BOUNDARY LINE AGREEMENT ORIGINAL
AGREEMENT made thisal"day of October,2013, between JOSEPH SCHAFER and
CYNTHIA SCHAFER, residing at 1030 West Lake Drive, Southold,New York 11971
(hereinafter referred to as"SCHAFER"),party of the first part,and DING SHARI CAI,residing
at 62-11 Asquith Crescent, Rego Park,New York 11375, (hereinafter referred to as ACAI6), party
of the second part.
WHEREAS, SCHAFER is the owner in fee of certain real property situate in the Hamlet of
Southold,Town of Southold, County of Suffolk, State of New York, known as 1030 West Lake Drive,
Southold,New York 11971,(sctm#1000-090.00-02.00-003.000)by virtue of deed dated September 16th,
AT Ph-FP LV3EA 1 X74y, PW-X-c(3'3L,,�AC
2013, said deed recently recordedthe Suffolk County Clerk's office,the
unrecorded deed is attached hereto; and CAI is the owner of premises immediately adjoining the aftAvsaiJ
premises of SCHAFER, on the East thereof, known as 380 Midway Road, Southold,New York 11971,and
the CAI deed describing said property was recorded on November 8, 2012 at deed liber D00012710 at page
489, which is an exhibit hereto; and
WHEREAS, the boundary line between said premises of SCHAFER and the premises of CAI is
described in the aforesaid deeds of SCHAFER and CAI and is shown on a survey prepared by John C. Ehlers
Surveyor,dated 9/11/13,which survey shows a 2.7 foot stone encroachment onto the SCHAFER premises
from the CAI premiss/es which CAI encroachment is upon the SCHAFER premises and a copy of the Ehlers
survey is as exhibit"ier to;and
WHEREAS,CAI does not seek to assert a claim against the Schafer property on the basis of the
existence of the 2.7 foot stone encroachment; and
WHEREAS,the parties hereto deem it proper that this declaration and agreement should be
entered into defining their respective rights,duties and obligations concerning said in common boundary
line,
NOW,THEREFORE,the parties hereto agree as follows:
1. CAI hereby represents and declares that she does not claim and hereafter shall not clgiyi
any right,title, interest, easement or otherwise in or to any portion of the said land of
SCHAFER, lying to the West of the aforesaid boundary line as described in the CAI deed
and does hereby remise, release and quitclaim unto said SCHAFER,his heirs and assigns
forever,all of her right,title and interest in and to any land lying to the West of said
boundary line.
2. This agreement shall run with the land and be binding upon and enure to the benefifef
the respective heirs,executors,administrators,successors and assigns of each of the
parties hereto.
