PROPERTY LOCATION: 230 Oyster Pond Lane Orient,NY. SCTM#1000-17-6-12 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 16, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject parcel is located in a R40 zone district and is non-conforming with 12,344 sq. ft. It is improved with a one story single family dwelling. It has 75.00 feet of frontage along Oyster Pond Lane, 167.00 feet along the southern property line, 75.36 along the western property line and 162.23 feet along the northern property line as shown on the site plan dated April 28, 2014 prepared by Robert 1. Brown, Architect. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's April 7, 2014 Notice of Disapproval based on an application for building permit to construct additions and alterations to existing single family dwelling, at; 1) less than the code required front yard setback of 35 feet, 2) less than the code required side yard setback of 10 feet, 3) less than the code required combined side yard setback of 25 feet. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to the existing single family dwelling with a front yard setback of 27 feet where the code requires 35 feet, a minimum side yard setback of 4.3 feet where the code required 10 feet and a combined side yard setback of 24.16 feet where the code requires 25 feet. ADDITIONAL INFORMATION: The immediate neighborhood is comprised of lots that are significantly non- conforming in size. The agent for the applicant provided information on the character of the neighborhood and similar variances granted for setbacks in the area. During the hearing, the agent for the applicant was questioned regarding the proposed at grade stone patio which places the lot coverage at a conforming 19.75 percent. Page 2 of 3-June 19,2014 ZBA#6756—230 Oysterponds Lane,LLC SCTM#1000-17-6-12 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 5, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not cause a detriment to the immediate neighborhood. The immediate neighborhood is comprised of older homes with non-conforming properties with non-conforming setbacks. Information submitted by the agent for the applicant indicates that numerous variances have been granted by the Board of Appeals in the Orient Hamlet. There are many other two story dwellings in the area similar in size and style to what the applicant proposes to construct. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The home has existed for more than 40 years in its present location. The applicant is proposing to convert the attached garage to habitable space on the existing footprint. The proposed additions will have conforming setbacks; however the minimum side yard exists at 4.4 feet and will not be changed. Although the lot is non-conforming in size at 12,344 sq. ft. it has a rather large rear yard. 3. Town Law &267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 56% relief for the minimum side yard setback and 18% for the front yard setback. The combined side yard setback is not substantial representing 3.4% relief. However, the substantialty is mitigated by the fact the footprint will not be changing where the non-conformity exists. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to the existing dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variances as applied for, and shown on a site plan dated April 28, 2014 prepared by Robert I. Brown, Architect, and the architectural drawing labelled first floor, second floor and north/south elevations dated 3/24/14 and the west/east elevation dated Mar. 21, 2014 prepared by Robert I. Brown, Architect. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted,because: We are not changing the footprint of the disapproved area of the home. It has disapproved—although only an interior renovation,because we are changing an attached garage into living space. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: We are proposing the least possible changes to pre-existing non- conforming setbacks—the front yard setback shall remain as it exists at 2817" with the need of a new front stoop-which is at the disapproval's quoted"approximately 27' "(as per the Corwin survey the existing front stoop is actually only 23' from the front property line)- while the pre-existing side yard setback shall remain 4.3'at its closest point. The proposed rear single story Addition is 19'10"from the South property line(also owned by the Treibers)—which combined with the pre-existing nonconformance totals 24.16' combined set back where 25' is required. The proposed second story additions have conforming setbacks of 10 and 35' as required by code. 3. The amount of relief requested is not substantial because: in the front we actually reducing the setback with a smaller stoop.On the side we are not increasing the pre-existing non-conforming 4.3 at the closest point on the north side while the total of 24.16 setback is only at the point of where the old joins the new as the proposed addition is 15' from the north property line(combined total of new construction is 34'+where 25 is required. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: Most of what has been disapproved although being improved is pre-existing non-conformance. I RECEIVED After investigation and personal inspection, the Board APR �r 7S� finds as follows: z 01 Appellant has appealed to the Board seeking a variance approving the insufficient area and width of two parcels on BOARD OF'APPEALS Village Lane (Main Street) , Orient, of approximately 7,300 square feet in area and 58.50 feet in width, and approximately 6,460 square feet in area and 51 .70 feet in width. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because addition to bathroom space cannot be created within the existing building without extensive reconstruction. (3) The requested area variance is not substantial in relation to the code requirement because total new construction will exceed the 20% allowed by 1 .26% (total: 21 .26%) . (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because relief sought will not interfere with the abutting properties and density limitations ire exceeded in the area. No. 4614 — RICHARD BOARDMAN PARCEL 1000-25-1-13 STREET & LOCALITY: 690°Village Lane, Orient DATE OF PUBLIC HEARING: October 15, 1998 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The above-referenced property is located in the R-40 Residential Zone district, being situate on the westerly side of Village Lane (76.30 ft. in width). this lot contains a total area of 9,626 sq. ft. and is improved with an existing house of 1079 sq. ft., existing shed 50 sf, garage 240 sf, bath addition 36 sf, bedroom addition 136 sf, living.room addition 320 sf for a total of 2,046 square feet. BASIS OF APPEAL: Building Inspector's August 25, 1998 Notice of Disapproval, disapproving an application to expand a recently-built deck by 85 sq. ft. because such addition will exceed the allowable lot coverage. AREA VARIANCE RELIEF REQUESTED BY APPLICANT• In May 1997, this Board granted a variance (under Application No. 4472) authorizing lot coverage of 21.26%, or 2046 square feet to accommodate an improvement project that included a new garage, additions to the house, and a new deck. Applicant has carried out these improvements, but has concluded that an additional 85 square feet is needed at the north end of the deck in order to have a rational traffic Flow between the house and the deck. this request is for a variance allowing total lot coverage of 2,131 sq. ft., or 22.1%. The deck is proposed to be located at the westerly corner of the dwelling maintaining the existing 9.5 ft. nonconforming setback which exists for the dwelling. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented and personal inspection, the Board makes the following findings: 1. Applicant's neighborhood is densely built on small lots, with relatively high lot coverage. The small size of applicant's lot is typical of the neighborhood. PROPERTY FACTS/DESCRIPTION: The applicant's 13,298 sq. ft. parcel has 121.68 feet along Oyster Ponds Lane and is improved with a one-story frame house and detached garage, as shown on the May 25, 2005 land survey prepared by John C. Ehlers. BASIS OF APPLICATION: Building Department's June 8, 2005 Notice of Disapproval, citing Sections 100-33 and 100-244 in its denial of an application for a building permit to construct a proposed addition for the reason that the rear yard setback is proposed at less than 35 feet and the new construction will create a new nonconformity with respect to the accessory garage, partly in a side yard instead of the code-required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 18, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a 12' by 163" wide one-story addition at the rear of his home, resulting in a rear yard setback of 24 feet(minimum).
