This protection covers all forms of 'taking', including harassing the birds. In other areas of the State we have seen slight increases in distribution ( http://www.dec.ny.gov/cfmx/extapps/bba/bbaMaps.cfm?bndcode=CLSW&order=2&year =2000&comp=1). They were absent as breeders from Long Island during the first Breeding Bird Atlas surveys conducted between 1980 and 1985, but were reported as 'Probable' nesting from one area on the North Fork during the second Breeding Bird Atlas (2000-2005). It is illegal to intentionally damage or destroy the nest, eggs, or young of a swallow while it is being built or in use. The Act allows fines or prison sentences for every bird, egg or nest destroyed. D E C E[ V I JUN 2 7 2011 Southhold Town Board of Trustees June 15,2011 Diana.Van Buren PO Box 973 Mattituck NY 11952 Dear Ms.Van Buren, While visiting a friend in Peconic,I was shown a number of Cliff Swallow nests in the bluffs along the Long Island Sound. The birds are quite lovely and were flying like they were dancing in the air. What concerns me is that there is construction going on at the two properties where the nests are. Are Cliff Swallows a protected species? My friend tells me that the properties at 4730 and 4690 Blue Horizon Bluffs were heavily. re-graded and defoliated in an attempt to build new dwellings without permission. My friends have beencoming to this pristine location for more than 18 years only to find the destruction on these properties last year. They think that the heavy machinery used and vibrations caused the bluff to destabilize thus adding to the erosion. The only good thing to come of it all is the Swallow nests. The birds are amazing to watch. Can anything be done to protect these little birds and their nests? Can the building of retaining walls and additional structures be halted to prevent the destruction of the birds'homes? Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the Board considers the following: 1. It is recommended that the 20' non-turf buffer be extended landward to the Coastal Erosion Hazard Line. 2. Due to the high erosive nature of the bluff slope, it is recommended that the Board preserve existing vegetation to the greatest extent practicable.
