SCTM#1000-75-1-14 PROPERTY LOCATION: 42155 Main Road (aka NYS Route 25) (corner Peconic Lane), Peconic, NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 16, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property consists of 2.8765 acres and is zoned general business. The property is a corner lot with 368.97 frontage on the Main Road (Rout 25) and 382.63 feet of frontage on Peconic Ave. The property runs 310.3 feet on the East side and 361.77 feet on the North side. There is a one story brick, stucco, and concrete block building on the property, a one story concrete block and frame building, and a concrete foundation. All is shown on a survey by John T. Metzger L.L.S. dated November 29, 2011 and last updated January 2, 2014. BASIS OF APPLICATION: Request for Special Exception per Article XI Section 280-48B(10)to create a drinking establishment within an existing building located in the Business(B)Zone District. RELIEF REQUESTED: The applicant currently proposes to operate a micro-brewery with an accessory beer tasting room open to the public. The micro-brewery will make beer on premises and sell beer in the tasting room. Included with the tasting room the applicant intends to sell local farm goods, provide entertainment including music, provide finger foods for patrons, and to educate patrons about the process and culture of brewing locally made beer. The tasting room hours of operation will be approximately 11 am through about lOpm. The applicant testified that all of its service employees are certified in "TIPS" (Alcohol Training Awareness) training in order to identify and prevent any problems intoxicated patrons may present. The applicant eventually intends to expand the tasting room into a brew pub and to serve bar food and local wine in addition to its beer, which is a permitted use as of right in the B Zone. The Zoning Board requested comments from the Town Fire Marshall and the Planning Board. In an e-mail dated May 27, 2014, the Fire Marshall stated no objection to the proposed drinking establishment. In a memo dated June 3, 2014 the Planning Board had no objections to the Special Exception. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 5,2014 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or properties in adjacent use districts. The property is 2.87 acres and located on NY State Route 25 at the corner of Peconic Lane in Peconic that is surrounded by vineyards, local farms, and businesses. Across the corner from the property is an auto body business, the Town of Southold Highway Department's yard and work shop, and across the Main Road is a farm. Next door to the property on the East and North side is a vineyard. Access to and from the property will not impede nearby uses. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts because the micro-brewery with accessory tasting room is similar to the uses of the nearby vineyards who make wine, sell wine, and sell tastings. C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed use and its location. This will not be a late night bar or club, but rather a tasting room that will close at reasonable hours, serve food, and maintain a reasonable and orderly business. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. The property is located on the North Fork wine trail and on a main state road. It is located on a 2.87 acre parcel which is zoned for business. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. The size of the tasting room and micro-brew is less than 3% of the entire parcel. The facility will complement the parcel and be set back from the road way and be sufficiently screened. The neighborhood consists of industrial businesses, workshops, and vineyards and a micro-brewery fits with these uses. Page 3 of 3—June 19,2014 ZBA#6759—Mmmm Beer,LLC SCTM#1000-75-1-14 F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. The structure will have multiple entrances and exits, be a single story, and have a large open floor plan. It will be a block and timber structure. G. That the proposal shall comply with the requirements of Chapter 236, Storm water Management. The development of the property has increased the areas of permeable surfaces and the applicant has added on site drainage to handle storm water runoff. BOARD RESOLUTION: In considering all of the above factors, motion was offered by Member Dantes, seconded by Member Schneider, and duly carried to GRANT, a Special Exception, as applied for, and shown on the Survey prepared by survey by John T. Metzger L.L.S. dated November 29, 2011 and last updated January 2, 2014 and the architectural drawings by Robert I Brown labeled A2 and A5 dated April 2, 2014. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must obtain site plan approval from the Southold Town Planning Board. Failure to do so will render this Special Exception Permit null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. NOTE: This Special Exception permit cannot be transferred to new owners Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein.
