LOCAL LAW NO. 1 - YEAR 1964
A local law providing for public notices relating to adoption of local
Be it enacted by the Town Board of the Town of Southold as follows:
Section i. No local law shall be adopted by the Town Board of the
Town of Southold until a public hearing has been held thereon in its final
form before such Town Board not less than three nor more than thirty days
after public notice has been given of the time and place of the holding of such
public hearing. Such notice shall be given by the Town Clerk by causing
the same to be published once in the official newspaper of the town. Such
notice shall contain the title of the proposed local law and a brief explanatory
statement thereof.
§ 2. The Town Clerk shall cause to be printed or otherwise
reproduced copies of such proposed local law and shall, not later than the
day such notice is published, post one such copy together with the notice of
hearing on the sign-board at his office and shall also make copies of such
proposed local law available at his office for inspection by and distribution
to any interested person during' business hours.
§ 3. The Town Clerk shall forthwith upon the adoption of a local
law by the Town Board post a copy thereof on the sign-board at his office.
§ 4, l~roof of publication of the notice of public hearing required
by section one hereof and proof of the posting required by section three
hereof shall be filed in the office of the town clerk.
§ 5. Each local law shall be numbered consecutively beginning with
number one for each calendar year. When a local law is finally adopted, and
certified copies thereof are required by section twenty-seven of the municipal
home rule to be filed in the offices of the Town Clerk, the State Comptroller
and the Secretary of StaGe, the Town Clerk shall accordingly assign to su.ch
local law ils appropriate number.
§ 6. This local law shall take effect immediately.

"PUBLIC NOTICE is hereby given that there has been presented
to the Town Board of the Town of Southold~ Ne%~ York, on February
4~ 1964~ Local Law No. 1 of the Year 1964 entitled "A Local
Law Providing for Public Notices Relating to Adoption of Local

Supervisor Albertson explained the purpose of the hearing°
SUPERVISOR ALBERTSON: ~s there anyone present who wishes

SUPERVISOR ALBERTSON: Is there anyone present who wishes
to speak in opposition?
MR. JOSEPH KERWIN, Pine Tree Road, Cutchogue, New York
questioned the time limit of 3 days to 30 days as being the
time limit for a public hearing. He felt 3 ~ys was not
notice. Town Attorney Tasker explained that the

statute provides this and. it is probable that the time limit
would be more than three day~ in most cases.

Further, the cost would be great and not practical for the

Next Mr. Kerwin questioned the effective date of the
Local Law. He misunderstood that the effective date set forth
in the legal notice pertaine~ to the adoption of the Local
Law being considered at thislhearing. He was under the
impression it pertained to f~ture local laws. This point
was clarified.
