SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 16, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. BASIS OF APPLICATION: Request for a Lot Waiver under Section 280-11 to unmerge a vacant land area of 21,974 square feet (CTM 1000-111-06-017) from an adjacent land area of 18,419 square feet (CTM 1000-111-06-018), based on the Building Inspector's Notice of Disapproval dated April 1, 2014, pursuant to Section 280-10A, determining the properties have been merged. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 5, 2014 at which time written and oral evidence were presented. Pursuant to § 280-11 the Applicant has submitted documentation, to the satisfaction of the Board that these lots were merged consequent to the death of the owners. There have been no transfers of ownership outside the family since the time merger was effected. Pursuant to §280-11, the Zoning Board finds that (1) The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood because this sub-division has been developed with single family homes on lots as designated on the subdivision map. The average lot in this subdivision is approximately Page 2 of 2—June 19,2014 ZBA#6751—Auerbach SCTM#1000-111-6-17&18 20,000 square feet. The subject parcel is an interior vacant lot containing 21,974 square feet with a lot with of 100 feet on Haywaters Road. The adjacent lots all have residences built on them and are similar in size and shape to the lot which is to be unmerged. Four neighbors attended the hearing and by a show of hands all four were in favor of unmerging the vacant lot. Testimony was taken that smaller lots would lead to the building of smaller dwellings which is typical of the neighborhood. If the lots were to remain merged then a large mansion style home could be built and larger homes are not in character with the neighborhood. (2) The waiver would recognize a lot that is vacant(CTM 1000-111-06-017) and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation because the lot remains unimproved and ownership has remained within the applicant's family. The applicant has not maintained the lot other than to trim the weeds. The owners of the lots pay taxes on the lots separately. (3) The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because the lot was purchased as a building lot and was always intended to be improved. Any new dwelling would be connected to county water supply and any new septic system would have to meet current standards according to the Suffolk County Board of Health. RESOLUTION OF THE BOARD: In considering and balancing the above factors and pursuant to the Waiver Provisions of the Town of Southold Merger Law, Section 280-11, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried to GRANT the waiver of merger as applied for as shown on the survey by Barrett, Bonacci &Van Weele, PC, dated March 24, 2014,with the following condition: CONDITION 1. Proof that waiver of merger is effected by way of a deed from the applicant to a separate individual or entity conveying title to that portion of the property known as 1850 Haywaters Road be provided to the ZBA within 2 years of the date of this decision. Failure to comply with this condition will result in nullification of the waiver of lot merger granted herein. The subject property of this application is Subdivision Lot 372 as shown and designated on a certain map entitled, "Map of Section D, Nassau Point Club Properties, Inc. ", which map was filed in the Suffolk County Clerk' s Office on May 7, 1926 as Map No. 806 . The property is also designated on the Suffolk County Tax Map as Lot #1000-111-6-17 . (A copy of the subdivision map is attached to this application. ) This subdivision over the years has been developed with one-family residences on the lots as designated on the subdivision map. Further, when Zoning was adopted by the Town of Southold, the lot area and lot widths were excepted from the requirements of the Zoning Code. This continued for various amendments to the Zoning Code over the years. However, unbeknownst to our parents, Louis and Charlotte Auerbach, the Zoning Code was subsequently amended to merge any non-conforming lots held in common ownership and Nassau Point was not exempt from this merger. It is noted that, with the exception of this merger law, the subject parcel, Subdivision Lot 372, as well as the other individual lots on Nassau Point qualify under §280-9 (a) (1) and (3) of the Zoning Code as "recognized building lots" . The subject parcel is an interior vacant lot containing 21, 974 square feet with a lot width of 100 feet on Haywaters Road. The lot width and size of Subdivision Lot 372 are similar with the majority of the lots on Haywaters Road as well as the adjacent roads in this particular subdivision. Subdivision Lots 351, 352, 353, 354 and 371, which are adjacent to Louis Auerbach' s property, all have residences built on them, and the estimates taken from the Suffolk County and Southold Town Tax records have an average square footage of 22, 564 square feet and an average lot width of 108 feet, making Lot 372 similar in size and shape. Expanding the radius from Subdivision Lot 372 also along Haywaters Road, Old Menhaden Road and Vanston Road illustrates that these improved subdivision lots are slightly larger in area but comparable in lot width and shape to the subject lot. (See attached portion of Suffolk County Tax Map of Section D, Nassau Point Club Properties, Inc. ) ' AFP Page 3 3 APPLICANT ' S REASONS : (Sheet #2) (2) Your applicants ' parents, Louis and Charlotte Auerbach, purchased the residence located on Subdivision Lot 373 (Tax Lot 18) on April 28, 1962 . At the time of the purchase, Louis Auerbach was a school teacher in the New York City school system, residing in New York City with his wife, Charlotte, and their two children, Roy Allen Auerbach and Andrea Auerbach. Throughout your applicants ' teenage years, we spent enjoyable summers, school and family holidays at our parents ' house on Nassau Point. In 1967, the adjacent vacant parcel, Subdivision Lot 372 (Tax Lot 17) , became available for sale. Louis Auerbach researched this property and found that it was recognized as an individual building lot by the Suffolk County Department of Health and the Southold Town Building Department. On December 14, 1967, Louis and Charlotte Auerbach purchased Subdivision Lot 372 as a future investment for their children as prices for vacant building lots on Nassau Point were rapidly increasing. Your applicants recall that it was discussed in the family many times that this adjacent vacant lot was an independent building lot and would be available if either one of your applicants desired to build a home on it. Louis Auerbach retired in June of 1982, and he, along with his wife Charlotte Auerbach, became full-time residents of Nassau Point . Over the years, several additions were made to the residence on Subdivision Lot 373, for which building permits and certificates of occupancy were obtained (copies of which are attached to this application. ) Louis Auerbach was careful to have Subdivision Lot 372 remain vacant and as a separate building lot as he made no improvements to the lot . All he did was to have the weeds trimmed and kept the lot neat. Our children when visiting their grandparents would occasionally play on the vacant lot . Over the years since our parents brought this property, single-family homes were built on the surrounding subdivision lots . Charlotte Auerbach died on May 30, 1999 at the age of 81 years, and Louis Auerbach died on October 19, 2013 at the age of 101 years, owning both of these lots . Your applicants have married and have grown children who have moved out of the area. Your applicants as well as their children have no interest at this stage of their lives in utilizing either one of these properties . APF ! 0 20111 p Page 4 APPLICANT ' S REASONS: (Sheet #2) - CONTINUED In the process of our duties in settling the Estate of Louis Auerbach, we discovered that Subdivision Lot 372 had been merged with Subdivision Lot 373 . This came as quite a shock to us because Louis Auerbach always thought and treated this as a separate lot. In fact, each and every year the Town of Southold has issued separate tax bills for these two properties . (Copies of the current tax bills are attached to this application. ) Your applicants have always thought, as it was discussed over the years, that Subdivision Lot 372 was a separate and independent lot on which a residence could be built. Your applicants as Executors would like to be able to sell this property as two individual lots . Op 0 2014 Page 5 APPLICANT' S REASONS: (Sheet #3) The subject property, Subdivision Lot 372, is located on Nassau Point which is a residential neighborhood with rolling terrain. The subject parcel (Lot 372) is the only vacant lot in the neighborhood, is level, and suitable for the construction of a one-family residence. The lot will not require any fill or contour altering for the construction of a one-family dwelling. The recognition that the subject parcel is a building lot for the construction of a single-family home will not create any adverse impact by allowing an additional residence to be built which would be in conformity with both the physical and environmental conditions of the neighborhood of Nassau Point.
