ORDINANCES AND LOCAL LAWS oF THE TOWN OF SOUTHOLD
Be it enacted by the Town Board of the Town '6f Southold as follows:
Section 1.
A. The penalty sections of ~ertaifi existing ordinances of the Town
~ of Southold, as enumerated betOW~ are h~reb~ amended to read as
~: provided in Subsection B below. ~

provided in Subsection B below.

The sections enumerated in Subsection A above are hereby amended
to read as follows:
Any person cormmitting an offense against any provision
of this ordinance shall, upon conviction thereof,
be guilty of a violation punishable by a fine not
exceeding two hundred fifty dollars ($250.) or by
imprisonment for a term not exceeding fifteen (15)
days, or by such fine and imprisonment. The continuation
of an offense against the provisions of this ordinance
shall constitute, for each day the offense is continued~ a
separate and distinct offense hereunder.
In addition to the above-provided penalties~ the Town
Board may also maintain an action or proceeding in the
name of the town in a court of competent jurisdiction to
compel compliance with or restrain by injunction the
violation of this ordinance."

Section 3.
Section V of the Ordinance Prohibiting and Regulating the Disposal
of Garbage and Rubbish adopted 3-23-48 and amended in its entirety 6-25-65
is hereby amended to read as follows:
Any person committing an offense against any provision of this
ordinance shall, upon conviction thereof, be guilty of a violation
punishable by a fine not exceeding two hundred fifty dollars ($25~.)
or by imprisonment for a term not exceeding fifteen (15) days, or
by such fine and imprisonment. The continuation of an offense
against the provisions of this ordinance shall constitute~ for each
day the offense is continued, a separate and distinct offense
hereunder.
Any person committing an offense against the provisions of this
ordinance shall be subject to a civil penalty enforcable and
collectible by the town in the mnount of one hundred dollars
($100.) for each such offense. Such penalty shall be collectible
by and in the name of the town for each day that such violation
shall continue. ~
In addition to the above-provided penalties, the Town Board
may also maintain an action or proceeding in the name of the
town in a court of competent jurisdiction to compel compliance
with or to restrain by injunction the violation of this ordinance."

Section 4.
Section 1100 of Local Law No. 1-1967, entitled "A Local Law Establishing
a Housing Code for the Town of Southold," is hereby amended to read as follows:
Any person committing an offense against any provision of this
local law, or any person who fails to comply with a notice or order
within the time limit stated thereon, shall, upon conviction thereof,'
be guilty of a violation punishable by a fine not exceeding two
hundred fifty dollars ($250.) or by imprisonment for a term not
exceeding fifteen (15) days, or by both such fine and imprisonment.
The continuation of an offense against the provisions of this local
law shall constitute~ for each day the offense is continued, a
separate and distinct offense hereunder.

"B. In addition to the above-provided penalties, the Town Board may
also maintain an action or proceeding in the name of the town in
a court of competent jurisdiction to compel compliance with or
to restrain by injunction the violation of this local law."
Section 5.
Section VII of an Ordinance Licensing and Regulating 'Secondhand
Junk and Auto Parts Activities and Businesses adopted 8-10-65 is hereby
amended to read as follows:
The owner or licensee of any such place of business who commits or permits
the commission of any offense against any of the provisions of this
ordinance shall be deemed to have committed a violation and shall be
liable for any such offense or the penalty therefor. Each day such
offense shall continue or be permitted to exist shall constitute a
separate offense.
For every offense against any provision of this ordina~ee,~'the person
cormnitting the same shall, upon conviction thereof, be subject to
a fine of not more than two hundred fifty dollars ($250.) or
imprisonment not exceeding fifteen (15) days, or by both such fine
and imprisonment.
"C. Conviction for any above-mentioned offense shall constitute and effect
an immediate forfeiture of the license.
Any person committing an offense against this ordinance shall,
upon conviction thereof, be subject to a civil penalty enforceable
and collectible by the town in the amount of one hundred dollars
($100.) for each soch offense. Such penalty shall be collectible
by and in the name of the town for each day that such offense shall
continue.
In addition to the above-provided penalties and punishment, the Town
Board may also maintain an action or proceeding in the name of the
town in a court of competent jurisdiction to compel compliance with
or to restrain by injunction the offense against such ordinance."

Section 6.
Section XI of An Ordinance Regulating the Taking and the Manner of Taking
Shellfish in the Town of Southold adopted 6-23-66 is hereby amended to read
as follows:
Any person convicted of an offense against any provision of this
ordinance shall be deemed to have co~m%itted a violation against
such ordinance, and also shall be liable for any such offense or
penalty therefor.
For every offense against any provision of this ordinance, the
person committing the same shall be subject to a fine of not more
than two hundred fifty dollars ($250.) or imprisonment not
exceeding fifteen (15) days, or by both such fine and imprisonment.
A second conviction for an offense against any of the provisions
of this ordinance within a period of one (1) year shall constitute
and effect an immediate forfeiture of a permit issued to such
person. No new permit shall be issued to such person f6r al
least one (1) year after such forfeiture.
Any person con~itting an offense against this ordinance shall be
subject to a civil penalty enforceable and collectible by the town
for each such offense. Such penalty shall be collectible by and
in the name of the town.

Section 7.
Section 330 of An Ordinance Regulating Dredging~ Filling and Construction
Operations on Wetlands in the Town of Southold adopted 6-29-71 is hereby
amended to read as follows:
Any person committing an offense against any provision of this
ordinance, or failing to comply with a notice of violation issued
by the Building Inspector, shall~ upon conviction thereof, be
guilty of a violation punishable by a fine not exceeding two hundred
fifty dollars ($250.) or by imprisomnent for a term not exceeding
fifteen (15) days, or by both such fine and imprisonment. The
continuation of an offense against the provisions of this ordinance
shall constitute, for each day the offense is continued~ a separate
and distinct offense hereunder.

Section 8.
This local law shall take effect as provided by law.
AN ORDINANCE TO AMEND AN~ORDI~ANC~ BELATING TO A CODE OF
ETHICS AND A BOARD OF ETHICS FOR THE TOWN OF SOUTHOLD
Be it enacted by the Town Board of the Town of Southold as follows:
Section 1.
Section 4 of Article II of An Ordinance Relating to a Code of Ethics
and a ~oard of Ethics for the Town of Southold, adopted 6-30-70, is hereby
amended to read as follows:
"In addition to any penalty contained in any o~er provision of law~
any such town employee who shall knowingly violate this ordinance may be
fined, suspended or removed from office or employment in the manner provided
by law." ~
Section 2.
This ordinance shall take effect inm~ediately.
AN ORDINANCE TO AMEND ON ORDINANCE REGULATING THE BURNING OF
RUBBISH
Be it enacted by the Town Board of the Town of Southold as follows:
Section 1.
Sections 1 through 5 of An Ordinance Regulating the Burning of Rubbish,
adopted 5-21-57, are hereby renumbered as Sections 2 through 6~ respectively.
Section
Anew Section 1 is hereby added to read as follows:
The Town Board of the Town of Southold is hereby authorized to
enter into an agreement with the Board of Commissioners of any
fire district now or hareafter established in said town, to
provide for the issuanme of fire permits for the burni6g o{ grass,
leaves, brush, rubbish, refuse, buildings or other materials
in the fire district in which issued.
Such agreement shall provide standards or conditions for the
issuance of such permits including, but not limited to,
specification of the exact location of the fire for which
the permit is sought, and prohibition of fires on streets~
highways, sidewalks and other public places where deemed
necessary.
Violation of the conditions attached to any permit issued
pursuant to said agreement shall be deemed an offense against
this ordinance and shall be punishable as such."
Section 3.
Section 3 of said ordinance, as renumbered by Section 1 above, is hereby
amended by adding at the end of the section the phrase "... as provided in
Section 1 above."
Section 4.
ThUs ordinance shall take effect immediately.
AN ORDINANCE TO AMEND AN ORDINANCE REGULATING THE RAISING AND
KEEPING OF DUCKS WITHIN THE ToWN~.OF SOUTHOLD
Be it enacted by the Town Board of the Town of Southold as follows:
Section 1.
Section 2 of An Ordinance Regulating the Raising and Keeping of Ducks
within the Town of Southold, adopted 5-24-49, is hereby amended to read
as follows:
I "No person shall raise or keep ducks for personal or family use,
"in excess of one hundred (100), without first obtaining written per-
mission of the Town Board."
Section 2.
Sections .3, 4 and 5 are hereby renumbered as Sections 4, 5 and 6~
respectively, and a new Section 3 is added as follows:
"Section 3. Applications and issuance of permit.
"A. Applications for the permit required by Section 1 above shall be
on forms provided by the Town Clerk and shall include, among other
things, the following information:
(1) The number of ducks proposed to be raised.
(2) A description of the structures and enclosures to be used for
such ducks, including:
(a) The design and dimensions.
(b) Type of construction and materials to be used.
(c) Sanitary provisions.
(3) Provisions for the collection and disposal of all waste matter.
"B. In addition to the above information~ the Town Board may require
-- such information as will enable it to make a proper determination~
·including the submission of a sketch of the property in questiom,
and of all property within two hundred (200) feet, showing:
(1) Ail existing and proposed buildings, structures and enclosures.
(2) All property and street lines.
(3) Ail bodies of water and drainageways.
(4) Any other pertinent details.

In arriving at a determination regarding the issuamce of a permit
to raise or keep ducks as a corm~ercial enterprise~ the Town Board
~hall be guided by all pertinent ordinances, local laws and regu-
]ations of the town, and, in particular~ the Zoning Ordinance.
In no case, however, shall a permit he granted if a building structure
or enclosure containing ducks is located nearer than fifty (50)
feet to a property line or dwelling, or nearer than one hundred
(100) feet to a street line."

This ordinance shall take effect irm~ediately.
AN ORDINANCE TO AMEND AN ORDINANCE REGULATING THE TAKING AND
THE MANNER OF TAKING SHELLFISH IN THE TOWN OF SOUTHOLD
Be it enacted by the Town Board of the Town of Southold as follows:
Section 1.
In Section II(e) of An Ordinance Regulating the Taking and the Manner
of Taking Shellfish in the Town of Southold, adopted 6-Z3-66, the definition
of-"shellfish" is hereby amended to read as follows:
"SHELLFISH -- Clams, scallops~ oysters~ blue claw crabs and

A new Subsection (f) is hereby added to Section III as follows:
"(f)
The presence of shellfish in excess of the lfmit~, or of
less size than that set forth in this ordinance~f~n~~
aboard any boat or vessel in the waters of the Town of
Southold, shall be deemed presumptive evidence of a
violation of this ordinance."
Section 3.
In Sections IV and~ the last sentence of Subsection E of each is
hereby deleted.
Section 4.
Sections VII through XIV are hereby renumbered as Sections IX through
XVI, respectively and two new Sections VII and VIII are hereby adopted as
follows:
"Section VII. Blue claw crabs.
"A. Blue claw crabs measuring less than five (5) inches from point to
point of the upper shell shall not be taken from the waters of the
Town of Southold.

"B. A permanent resident~ a temporary resident or a g~est
accompanied by a permanent resident may not take ~ore
than one-half (½) bushel of blue claw crabs from ~own
waters in any one (1) day for noncommercial purp6ses.
"C. Female blue claw crabs with eggs visible thereon, coranonly
called "sponge crabs," shall not be taken from the waters
of the Town of Southold."
"Section VIII. Mussels.
A permanent resident, a temporary resident or a guest
accompanied by a permanent resident may not take more
than one (1) bushel of mussels from town waters in one
(1) day for noncommercial purposes.
Not more than ten (10) bushels of mussels may be taken from
town waters for commercial purposes in one (1) day by any one
(1) person. Two (2) or more persons occupying the same boat
may take~ in the aggregate~ not more than twenty (20) b~shefs of
mussels in one (1) day for cormnercial purposes."
Section 5.
This ordinance shall take effect irmmediately.
ANORDINANCE TO AMEND AN ORDINANCE PROHIBITING AND REGULATING
THE DISPOSAL OF GAP~BAGE AND RUBBISH
Be it enacted by the Town Board of the Tow~ of Southold as follows:
Section 1.
Section I1 of An Ordinance to Amend an Ordinance Prohibiting and
Regulating the Disposal of Garbage and Rubbish, adopted 3-23-48 and
amended in its entirety 6-25-65, is hereby amended to read as follows:
No person shall collect~ store, accumulate, throw, cast~ deposit
or dispose of, or cause or permit to be collected, stored~
accumulated, thrown, cast, deposited or disposed of, any refuse
upon any premises or upon any street, highway, sidewalk, or
public place within the Town of Southold, except when authorized
by the To~n Board.
"B. Nothing contained herein shall be construed so as to prevent:
"(1)
The temporary accumulation of refuse by a resident of the
town upon premises occupied by him to the extent that ----~ .... ~
such accumulation is ordinary and necessary for his
personal household requirements.
"(2) The disposal of refuse at any refuse disposal area
maintained or authorized by the Town of Southold.
"(3)
The proper use of receptacles placed upon the streets or
other public places in the Town of Southold for the
depositing of refuse; provided, however~ that such public
receptacles shall not be used for the deposit of accumulated
household garbage.
"(4)
The engaging in secondhand junk and auto parts activities
and businesses when a license therefor has been obtained
pursuant to the provisions of the Southold Town ordinance
licensing and regulating secondhand junk and auto parts
activities and businesses."

SectiOn 2.
The existing text of Section III is hereby designated as Subsection A
and a new Subsectiom B is added to said Section III as follows:
No garbage~ refuse, rubbish or other material that does not have
its origin within the Town of Southold shall be deposited or
disposed of in the town refuse disposal area."
Section 3.
This ordinance shall take effect i~nediately.
AN ORDINANCE TO AMEND THE EXCAVATION ORDINANCE OF THE TOWN OF
SOUTHOLD
Be it enacted by the Town Board of the Town of Southold as follows:
Section 1.
Section III of the Excavation Ordinance of the Town of Southold
adopted 2-16-65 is hereby amended to read as follows:
"No lands or other premises shall be operated or used as sand and
gravel pits, or for the excavation or removal of sand, gravel~ stone or
other minerals, or for other excavation purposes, or for the stripping
or removal of topsoil therefrom, including sod farming, [except such sod
farming operations as remove only the top two (2) inches or less of topsoil
annually] without a currently effective permit issued by the Town Board
in compliance with the provisions of this ordinance or unless listed as an
exception in Section IV."
Section 2.
A new Subsection (h) is hereby added to Section IV to read as
follows:
"(h) The removal of two (2) inches or less of topsoil
annually during the normal operation of sod farming."
Section 3.
This ordinance shall take effect ima~ediateiy.

Be it enacted by the Town Board of the Town of Southold as follows:
Section 1.
Article III~ Section 1, of the Traffic Ordinance of the Town of
Southold adopted 6-21-66 is hereby amended and reviaed as follows:

AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE TOWN OF SOUTHOLD
Be it enacted by the Town Board of the Town of Southold as follows:
The Zoning Ordinance of the Town of Southold adopted 4-9-57 and amended
in its entire~y 4-8-58 and 11-23-71 is hereby amended as follows:
Section 1. In Article I, Section 101~ the definition of "YARD~ FRONT"
is hereby amended to read as follows:
"YARD, FRONT -- An unoccupied ground area fully open to the sky
between the street line~ or between the street line established
by the Official Map of the town or an approve subdivision plat,
and a'tine drawn parallel thereto."
Section 2. 'In Article II, Section 200, the designated title'of the
C-1 District is hereby amended to read as follows: "General Indus~ria~
Districts."
Section 3. In Article III, Section 300:
A. Subsection 7(a) under B, Uses Permitted by Special Exception by the
Board of Appeals~ is hereby amended to read as follows:
"No building, tent, activity area or recreation facility shall be
less than two hundred (200) feet from any lot line, and any such
building, tent, activity area or recreation facility shall be
effectively screened therefrom aa required by the Planning Board.
Buildings intended for use as sleeping quarters shall be not less
than thirty (30) feet from each other, except tents, which shall be
not less than ten (10) feet apart."
B. Subsection 9(a) under B, Uses Permitted by Special Exception by the
Board of Appeals, is hereby amended to read as follows:
"(a)
There shall be docking or mooring facilities for not more than
two (2) boats other than those owned and used by the owner of the
premises for his personal use,"
Subsection 1 under C, Accessory Uses, Limited to the Following, is
hereby amended to read as fellows:
"1. Home occupations~ provided that: ..."

D. Subsections l(e) and (f) under C, Accessory Uses, Limited to
the Following, are hereby repealed.
Section 4. In Article VII, Section 700, Subsection A1 is hereby amended
so as to refer to "... Section 300A, Section 400A, Section 500A~ Section 600A'
and Section 602..."
Section 5. In Article IX, Section 900, Subsection 21 is hereby amended
to read as follows: "Oil, rubber or leather manufacture."
Section 6. In Article XIII, Section 1301, Subsection C(2)(i) is
hereby amended~to read as follows:
"(i)
Whether a hazard to life, limb or property because of fire% flood,
erosion or panic may be created by reason of or as a result of the
use, or by the structures to be used therefor, or by the inaccessi-
bility of the property or structures thereon for the convenient
entry and operation of fire and other emergency apparatus, or
by the undue concentration or assemblage of persons upon such
plot."
Section 7. In Article XV, Section 1501, Subsection 10~ the section
reference under the entry for "SIGNS" is hereby amended to read as follows:
"... Section 300C6(a)..."
Section 8.

In Article XV~ Section 150~ is hereby amended to read as
"For every offense against any of the provisions of this ordinance or any
regulations made pursuant thereto~ or failure to comply with a written notice
or order of the Building Inspector within the time fixed for compliance there-
with, the owner~ occupant~ builder~ architect, contractor or their agents
or any other person who co~nits~ takes part or assists in the commission of any
such offense or who shall fail to comply with a written order or notice of the
Building Inspector shall, upon conviction thereof, be guilty of a violation
punishable by a fine not exceeding fifty dollars ($50.) or imprisonment for a
period not to exceed six (6) months~ or both. Each week's continued offense
shall constitute a separate, additional violation."
Section 9. In Article XV, Section 1504, Subsection 2 is hereby amended
to read as follows:
"No certificate of occupancy shall'be issued for the use of a building or
lands requiring a Special Exception or special permit by the Board of
Appeals or for any land or ~4se requiring a site plan approval by the Planning
Board unless and un~il such special exception or special permi[ use or site
plan approval has been duly granted. Every certificate of occupancy for which
a special exception,, special permih or site plan approval has been granted
or in connection~ith which a variance has been granted by ~he Board of Appeals,
shall contain a.detailed statement of .any ~ondiiion to which the same is
subject." ·
Section 10. This ordinance shall take effect as provided by law.

collectible by the town in the amount of one hundred dollars
($100.) for each such offense. Such penalty shall be collectible
by and in the name of the town for each day that such violation
shall continue. ~
In addition to the above-provided penalties, the Town Board
may also maintain an action or proceeding in the name of the
town in a court of competent jurisdiction to compel compliance
with or to restrain by injunction the violation of this ordinance."
Section 4.
Section 1100 of Local Law No. 1-1967, entitled "A Local Law Establishing
a Housing Code for the Town of Southold," is hereby amended to read as follows:
Any person committing an offense against any provision of this
local law, or any person who fails to comply with a notice or order
within the time limit stated thereon, shall~ upon conviction thereof,
be guilty of a violation punishable by a fine not exceeding two
hundred fifty dollars ($250.) or by imprisonment for a term not

ETHICS AND A BOARD OF ETHICS FOR THE TOWN OF SOUTHOLD
Be it enacted by the Town Board of the Town of Southold as follows:
Section 1.
Section 4 of Article II of An Ordinance Relating to a Code of Ethics
and a 8oard of Ethics for the Town of Southold, adopted 6-30-70, is hereby
amended to read as follows:
"In addition to any penalty contained in any other provision of law~
any such town employee who shall knowingly violate this ordinance may be
fined, suspended or removed from office or employment in the manner provided

AN ORDINANCE TO AMEND AN ORDINANCE REGULATING THE RAISING AND
BLEEPING OF DUCKS WITHIN THE 'tOWN OF.SOUTHOLD
Be it enacted by the Town Board of the Town of Southold as follows: ·
Section 1.
Section 2 of An Ordinance Regulating the Raising and Keeping of Ducks
within the Town of Southold, adopted 5-24-49, is hereby amended to read
as follows:
"No person shall raise or keep ducks for personal or family use,
'lin excess of one hundred (100)~ without first obtaining written per-
mission of the Town Board."
Section 2.
Sections .3, 4 and 5 are hereby renumbered as Sections 4, 5 and 6,
respectively~ and a new Section 3 is added as follows:
"Section 3. Applications and issuance of permit.
"A. Applications for the permit required by Section 1 above shall be
on forms provided by the Town Clerk and shall include, among other
things, the following information:
(1) The number of ducks proposed to be raised.
(2) A description of the structures and enclosures to be used for
such ducks, including:
(a) The design and dimensions.
(b) Type of construction and materials to be used.
(c) Sanitary provisions.
(3) Provisions for the collection and disposal of all waste matter.
"B. In addition to the above information, the Town Board may require
such information as will enable it to make a proper determination~
including the submission of a sketch of the property in question,
and of all property within two hundred (200) feet~ showing:
(1)' All existing and proposed buildings, structures and enclosures.
(2) All property and street lines.
(3) All bodies of water and drainageways.
(4) Any other pertinent details.
AN ORDINANCE TO AMEND AN ORDINANCE PROHIBITING AND REGULATING
THE DISPOSAL OF GARBAGE AND RUBBISH
Be it enacted by the Town Board of the Town of Southold as follows:
.Section 1.
Section II of An Ordinance to Amend an Ordinance Prohibiting and
Regulating the Disposal of Garbage and Rubbish, adopted 3-23-48 and
amended in its entirety 6-25-65, is hereby amended to read as follows:
No person shall collect, store, accumulate~ throw, cast~ deposit
or dispose of, or cause or permit to be collected~ stored,
accumulated, thrown~ cast, deposited or disposed of, any refuse
upon any premises or upon any street~ highway, sidewalk~ or
public place within the Town of Southold~ except when authorized
by the Town Board.
"B. Nothing contained herein shall be construed so as to prevent:
"(i)
The temporary accumulation of refuse hy a resident of the
to~n upon premises occupied by him to the extent that
such accumulation is ordinary and necessary for his
personal household requirements.
"(2) The disposal of refuse at any refuse disposal area
maintained or authorized by the Town of Southold.
"(3)
The proper use of receptacles placed upon the streets or
other public places in the Town of Southold for the
depositing of refuse; provided~ however, that such public
receptacles shall not be used for the deposit of accumulated
household garbage.
"(4)
The engaging in secondhand junk and auto parts activities
and businesses when a license therefor has been obtained
pursuant to the provisions of the Southold To%~n ordinance
licensing and regulating secondhand junk and auto parts
activities and businesses."

"A. The owner or licensee of any such place of business who commits or
permits the commission of any offense against any of the provisions of this
ordinance shall be deemed to have committed a violation and shal~ be liable
for any such offense or penalty therefor. Each day such offense shall con-
tinue or be permitted to exist shall constitute a separate offense.
"B. For every offense against any pro~s'i&n of this ordinance, the person
.committing the same shall, upon conviction thereof, be subject to .a fine of
not more than two hundred fifty dollars ($250.) or imprisonment not exceeding
fifteen (15) days, or by both such fine and imprisonment.
"C. Conviction for any above-mentioned offense shall constitute and effect
an immediate forfeiture of the license.
"D; Any person committing an offense against this ordinance shall ~upon
Conviction thereof, be subject to a civil penal~y enfo~'ceable and collectible
by tile town in the amount of one hundred dollars ($100.) for each such
offense. Such penalty shall be collectible by and in the name of the ~0wn for
each day that such offense shall continue.
"E. In addition to the above-provided penalties and punishment, the Town
Board may also maintain an action or proceeding in the name of the town in
a eourt of competent jurisdiction to compel compliance with or to restrain
by injunction the offense against such ordinance."
Section 6.
Section XI of An Ordinance Regulating the Taking and the Manner of Taking Shellfish
in the Town of Southold adopted 6-23-66 is hereby amended to read as follows:
"A. Any person convicted of ~(n offense against any provision of this ordinance
shall be deemed to have conamitted a violation against such ordinance~ and
also shall be liable for any such offense or penalty therefor.
"B. For every offense against any provision of this ordinance, the person
committing the same shall be subject to .a fine of not more than two hundred
fifty dollars ($250.) or imprisonment not exceeding fifteen (15) days, or by
both such fine and imprisonment.
"C. A second conviction for an offense against any of the provisions of this
ordinance within a period of one (1) year shall constitute and effect an
immediate forfeiture of a permit issued to such person. No new permit
shall be issued to such person for at least one (1) year after such forfeiture.
"D. Any person committing an offense against this ordinance shall be sub-
ject to a civil penalty enforceable and collectible by the town for each such
offense. Such penalty shall be collectible by and in the name of the town.
"E. In addition to the above-provided penalties and punishment, the Town
Board may also maintain an action or proceeding in the name of the I:own in
a court of competent jurisdiction to compel compliance with, or [o restrain
by injunction, the Offense against this ordinance."
Section 7.
Section 330 of An Ordinance Regulating Dredging, Filling, and Construction
Operations on %Vetlands in the Town of Sou/hold adopted 6-29-71 is hereby amended
to read as follows:
"A. Any person committing an offense against any provision of this ordinance,
or failing to comply with a notice of violation issued by the Building Inspector,
shall upon conviction thereof, be guilty.of a violation punishable by a fine not
exceeding two hundred fifty dollars ($250~) - or by imprisonment for a term not
exceeding fifteen (15) days, or by both such fine and impri~so~ment. The
continuation of an offense against the provisions of this ordinance shall con-
stitute, for each day the offense is continued, a separate and distinct offense
hereunder.

Supervisor Albert Martocchia called the meeting to order.
Councilman Rich read the Notice of Hearing, as follows:
PL~A~ take notice that, in connection with the codification of the
ordinances and local laws of the Town of Southold, the following ordinances
and local laws were introduced at a meeting of the Town Board af the Town
af Southold held at the offices of the Town Supervisor, 16 South Street,
Greenport, New York, at 3..00 P.M. on the 19th day of June, 1973:
1. A Local Law to Amend the penalty provisions af certain existing
ordinances and local laws of the Town cf $outhold .
Said local law pro~ides that offenses against the ordinances and
local laws enumerated therein be deemed violations with maximum penalties
of a fine of $250. and/or imprisonment for not exceeding 15 days. The
penalty sections cf certain ~f such ordinances and local laws also
contain provisions for civil penalties and/or injunctive relief.
2. An Ordinance to amend an Ordinance relating to a Code of Ethics and
a Board of Ethics for the Town of Southold.
Said amendment clarifies the wording of Section 4, Violations, af

Article II of said Ordinance,
3, An Ordinance to amend an Ordinance regulating the burning of rubbish,
Said amendment provides for the issuance o~ permits and the standards or
conditions thereof,
4, An Ordinance to amend an ordinance regulating the raising and keeping
af ducks within the Town of Southold,
Said amendment lowers the number of ducks which may be raised for pereonal
use without a permit from 1.50 to 100 and establishes the requirements for the issuance
of a permit and the application therefor,
5o An Ordinance to amend an Ordinance Prohibiting and Regulating the ~)is-
posal of Garbage and Rubbish,
Said amendment revises provisions concerning the disposal of refuse and
prohibits the use of the town disposal area for any garbage or refuse not
originating within the Town of Southold,
6, An Ordfdance to amend an Ordinance regulating the taking and the m~anner
of taking shellfish in the Town of Southold,
Said amendment revises the definition of"shellfish" to include blue claw
crabs and mussels and establishes regulations for the taking of such shellfish
frill tow~ waters,
7. An Ordinance to amend the Excavation Ordinance of the Town of Southold,
Said amendment exempts from permit requirements any sod farm/no operation
which removes two inches or less of topsoil annually,
8. An Ordinance to amend the traffic ordinance of the Town of Southoldo
Said ameddment makes certain organizational changes within the ordinance
and establishes new schedule listings for stop signs and yield signs and provides
for restricted parking at certain streets in the Town.
9. An Ordinance to amend the zoning ordinance of the Town of $outholdo
Said amendment clarifies the wording of various sections of said ordinance
and updates the penalty provisions for offenses against the ordinance.

law and ordinances entitled and described above will be held at the Supervisor's
Office, 16 South Street, Greenport~ N.Y. at 7:30 P.~4. on the 17th day of July~
1973 at which time and place all interested persons will be given an opportunity
to be heard.
Copies of the proposed local law and ordinances are on file in the office of
the Town of Supervisor and in the Office of the Town Clerk, where the same may be
inspected during office hours.

Supervisor ~rtocchia: Also in the Traveller of $outhold: an extra paper
that ~';e use. We have proof of Notice posted in the T~n Clerk's Office, Albert
Richmond sworn to and the Comments of the Suffolk County Planning Department, leaving
this m~tter to local determination. We have notified the Town of Riverhead, the
Town of Shelter Island, the Town of Southampton~ the Town of East Hampton, and the
Village of Greenport~ the Village ~f Deering Harbor, the Suffolk County Planning
Commission~ N.Yo State Department of Parks and Recreation~ and Suffolk County Dept.
of Parks. They've a!l had proper notice and everything is in order to start dis-
cussing any of the items that were read off. The floor is open to anybody who
wishes to discuss any of the changes.
Ed F. ruszeski, Bayman: The amendment to the "shellfish" law. Is that just
changing it to include blue crabs and mussels with no regulations to size or anything?
Robert Tasker, Attorney: As to blue crabs there is a size limitation~
inches from point to point, and one-half a bushel a day for non-commercial purposes
and female blue claws, with eggs visible called "sponge crabs", should not be takenj
and as to mussels~
Ed Kruszeski: Wait, let's not get into mussels yet. H~v about non-residents?
Judge Surer: That hasn't changed.

Councilman Homan: Well, we include blue crabs, no blue claws, with the
clams~ scallops, oysters, in other words, you've got to have a license to take any ~f
these, so non-residents would be affected.
Ed Ifruszeski: You don't stipulate it there though in the amendment
Councilman Homan: Yes, we do, because we amend it to read~ not only clams,
scallops and oysters, but also blue crabs and mussels.
Ed t~uszes~i: Ail right, now you've got another point here, how about a
shedder or a peeler, you say five inch~ there is at the ~resent time, no law at all
on the blue crabs, in New York State, why don't you adopt the same law as the
state had which was five inch for the hard shell crab~ for the shedder or peeler~
was three inch that's a soft shell crab with the hard shell with it. Once it sheds
it ~vill gain that 1/2 inch, and for the soft crab, three and one-half inches.
Councilman Homan: I don't think in my own personal opinion, that soft-shell
crabs are that much in abundance~ th*t we should lower our limit to specifically
include it.
Ed !(ruszeski: Yeh, but when you are hard-crabbing~ nine times out of ten
when you get a hard crab or a soft crab: it's with a hard crab. Now that crab is
going to be caput. If you don't take that crab, what are you going to do with it,
once you thrc~, it into ~he boat and that other crab chews it all to pieces.
Councilman Homart: Well, I would like to think the good people cf $outhold
Town when they came upon that situation, would put bo~h of them back.
Ed Kruszeski: That's what we tried to get, I believe it's back in 1969
I'm glad the To~ Board has finally come up with z bl~]e crab law. But, I don't

eggs. I ~:ou!d like to see that amendment made to include the shedder and the soft-
crab.
Councilman Homan: Well, if the shedder is less than five inches, personally,

to the Bayman's Association, and asked if we would go over so~e of the Creed ordinances

the same ms the State had. ~,~.~.,; there is no problem there at all0 gverybod;, seemed
happy ~,~ith the state law.
Councilman !~'o~n: '..Vel!~ we've got everything as the State Law with the
exception of the peeler crab.

Councilman !.-:oman: Other~vlse we have got it in its entirety and personally,
I don't kn~ how many ~f the people in the audience feel about it, but I don't think
it's that big of an issue. To begin with, you've got to educate the people to what
a peeler crab is. You know, and I know and Jarvis knows, but the rest of this To~
Board doesn't even ..~a..~v. You can't pass the law that people don't even understand.

We will take into consideration everything you have mentioned, it cannot be
incorporated into the .~eeting tonight,but if we settle down, we will give it thought.
Ed I~ruszeski: That just includes, ncaA; tonight, nca.~ it's the blue crab
includes ~he shellfish and five inch crab, nc~ until something else comes up, you
cannot take a soft shell which is three and one-ha]~ inches, or you canno~ take a
peeler. Anything less than five inches~ you cannot take. ~o is going to enforce this?l
Supervisor :,-~rtocchia: %\~11, I guess you will in ~he creeks° Januick
will do durs ss much as is humanly possible. We only have so many legs~ so many
arms, so many guys on the jobs and so many creeks, we don't have that many eyes.
We kno~ ~hat we can trust the Baymen to give each other a fair shake: don't
cheat on each o~her, in other words.
Councilman Homan: ~3~d by publicly posting these notices in conspicious
places in and around the wae~er, we hope this will self-educate people.

from the North Fork Environmental Council:

"An Ordinance to amend ordimance regulations of the taking and manner of
taking shellfish in the Town cf Southold."
We wish to compliment the Town Board for the additions to our ordinance
regarding shellfish, but we do urge the following recommendation to be considered:
In regard to taking mussels for bait from the bogs on inland waters, we
urge that not more than 1/2 bushel to be taken by hand, no forks or rakes to be
used, as to prevent the bog from being distmrbed.
Also: Consideration should be given to the possibility of removal of shellfish
by permit only. The charge for such permit could be nominal, $1.00, and simplified
by using triplicate card system. This is being done at this time successfully on
Shelter Island. Permits would be for all Permanent, Temporary Residents~ the
guest permit to be used only when accon~anied by a permanent resident.

Supervisor Martocchia: Anyone e'lse wish to speak?
Joe Sullivan cf Cutchogue: I would like to ask a question about the
residency requirement, the newspaper article says 60 days would be construed as
permanent residency this dealing with the corrent legislation, I would suggest
that possibly ~ New York State residency laws which currently state a person
may become a bonafide resident within thirty days living in a school district or

purposes, llke voting and so on
Joe Sullivan: Well, what I am saying is that I think this provision can be
challanged in the courts I question why residents are given thirty days in most
other cases and sixty days here doesn't this discriminate against people who do live
in the town and want to become permanent residents, they have to wiit sixty days

I am writing in regard to Public Hearing ~o be held on the 17th of
7:30 P.M. on ordinances and local law that were introduced on June 19, 1973. To

General discussion among the audience
Supervisor Martocchia: We don't want somebody come in for forty days for the
summer and take all our livestock. Any other questions on this part of the hearing,
Anyone else wish to be heard on any matters that were advertised for this particular
hearing ·
~enneth Tabor, Chairman Board of Fire Commissioners: About a month ago,
our Board of Fire Commissioners received a letter from our Fire Dept. stating
that at their meeting it was voted unanimously that we the Commissioners request
that the Town Board take under consideration one side of the street parking on
Orient Village Lane. We as Commissior~rs voted unanimously that this was a very
necessary change which should take place as soon as possible· I then contacted
Louis Demarest and gave him the two letters, one from the Dept. and one from the
Commissioners. He brought the matter up before the Town Board and they decided to
hold a hearing on this matter, so here we are. We would request that there be one
side of the street parking on the west side of Village Lane, from Orchard St., to
the Monument at the north end of Village Lane, also one side of the street parking
on the east side from Orchard St. South to the dock. This would make it easier
for the Fire trucks to go with the flow of traffic on the right side of Village
Lane in which ever direction the trucks have ~o go. Also with the parking as we
suggest, people can park in front of the stores and the post office and also in
front of the Historical Society buildings.
As conditions are today, our fire truck simply cannot move on Village Lane.
The chief has instructed the fire company, that in case of a fire any where on
Village Lane, other alternate routes are to be used which, of course, will delay
the fire company getting to the fire as soon as possible. I am sure you realize

Other factors concerning the congestion on Village Lane is the safety of the
children congregating at the Post Qffice and the stores. They are constantly ooming
and going on foot and on bycycles and at times darting out into the road.
Considering ail of the above factors, we members of the Orient Fire Dept. hope
for an early favorable action on this matter.
Supervisor Martocchia: Do you have a copy you wish to submit to the steno.
~enneth Tabor: Yes, I think at this time, it would be nice to hear from
our Chief.
Elbert Luce, Chief: Relating to this letter which was composed by Mr. Tabor
I approached the Commissioners back 2 or 3 months ago asking for these regulations
simply because we have purchased within the last year a piece of fire fighting
equipment. The truck, with the traffic that is parked on Village Lane, physically
cannot pass through that part of the Vil~e. So, you see for the safety of li~e
and property along Village Lane and next to Village Lane, ! feel it really is
imperative that this regulation is passed.
Supervisor r~rtocchia: Thank you. Is there anyone else who wishes to
speak on that subject?
Joe Sullivan: I might back up what these people are saying, I just
happened to come out of the lane where the tire house is one day last week, and I
was driving an F100 pickup truck which is a little big and there were cars parked
on both dides of the street, and as I rounded the corner in the traffic lane,
another woman was coming along the street and ~lmost collided with my truck, it is
hard to pass by.
Supervisor Martocchia: Thank you. Yes?
Eloise Norklun: The man who usually speaks here isn't here. There
has been some opposition~ ~ don't know. In the way of preventing enough trs£fic
to stop at stores long enough and within a decent distance to .make purchases, it

block ~ff our front because we have an entrance from the back. It's for our own
use ~f course, but there maybe somebody else here who does feel that it will hurt
the business o
Supervisor Martocchia: Thank you, is there anyone else~ Mr. Douglass?
~obert Douglass: Mr. Chairman and the Board, I am a member ~f the Orient
Fire Department, Board ~f Fire Commissioner~, and also a heavy machine operator
I feel that this is a very serious matter for more than one reason. The way the
situation is now, they couldn't get to either fire, or life or property in this
area along the village under most hours cfi the day and all hours of the evening
and a matter of five minutes to ten minutes would more time than you could afford
if there was any life involved let alone property. I can quarantee you as of today
in travelling Village L~ne ~ ~{,.,e times today, I have at one point waited ten
m/nutes to get between tv~o cars to get into the next little slotto park to wait
for some more to go through . .And this is the only way that you can traverse
Village Lane, most or._' the day and most of the evening is by running the slot
between the parked cars. I don't think this would have any adverse affect on
anybody's business. Business wizej we are all going the same place - it may give
us a little round about way to get to the local business to get on the right side
of the street~ hc~ever, when these firemen are coming to fires or when we have to
get the equipment out of there~ or the emergency wagon, the emergency wagon even
~ore important today. The emergency wagon is u~ed ten times to one of the fire
truck. The emergency wagon has been proved for a heart attack, if he has to sit
ten minutes to wait and I can gsarantee that he will, if he has to wait, it can
mean somebody's life. It is very imperative~hat we change it and it won't affect
anybody, it :von't hurt anybody and it will give the equipment the right to go down
on it's own lane the way we have suggested the parking.

I don't want to give the impression that I am opposed
My family some ~f them-live over on Village Lane. How-
ever I wonder if it can _he enforced any better than when we had it previously a
fe~ years back?
Supervisor ~artocchia: Well, I can best answer that by saying, in our
reports that come back to us, If we feel it is not being enforced proper!y,~e can
assign a special there for awhile, until we break so_~e habits

Bill Terry: Gentlemen:
In regard to Public H~Ering to change Zo one side of the
street parking in the Village of Orient, Village Lane, I urge the Board to accept
the proposals and recommendations as set forth by the Orient Fire Dept. This is
not only a ~fe-guard which would enable the fire trucks to get to a fire as
quickly and as safely as possible~ but Village Lane a narrow roadway is not wide
enough to acco.~modate traffic north 8.nd south in addition to parking on both
sides. I feel it is almost a m/racle that no serious accidents have occurred.
In addition could there be under the advisement of the $outhold Town Police
Dept. ~ a policy used to circumnavigate the flow ~f traffic around the monu_.~ent.

Elbert Luce: I would like to make one more quick comment. This re=
commendation from the Fire Dept. and the Board of Commissioners was unanimously
recommendated by the Department.

Floyd Fdng~ Orient: In favor of the proposal for the safety of the
people using Village Lane 365 days a year, and not just the times the equipment
uses it. A~d I think to support this, the Town Board should provide parking signs
patrols~ and anything else it takes to enforce this.

favorable on this matter ~hen will it be put into affect? %~e would like to have
it not drag on and on and on.
Robert Tasker: Well, if, when the ordinance is adopted,the change,
it has to be published in your local paper for ten days and then it becomes
effective ten days a~j~er the pbblication and also it has to be posted with signs
it can't become effective until both the enactment and the posting and signs are
put up . Then it becomes effective~

preparation of the Code of the Town of Southold, new proposed local laws~ to be
included in the codification were introduced at a meeting of the Town Board of the
Town of Southold held at the offices of the Town Supervisor, 16 South Street,
Greenport, New York, at 3:00 P.M. on the 19th day of dune, 1973 as follows:
!. A local law to provide for the control of litter in the Town of Southold.
Said local law prohibits litter in public places; ~itter from vehicles; litter
in parks, beaches and bodies of water; litter on private property; regulates the
distribution of handbills; and established penalties for ~ffenses.
2. A local law to provide for the licensing and regulation of peddlers and
solicitors within the Town of Southold.
Said local law requires the licensing of peddlers and solicitors; establishes
application requirements, procedures for investigation of application and issuance
of the permit; establishes a perm_it fee and license conditions; imposes various
restrictions on the operation of permitted busiless activities; and provides
penalties for offenses.

Robert Reeves: Does this include the trucks that go back and forth to
the dump?
Judge Surer: It can, but it is already in the Vehicle and Traffic Law
Robert Reeves: Well, we have numerous calls about this, and by the time
the police get there~ they are already unloaded and we have several bad offenders
Sbedrick is one of them.
Supervisor Martocchia: I think we have something in the Refuse Ordinance

Joe Sullivan: I have a resolution of the Southold Town Democratic Committee

Notice of Resolution - Unanimously passed by Southold Town Democratic Committee
P. esolved that the $outhold Town Democratic Committee is opposed to the
adoption of any proposed ordinance or local laws which would, in any way,
restrict or regulate the circulation and/or distribution of political leaflets
and literature an~here in the Town of Southold, or to any proposed local laws
which would in any way interfere with the election district activities, door to
door canvassers, telephone canvassers and candidates for office.
B~ it further Resolved That The Southold Town I~emocratic Committee opposes
the proposed standardization, on across the board basis for all fines or sentences
for infractions of local ordinances or local laws.
The idea here ~,~as that ~.~e'd hate for it to be enforced where one guy was held
for murder and another guy for littering, and they both got the same sentence.
I think the same concept applies to local laws. I would like to read a personal
statement too.
"I would like to point out that the proposed local anti-litter and anti-
sol~_citor legislation, as now ~ritten, could be misueed to limit the political
freedom and right to free expression of local residents, particularly where the
loca! press is biased in favor of the political party in power.
The political leaflet or handbill is in the finest tradition of Thomas Paine j
Samuel ~ams, Patrick Henry and other Patriots of the American Revolution, and I
no~
believe the freedom to distribute political leaflets and other literature must/be

If the intent of the proposed local anti-litter legislation is purely to ban
litter, I submit the state already has anti-litter laws and appropriate penalties.
Perhaps the answer to litter is not new local legislation, but the enforcement ~f

The handbills, it doesn't prohibit handbills, here's
what it says "}~ndbills in public places" No person shall throw or deposit any
handbill on or upon any sidewalks, streets, or other public place within the Town.

No person shall distribute or hand out any handbill/except to a person willing to
accept it. In Vehicles. No person shall ~brow or deposit any handbill in or on
any vehicle exc4p~ it shall not be unlawful in any public place for a person
to hand out or distribu±e a h~dbill to any occupant of a vehicle who is willing
to accept it. The purpose is to prevent the litter. It doesn't prohibit the
distribution. Now, on private property , No person shall t~ow or deposit any
handbill in or upon any private property which are temporarily unim~abited. The
same thing applies° If the person is willing to accept a handbill, you can dis-
tribute it, but you can't just scatter them all over the town. And you can dis-
tribute handbills eo houses, as long as you put them in a place where they will not
bl~v away. So it has no prohibition.

element of supprise. You go in and they say we've got to check your literature,

religious, charitable, educational, civic or political organization, 2-any organ-

NOTICE IS HEREBY GIVEN that at a meeting of the Town Board of the Town of SoUthold, Suffolk County,
New York, held on the 31st day of July, 1973, amendments to certain town ordinances were enacted as
follows:
AN ORDINANCE RELATING TO A CODE OF ETHICS AND A BOARD OF ETHICS FOR THE TOWN
Section 1.
Section 4 of Article II of An Ordinance Relating to a Code of Ethics and a Board of Ethics for the Town of
Southold, adopted 6-30-70, is hereby amended to read as follows:
"In addition to any penalty contained in any other provision of law, any sUch town employee who shall
knowingly violate this ordinance may be fined, suspended or removed from office or employment in the
manner provided by law."
Section 2.
This ordinance shall take effect immediately.
AN ORDINANCE REGULATING THE BURNING OF RUBBISH IN THE TOWN
Section 1.
Sections i through 5 of An Ordinance Regulating the Burning of Rubbish, adopted 5-21-57, are hereby
renumbered as Sections 2 through 6, respectively.
Section 2.
A new Section I is hereby added to read as follows:
"A. The Town Board of the Town of Southold is hereby authorized to enter into an agreement with the
Board of Commissioners of any fire district now or hereafter established in said town, to provide for the
issuance of fire permits for the burning of grass, leaves, brush, rubbish, refuse, buildings or other
materials in the fire district in which issued.
"B. Such agreement shall provide standards or conditions for the issuance of such permits including, but not
limited to, specification of the exact location of the fire for which the permit is sought, and prohibition of fires
on streets, highways, sidewalks and other public places where deemed necessary.
"C. Violation of the conditions attached to any permit issued pursuant to said agreement shall be deemed an
offense against this ordinance and shall be punishable as such."
Section 3.
Section 3 of said ordinance, as renumbered by Section I above, is hereby amended by adding at the end
of the section the phrase".., as provided in Section I above."
Section 4.
This ordinance shall take effect immediately.
AN ORDINANCE REGULATING THE RAISING AND KEEPING OF DUCKS WITHIN THE TOWN
Section 1.
Section 2 of An Ordinance Relpdating the Raising and Keeping of Ducks within the Town of Southold,
adopted 5-~,-49, is hereby amended to read as follows:
"No person shall raise or keep ducks for personal or family use, in excess of one hundred (100), without first
obtaining written permission of the Town Board."
Section 2.
Sections 3, 4 and 5 are hereby renumbered as Sections 4, 5 and 6, respectively, and a new Section 3 is added
as follows:
"Section 3. Applications and issuance of permit.
"A. Applications for the permit required by Section 1 above shall be on forms provided by the Town Clerk
and shall include, among other things, the following information:
(1) The number of ducks proposed to be raised.
(2) A description of the structures and enclosures to be used for such ducks, including: (a) The design and dimensions.
(b) Type of construction and materials to be used.
(c) Sanitary provisions.
(3) Provisions for the collection and disposal of all waste matter.
"B. In addition to the above information, the Town Board may require such information as will enable it to
make a preper deterwinstion, including the submission of a sketch of the property in question, and of all
property within two hundred (200) feet, showing:
(1) All existing and proposed build/ngs, structures and enclosures.
(2) All property and street lines.
(3) All bodies of water and drainageways.
(4) Any other pertinent details.
"C. In arriving at a determination regarding the issuance of a permit to raise or keep ducks as a cdmmercial
enterprise, the Town Board shall be guided by all pertinent ordinances, local laws and regulations of the town,
and, in par0cular, the Zoning Ordinance. In no case, however, shall a permit be granted if a building structm-e
or enclosure containing ducks is located nearer than fifty (50) feet to a property line or dwelling, or nearer
than one hundred (100) feet to a street line."
Section 3.
This ordinance shall take effect immediately.
AN ORDINANCE PROHIBITING AND REGULATING THE DISPOSAL OF GARBAGE AND RUBBISH IN
THE TOWN
Section 1.
Section II of An Ordinance to Amend an Ordinance Prohibiting and Regulating the Disposal of Garbage and
Rubbish, adopted 3-23-48 and amended in its entirety 6-25-65, is hereby amended to read as follows:
"A. No person shall collect, store, accumulate, throw, cast, deposit or dispose of, or cause or permit to be
collected, stored, accumulated, thrown, cast, deposited or disposed of, any refuse upon any premises or
upon any street, highway, sidewalk, or public place within the Town of Southold, except when authorized
by the Town Board.
"B. Nothing contained herein shall be construed so as to prevent:
"(1) The temporary accumulation of refuse by a resident of the town upon premises occupied by him to the
extent that such accumulation is ordinary and necessary for his personal household requirements.
"(2) The disposal of refuse at any refuse disposal area maintained or authorized by the Town of Southold.
"(3) The proper use of receptacles placed upon the streets or other public places in the Town of Southold for
the depositing of refuse; provided, however, that such public receptacles shall not be used for the deposit of
accumulated household garbage.
"(4) The engagin~ in secondhand junk and auto parts activities and businesses when a license therefor has
been obtained pursuant to the provisions of the Southold Town ordinance licensing and regulating secondhand
junk and auto parts activities and businesses."
Section 2.
The existing text of Section III is hereby designated as Subsection A and a new Subsection B is added to said
Section III as follows:
"B. No garbage, refuse, rubbish or other material that does not have its origin within the Town of Southold
shall be deposited or disposed of in the town refuse disposal area."
Section 3.
This ordinance shall take effect immediately.
AN ORDINANCE REGULATING THE TAKING AND THE MANNER OF TAKING SHELLFISH IN THE
TOWN
Section 1.
In Section II(c) of An Ordinance Regnlating the Taking and the Manner of Taking Shellfish in the Town of
Southold, adopted 6-23-66, the definition of "shellfish" is hereby amended to read as follows:
"SHELLFISH - Clams, scallops, oysters, bh;e claw.crabs and mussels."
Section 2.
A new Subsection (f) is hereby added to Section III ag follows:
"(f) The presence of shellfish in excess of the limits, or of less size than that set forth in this ordinance,
found aboard any boat or vessel in the waters of the Town of Southold, shall be deemed presumptive
evidence of a violation of this ordinance."

"Section VIII. Mussels.
"A. A permanent resident may not take more than one (1) bushel of mussels from town waters in one (1)
day for noncommercial purposes.
"B. Not more than ten (10) bushels of mussels may be taken from town waters for commercial purposes in one
(1) day by any one (1) person. Two (2) or more persons occupying the same boat may take, in the aggregate,
not morethan twenty (2O) bushels of mussels in one (1) day for commercial purposes."
Section 5.
This ordinance shall take effect immediately.

Section 1.
Section III of the Excavation Ordinance of the Town of Southold adopted 2-16-65 is hereby amended to read

"No lands or other premises shall be operated or used as sand and gravel pits, or for the excavation or
removal of sand, gravel, stone or other minerals, or for other excavation purposes, or for the stripping or
removal of topsoil therefrom, including sod farming, (except such sod farming operations as remove only the
top two (2) inches or less of topsoil annually) without a currently effective permit issued by the Town Board in
compliance with the provisions of ~his ordinance or unless listed as an exception in Section IV."
Section 2.
A new Subsection (h) is hereby added to Section IV to read as follows:
"(h) The removal of two (2) inches or less of topsoil annually during the normal .operation of sod far-
ming."
Section 3.
This ordinance shall take effect immediately.

Section 1. In Article I, Section 101, the definition of "YARD, FRONT" is hereby amended to read as follows:
"YARD, FRONT - An unoccupied ground area fully open to the sky between the street line, or between the
street line established by the Official MaP of the Town or an approve subdivision plat, and a line drawn
parallel thereto."
Section 2. In Article II, Section 200, the designated title of the C-1 District is hereby amended to read as
follows: "General Industrial Districts."
,Section 3. In Article III, Section 300:
A. Subsection 7(a) under B, Uses Permitted by Special Exception by the Baord of Appeals, is hereby
amended to read as follows:
"No building, tent, activity area or recreation facility shall be less than two hundred (200) feet from any lot
line, and any such building, tent, activity area or recreation facility shall be effectively screened therefrom as
required by the Planning Board. Buildings intended for use as sleeping quarters shall be not less than thirty
(30) feet from each other, except tents, which shall be not less than ten (10) feet apart."
B. Subsection 9(a) under B, Uses Permitted by Special Exception by the Board of Appeals, is hereby amended
to read as follows:
"(a) There shall be dockina or moori~ facilities for not more than two (2) boats other than those owned
and used by the owner of th~ premises for his personal use."
C. Subecetion ! under (2, Accessory Uses, Limited to the Following, is hereby amended to read as follows:
"1. Home occupatimm, provided that~ ..."
D. Subsections l(e) and (f) under C, Acoessory Uses, Limited to the Following, are hereby repealed.
Section 4. In Article VII, Section 700, Subsection A1 is hereby amended so as to refer to "... Section 300A,

Section 5. In Article IX, Section 900, Subsection 21 is hereby amended to read as follows: "Oil, rubber or
lenther manufacture."
Section 6. I~Arficle XIH, ,Section 1301, 8tlbsection C(2) (i) is hereby amended to read as follows:
"(i) Whether a hazard to life, limb or property because of fu-e, flood, erosion or panic may be created by
reason of or as a result of the use, or by the structures to be used therefor, or by the inaccessibility of the
property of structures thereon for the convenient entry and operation of fire and other emergency ap-
paratus, or by the undue concentration er assamblage of persons upon such plot."
Section 7. In Article X'V, Section 1501, Subsection 10, the section reference under the entry for "SIGNS" is
hereby am_ended to read as follows: "...Sectiun 300C~(a)..."
Section 8. In Article XV, Section 1505 is hereby amended to read as follows:

Section 9. In. Article XV, Section 1504, subsection 2 is hereby amended to read as follows:
"No certificate of occupancy shaU be imued for the use of a building or lands requiring a Special Exception
or special permit by the Board of Appeals er for any land or use requiring a site plan approval by the Planning
Board unless and until such Special exception or special permit use or site plan approval has been duly
granted. Every certificate of occupancy for which a special exception, special permit or site plan approval has
been granted or in connection with which a variance has been granted by the Board of Appeals, shall contain a
detailed statement of any condition to which the same is subject."
Section 10. This ordinance shall take effect as provided by law.
