map as 1000-117.00-05.00-046.004.
This document is intended to include a transfer of any right,title or interest the parties of the first part may have in
the land under the waters of Schoolhouse Creek, as set forth on the Suffolk County Tax Map as 1000-117.00-
05.00-047.000,except as set forth below.
This transfer is intended to comply with the provisions of a Stipulation of Settlement filed in connection with an
action brought in the Supreme Court of the State of New York, County of Suffolk (Schultheis v. Tuthill, Index
#2004-19824)and recorded at or around the time of the recording of this deed and shall not affect the rights of
the party of the first part under paragraph 2 of such stipulation.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
