This protection covers all forms of 'taking', including harassing the birds. It also protects their nests, eggs and feathers as well, unless permitted by the US Fish and Wildlife Service, Division of Migratory Bird Management. Additional protection, if warranted, may be conferred by Federal or State listing as endangered or threatened. Below are a couple of web sites that provide background information on the Migratory Bird Treaty Act: http://www.fws.gov/migratorybirds/RegulationsPolicies/treatlaw.html http://www.npwrc.usgs.gov/about/fags/birds/feathers.htm Overall, in New York, cliff swallows populations have shown a decline in distribution of 12% over the past twenty years (Medler, M. D. 2008. Cliff Swallow. Petrochelidon pyrrhonota . Pages 400-401 in McGowan, K. J. and K. Corwin, eds. The Second Atlas of Breeding Birds in New York State . Cornell Univ. Press, Ithaca, NY). The decline is most i notable in the AdirondacksOd the St. Lawrence Plains and0ansition ecological regions of New York. In other areas of the State we have seen slight increases in distribution ( http•//www dec ny gov/cfmx/extapps/bba/bbaMaps cfm?bndcode=CLSW&order=2&year =2000&comp=l). They were absent as breeders from Long Island during the first Breeding Bird Atlas surveys conducted between 1980 and 1985, but were reported as 'Probable' nesting from one area on the North Fork during the second Breeding Bird Atlas (2000-2005). They are not currently listed as endangered, threatened or special concern in New York. I hope this information is sufficient for your needs. The birds are quite lovely and were flying like they were dancing in the air. What concerns me is that there is construction going on at the two properties where the nests are. Are Cliff Swallows a protected species? My friend tells me that the properties at 4730 and 4690 Blue Horizon Bluffs were heavily re-graded and defoliated in an attempt to build new dwellings without permission. My friends have beencoming to this pristine location for more than 18 years only to find the destruction on these properties last year. They think that the heavy machinery used and vibrations caused the bluff to destabilize thus adding to the erosion. The only good thing to come of it all is the Swallow nests. The birds are amazing to watch. Can anything be done to protect these little birds and their nests? Can the building of retaining walls and additional structures be halted to prevent the destruction of the birds'homes? It's amazing to know that people have so little regard for nature.
