ten dollars, lawful money of the United States, paid by the party
of the second part, does hereby remise, release and quitclaim unto
the party of the second part, the heirs or successors and assigns
of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being in at
Southold, Town of Southold, County of Suffolk and State of New
York, known and designated as Lot 2 on a certain map entitled, "Map
of Puritan Farms" filed in the office of the Clerk of the County of
Suffolk on July 19, 1994 as Map No. 9538, being more particularly
bounded and described as follows:
BEGINNING at a point on the southerly side of Bowery Lane (Ackerly
Pond Lane) distant 1, 236 feet more or less westerly from the corner
formed by the intersection of the southerly side of Bowery Lane
(Ackerly Pond Lane) with the westerly side of Lower Road;
RUNNING THENCE South 36 degrees 03 ' 40" West, 145. 16 feet;
RUNNING THENCE South 52 degrees 10 ' 00" West, 772 .49 feet;
RUNNING THENCE North 44 degrees 22 ' 40" West, 343.42 feet;
RUNNING THENCE North 33 degrees 34 ' 10" East, 244 . 61 feet;
RUNNING THENCE South 50 degrees 25 ' 50" East, 414 . 16 feet;
RUNNING THENCE North 52 degrees 10 ' 00" East, 487 . 35 feet;
RUNNING THENCE North 36 degrees 03 ' 40" East, 144 .37 feet to the
southerly side of Bowery Lane (Ackerly Point Lane) ;
RUNNING THENCE along the southerly side of Bowery Lane (Ackerly
Pond Lane) South 48 degrees 51 ' 40" East, 15 .06 feet to the point
of place of BEGINNING.
Premises more commonly known as 1405 Ackerly Pond Lane, Southold
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof, TOGETHER with
the appurtenances and all the estate and rights of the party of the
first part in and to said premises, TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part, in compliance with Section 13 of
the Lien Law, hereby covenants that the party of the first part
will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for
any other purpose.
