Therefore, in accordance with the current Wetlands Code (Chapter 275)and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. The subject I am concerned about revolves around a parcel of land in the hamlet of Cutchogue formerly known as 1000-116-06-12, now in the eyes of some subdivided into two parcels 1000- 116-06-12.1 and 1000-116-06-12.2 There is a question of ownership of the second identified parcel of land (1000-116-06-12.2)that is currently being contested in the Supreme Court of the State of New York, County of Suffolk in the court of Judge Andrew Tarantino. The case reference is Todd Freed and Edith Webster Freed v Barbara Best and Zarko Svatovic and is currently still active. The homeowners in the adjacent neighborhood have deeded beach rights. Mr. Freed has already been fined for activities on the parcel and for removal of healthy landscaping. He additionally ravaged the rest of that parcel removing beautiful trees and under plantings that had existed on that property for many years. The fact that litigation existed was discussed with the then new Assistant Town Attorney,the Chief of Police,the Building Department,the Planning Department, and the Trustees. We personally affirmed in each of these departments the fact that litigation was ongoing and that permits that infringed or impacted that parcel should be questioned and referred to your office and that any police officer deployed to the site would be aware of the litigation. In no way have we challenged Mr. Freeds use of the parcel he is building on nor have we taken any action to interfere with that work. However, anything impacting the Right of Way(ROW) is of paramount interest to my fellow deeded rights owners in my neighborhood. Recently, the building department informed us the site 12.1 and 12.2 in their eyes and with direction from your office was to be treated as one parcel, even though the plans for construction submitted indicate and reflect 2 parcels. Until recently everything done at the site has complied with the boundaries as if the property was 2 contiguous lots and no infringements were made. About two weeks ago, without permission, heavy equipment and land fill was put on'the ROW in direct contradiction to previously issued requirements by the court. We were heard by Judge Tarantino and he concurred with our complaint and Mr. Freed was required to remove the land fill and replace the construction barrier to its original position. Again, it is not our intent or interest to hamper Mr. Freeds progress completing his construction. Our interests lie specifically in the 2 rod wide right of way in each of our deeds. The town code demands that any permit issued in violation should be immediately rescinded by any inspector that becomes aware of the violation. At the town hearing in 2014,town attorney Martin Finnegan gave false assurances that the permit does not allow building of any kind on the ROW property to the owners of the adjacent to the ROW lot,that in spite, of the fact that the permit was issued based on the fraudulent survey that annexed the ROW property. The unethical and deceitful position taken by the town attorney is not only a disreputable but the attorney's act involves the town of Southold in the fraud.It is a-crime to produce documents that illegally deprive people of their property rights. Since'I informed the town in advance about ongoing corruption and this fraud and in view of the direct involvement of the town attorney in the fraud the town is knowingly, willingly and continuously participating in this fraud even though the town was put on advanced notice. I have commenced a lawsuit against the town of Southold in the Supreme Court of Suffolk County alleging town corruption and fraud.The case is now in front of the Appellate Division of the State of New York, Second Department. When I first attempted to discuss with the town attorneys office the issues involving illegal permits granted to 12400 New Suffolk Avenue property the office advised me to "get a lawyer" because they do not discuss the issues with laymen. When I brought to the attention of Town Supervisor the issuing of illegal permits granted to 12400 New Suffolk Avenue property and an evident and harmful bias of the town attorney's office towards private interests, he advised me that if I suspect a fraud that I should "get a lawyer" and present my case to District Attorney. When I asked the Building Department to explain documentation regarding the illegal permits granted to the 12400 New Suffolk Avenue property, granted in spite of my earlier written warnings about the allegedly and ongoing fraud involving the property currently under litigation in the Supreme Court,the answer was still the same: "get a lawyer". This consistently offered advice, seemingly an unwritten local procedure,translates into "if you are not prepared to spend $400/per hour on a lawyers you have no rights". Something is very wrong with the apparent assumption that the township governance is immune to consequences of their irresponsible actions that cause economic harm to some constituents in favor of the others. One should not have to go to court to get an honest building permit or to have to bring a lawyer in order to talk to the local government official. This is seriously WRONG. The elected officials are directly responsible for fair and unbiased treatment of their constituents in the activities of the township. The elected officials are responsible not only for their own actions but also for the actions of the arbiters under their supervision, including the town attorney's office. If the entities under town supervision take actions that harm citizens, forcing them to spend hundreds of thousands of dollars on legal fees in order to correct incompetent, biased or corrupt decisions of the township - like issuance of an obviously illegal permit which would have not been issued if the responsible parties actually read the documents -the elected officials should be fully liable for the cost of the legal action to correct the error. The elected officials of this county are directly responsible for the sound management of this township, law and order and for upholding the values of this democratic society. The community as a whole depends on it for survival. On September 26, 2014, according to the Freedom of Information Act, I requested to review information based on which the Permit#39201 was granted by the Southold Building Department. The following are the reasons why the permit should be immediately revoked. 1) Permit#39201 was issued to non-existent property. See Exhibit A. Sufficient reason by itself to revoke Permit#39201. 2) The submitted survey does not match the description of the property in the deeds the Permit#39201 rests on. See Exhibit A Sufficient reason by itself to revoke Permit#39201. 3) The required subservient permits needed for the Building Permit were not based on the same survey and the same property description the Permit#39201 was granted on. A number of significantly different surveys with inconsistent ever- changing property descriptions were used to obtain the various required permits (such as Health Department permit). Technically, those surveys were referring to different properties. Some surveys are showing two lots instead of one and some are referring to Tax Map descriptions that are illegitimate or do not exist any more. The permit also conflicts the applicant's sworn affidavit based on which the Permit#39201 was issued. There is no consistency whatsoever in this mess. Sufficient reason by itself to revoke Permit#39201. 4) The Spano Abstract title search unequivocally certifies that applicant does not own the property for which the Building Permit#39201 was issued. No other title searches exist to conflict Spano Abstract findings. In fact the applicant own title searches, not offered into evidence, confirm Spano Abstract title search finding. See Exhibit B. Sufficient reason by itself to revoke Permit#39201. 5) Permit#39201 is referring to the same address but not to the same property for which a Building Department permit was issued in 1985. There is no reason or logical explanation why the same property, which had been 115' x 300' in size, or about 1 Acre, suddenly, in 2013, expands markedly in size to 145'-x 449', 50% bigger in fact, than the same property in 1985. Also,there is no plausible explanation to justify 2013 sudden disappearance of the adjacent 100 year old Right of Way property which through the history of 100 years was never part of the 12400 New Suffolk Avenue property. See Exhibits D & E - Russell Case's, last occupant of the property, relevant deeds indicating the size of the property and 1985 building. Sufficient reason by itself to revoke Permit#39201. 6) The supporting documentation in the Building Department files is incomplete, self contradicting but sufficient enough to warrant an immediate revoking of the issued Permit#39201: a) The Lot for which permit was requested does not match the Lot for which the permit was granted. Building permit was requested for the Lot referred to, by Tax Map No. 1000-116-6, Lot 12.3 (no info in the files) but the Building permit was issued to the lot referred to, by Tax Map No. 1000-116-6, Lot 12.1, (no such lot exists) Lot 12.1 according to the sworn affidavit and the survey based on which the Permit#39201 is issued is not a lot at all; 12.1 is only tax designation. See Exhibit C. Sufficient reason by itself to revoke Permit#39201. Note:Building permits are issued for the entire property or the lots, not for Tax Map designations which are used only as mere descriptions of the properties. Tax Map designation is just an incidental tool to help describe the property for collection of taxes and nothing else. b) The survey based on which Permit#39201 was granted in fact doesn't support existence of any plausible or feasible property, as that survey is defined. The deeds the survey rests on do not support existence of the property for which the Permit#39201 was granted. See Exhibit A, Page 5 Sufficient reason by itself to revoke Permit#39201. There is only one lot associated with 12400 New Suffolk Avenue property according to the permit, the Building department statement, Tax Maps. before year.2013 and since September 2014 according to the attached applicant's sworn affidavit (after applicants' change of mind on the split). See Exhibit F -Applicant's sworn affidavit For more than 50 years since the subdivisions of the Wickham Case Estate Lot 12.0, before it disappeared,was shown to be 115' x 330' in size,that according to all the publicly available documents. .The final survey claims that the lot for which Permit'939201 was granted is 149' x 449' in size. The lot is described by two Tax Map designations 12.1 + 12.2 which are according to applicant's sworn affidavit not lots or • r' parcels and in fact do not exist any more because they were replaced by something designated as lot 12.3; there is no documentation on file. Lot 12.3 used in the request for the Building permit. c) Permit#39201 approves building on the ROW property,which is not and was never part of the 12400 New Suffolk Avenue property. The ROW property on the building plans corresponds to 2013 Tax M'ap 1000- 116-6-12.2 designation, which apparently doesn't exist any more. See Exhibit G - Approved Building on the ROW property. Sufficient reason by itself to revoke Permit#39201. d) Permit#39201 was issued based on false assertions in the applicant's sworn affidavit. That which is stated in the affidavit is in conflict with almost all the other evidence. The use of the sworn affidavit was evidently suggested and approved by the Southold Township Attorneys Office in order to counter the disagreeable evidence opposing the issuing of this bogus building permit. The applicant's sworn affidavit constitutes a clear deception. See Exhibit F - The sworn affidavit. Sufficient reason by itself to revoke Permit#39201. e) The supporting documentation and the approval process employed in the issuing of the Permit#39201 were below any rationally acceptable standard. The supporting documentation and granting of Permit#39201 represent an across the board systemic failure of the process. This failure cannot be explained by the incompetence of the individuals involved in the issuing of the permit. The failure suggests a planned and deliberate attempt to derail the permit issuing process for an economic gain of certain individuals"at the expense of the community. Sufficient reason by itself to revoke Permit#39201. In conclusion: The Permit 439201 was issued in violation of town procedures. The granted permit almost entirely rests on the false sworn affidavit of the applicant and an implied promise of the town Attorneys Office that it will not challenge the outrageous circumstance of the issuance of this permit. The applicant's attorney letter surprisingly conflicts the sworn affidavit of the applicant it tries to promote. See Exhibit H - Letter of the applicant's attorney to the Building,Department supposedly copying the town attorneys to give it weight. The Southold township departments are apparently using the township attorney's office advice as an excuse for violating their procedure. It should be noted however that each department and the individuals involved in the process are responsible for their actions independently and responsible for getting a proper legal advice notwithstanding the fact that, in my experience, the failure of the permit issuing system can be to a great extent attributed to the negative role, arguably even subverting role, the attorney's office plays in the governing of this township. The issuing of Permit#39201 strongly suggests an outside undue influence on the decision process in the Building Department as well as undue influence on the other Southold township local government departments. The influence peddling or possibly an outright corruption is also evident in the actions of the Tax Map Division of the Suffolk County, which seems to consistently support illicit activities in favor of private interests. The Building Department as well as the Southold Town Attorneys office were informed about the alleged attempt to defraud 22 Cutchogue citizens of their property rights, the case now under litigation in the Supreme Court. The issuance of the Permit#39201 to "the property under litigation" therefore can be interpreted as a biased, informed and deliberate effort in support of the alleged attempt to defraud. The excuse used by the Trustees Department and the Southold Township Attorney's office for refusing to take a requested action against the previously issued, obviously illegal permits to the same property, was that "the property is under litigation". The granted work permits relied on the same Quit Claim deed which, it was agreed on, can not be used as a proof of ownership. The fact that "the property is under litigation" however didn't matter when the same applicant requested another illegal permit for the same fictional property. The issued permit still depends on the same Quit Claim deed, as agreed previously,that it is not acceptable as a proof of ownership. Furthermore, the town Attorneys office is evidently giving a legal advice to a private citizen, at taxpayer expense, on how to subvert the town's procedures. See Exhibit H. The issuing of this outrageous Permit#39201 is an insult to al the law-abiding, tax-paying citizens of Southold township who must abide by the rules of the real building application process. Attached is a certification by Spano Abstract Service Corp. which clearly states"no title vested in Todd E. Freed and/or Edith Webster Freed" on page 2. The Freeds apparently have asserted ownership of the SCTM .2 parcel to the East based on a quit claim deed that they executed,I believe,with the previous owner of the Freed property who had no apparent fee interest, either. The quit claim deed itself appears to describe land 33 feet to the WEST of the Freed property which is currently owned by the Plimpton,not the parcel to the EAST of the property. Third, and most important,I believe the Town of Southold has jurisdiction over subdivisions, and I am not aware of any approvals issued by the Town nor,indeed, any submission by the Freeds of a proposed subdivision. I am therefore requesting that any pending or future submission by the Freeds be denied until such time as the ownership and tax map designation be resolved,not only because apparently they do not own the 33 foot parcel to the East but also because only the Town of Southold can make a subdivision determination. Further,I am asking you to review the Freeds' subnmission to the Health Department which contains a survey and is stamped,"received"by the Board of Trustees on February 18,2014, showing a survey with ownership of both parcels(copy attached). I am also requesting that action be taken to notify the County that the tax map is apparently in error and that the ownership issue is currently in litigation in the Suffolk County Supreme Court. In my experience the police department, rather than to protect the community, has used intimidation and threats as a vehicle to advance private interests. The following will elucidate why we, speaking for my family and myself, no longer trust Southold police department. An officer from the Southold police department came on Memorial Day to my house soon after the incident I reported via e-mail to the police.The officer was apparently sent by private citizen Todd Freed evidently to threaten us. If the officer was honest and did his job, as I expected, instead of coming to bully us he would have found out that: 1) 1 was at the scene alone when Todd Freed arrived by car minutes after me to confront me, I assume after seeing me remotely on his security cameras 2)Todd was the one who got out of the car to threaten me. I just left the scene and walked away after he became aggressive. 3) Todd should have called the police if he believed I was doing something wrong and not get out of the car to enforce the law himself while trying to provoke physical confrontation by destroying my personal belongings in front of me 4) 1 managed to avoid physical confrontation only because I swiftly left the scene as Todd was destroying my property, shouting threats and getting violent 5)Todd falsely reported the event to the police with evident intention to entrap or frame me with false accusations which is to the best of my knowledge Federal and State crime 6) My accounts of the incident can be easily confirmed by the Todd's security cameras, which recorded the incident. However, I doubt that Todd would make them available because they are evidence of his lying I didn't see the police report, I just heard about the Freed's accusations from the police officer in my house. I learned from the officer about my supposed attack with a stick on Todd Freed and his 4-year-old child and my shouting of obscenities.There was nobody at the scene other than Todd and me. Who would in the right mind be bringing a child to the scene of an expected confrontation?This man Freed holds nothing sacred, involving even his children in his scams and lies. At the very beginning of this affair in which the Freeds are unlawfully attempting to evict the lawful residents of the land they covet, I have tried first to report in person to the police and afterwards I also reported in 1 writing more than a dozen serious incidents of the Freeds breaking the law including an assault, a personal attack on me on the beach. Not even once have the police department investigated our complaints or done anything other than issuing false or inaccurate police reports. In comparison to that, the one time ever that I am aware of, when the Freeds made a complaint to the police, the police reacted by instant action in the Freeds behalf. The Southold police based on a false accusation responded by intimidation and unlawful threats of arrest against us over a civil matter that the police shouldn't have been even addressing. The policeman that supposedly came to investigate the morning incident held his hand on the gun in my living room ordering me to stay off the Freeds Right of Way, an entirely unlawful demand by the policemen since I have deeded rights to use the Right of Way and the Freeds have no rights to be there whatsoever. The above biased treatment speaks for itself and doesn't need further explanation. The unlawful police action in conjunction with an attempt to frame with a false accusation warrants all the security concerns of the neighborhood. The existing conditions in the neighborhood are unsustainable and a clear violation of the law and order on multitude of levels: 1) I, myself, and few of the 18 owners in common with deeded rights to Right of Way are maintaining Right of Way now for more than, 14 years and other over 50 years. We are the incumbents on the property 2) Maintaining and using the Right of Way all this time gives us rights over this property even without our deeds,the rights based solely on the length of time of residence and usage of the property. 3) We the residents and users of the Right of Way should be protected against the Freeds unlawful land grab, attempts at eviction and attempts of the Freeds to squat on the land 4)The police instead of protecting incumbents is diligently and unlawfully assisting the Freeds while the Freeds are pursuing unlawful land grab using criminal means 5) Southold police are assisting Freeds with unlawful eviction of the neighbors 6) Southold police are blocking any challenge to the Freeds committing crimes 7) The police interference on the Freeds behalf is entirely illegal, creating a reasonable assumption of the Southold police corruption. 8) Nobody is allowed to threaten with harm and forcefully evict from a property without a legal court order, not even police 9) Nobody is allowed to take the law enforcement into their hands to implement his views on the situation as the private citizens Freeds are doing with support of the Southold police. 10)The police should bring charges against the Freeds to the District Attorney for prosecution on multitude of account of breaking the law and criminal activities with goal to steal half a million dollars 11) Other than forged documents, for which the Freeds should be brought to justice, the Freeds produced not a single valid document that would give them any right whatsoever regarding the Right of Way, nor any such documents exist in the public records 12)Title searches of licensed Agencies confirmed without any doubt that the Freeds have no interest whatsoever in the property they are trying to steal with support of evidently corrupted government agencies 2 13) The Freeds are trespassing on daily bases over the Right of Way, obtaining illegal work permits using forged documents, threatening neighbors, confiscating private property and engaging in activities that are clearly criminal in nature 14)The Freeds allegedly corrupted the local government and possibly even the Supreme Court of Suffolk County (to be determined) The police should be reporting the Freeds crimes to the District Attorney's office for investigation instead of facilitating and shielding the Freeds theft of property. This is the second time around that the Freeds are getting away with the crime of false reporting to the police, as the Freeds are protecting their theft of half a million dollars worth of real-estate property. Without having any control over what I am reporting anybody can put words into my mouth and entirely fabricate the situation. I decided that from then on I would stay away from the police station and e-mail my reports to the police in writing only, which I did for dozen or so of incidents, mostly referring to harassments and thefts of my personal belongings by the Freeds.The Freeds stole few of my boats, beach equipment, stalked my house, trespassed and are still trespassing on regular bases around my house at odd hours, day and night. Policeman did not come to investigate. The policemen knocked on my door, asked me nothing, in fact forbid me to talk about the incident and accused me of attacking Freed and his 4-year-old son with a stick.The policemen then threatened me with an eminent arrest if I don't stay off the Freeds' Right of Way, the accusation of attempted assault against man and his child and the threat of arrest over civil matter regarding the Right of Way having nothing to do with each other. In other words, the accusation police officer made was about attempted assault on a man and his child while the threat of arrest was about a civil matter. I presume that Todd Freed who send the policemen gave him instructions and scripted the entire policemen's action, the fact that is by itself extremely troublesome. To the best of my understanding this police action and the behavior of the police officer in my home were entirely unlawful. The officer, paid by taxpayers, acted as a common thug enforcing the interest of a private citizen who happens to be another thug attempting to illegally evict his neighbors from the property he covets but doesn't own, Right of Way worth approximately half a million dollars. We are still recovering from the trauma of the police unlawful intrusion into our lives, especially my wife who took it extremely badly since she never experienced anything of a sort in her life. The whole neighborhood is in shock. 3 The last incident including another case of false reporting to the police was this time around supported by follow-up of full assistance of the Southold police in support of the theft of property, a serious escalation of the events. I will send you shortly a description of the second part of the incident. I have sent quite detailed description of my earlier experiences with the Southold Police to the Town Attorney's Office and the Town Board before. I did not receive response from anybody. After that I tried to stay away from the police and use other avenues to pursue my grievances. I was successful at avoiding dealing with the police until the last Monday, when I was bullied by highly incompetent policemen in my own living room because I made a mistake of inviting him into my house. This is my official report of the incident to the police for my records. In my earlier experience the reports I submitted to the'police at the station verbally about the Freeds were not reported or the reports did not state what I reported. This is the only option I have available for the time being to communicate with the police and have a record of what I reported.There is noting more that I need to say. The hand written mark on the Quit Claim deed, at the top right corner of the page, the deed referring to lot 12.2 indicates R/O/W. The deed doesn't make any sense, description referring to apparently some other location or no location at all. Furthermore, the Liber 12718 P267 QC deed was issued by the person that never owned any such property. This Quit Claim deed is a_s relevant to the ownership of lot 12.2 as a Quit Claim deed to Brooklyn Bridge would have been if it were put forth as the evidence of the ownership. (Exhibits Page 7&8—The Quit Claim deed FRAUD, an irrelevant deed referring to some non-existent and indefinable property, description referring to the neighboring Fitzgerald's land.) The current Tax Map is based on a forged survey, forged deeds and forged documents used in a criminal conspiracy to steal half a million dollars worth of real-estate property.
