That the said Board of Trustees and the Town of Southold are released from any and all damages,or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense,defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents,and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. H. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title,or interest in real or personal property held or vested in a person not a party to the permit. King,Trustee Southold,New York 11971-0959 Dave Bergen,Trustee G Q ,'mac► • �� Telephone(631) 765-1892 Charles J.Sanders,Trustee OlyCOU( Fax(631) 765-6641 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD April 23, 2014 Mr. Nicholas Johnson 26 Montauk Highway PO Box 10 Amagansett, NY 11930 RE: LORRI SHACKELFORD 4370 MOORES LANE, CUTCHOGUE SCTM# 116-1-9.1 Dear Mr. Johnson: The Board of Town Trusteestook the following action during its regular meeting held on Wednesday, April 23, 2014 regarding the above matter: WHEREAS, Nicholas Johnson on behalf of LORRI SHACKELFORD applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 24, 2014, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that.the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: implementation of re-vegetation plan; establish.and subsequently a 25' wide non-turf.buffer no further than 25' off of seaward side of dwelling; establish and subsequently maintain a non-disturbance buffer area seaward of the non-turf buffer area and no further than 50' off of seaward side of dwelling to edge of wetlands; and 2 0 0 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 23, 2014, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of LORRI SHACKELFORD to remove all sod (t8,000sq.ft.) previously installed in the non-turf buffer area and install 66 cubic yards of organic, non-treated mulch in a 2" layer in the non-turf buffer area; establish and subsequently maintain a 25' wide non-turf buffer area no further than 25' off of seaward side of dwelling; establish and subsequently maintain a non-disturbance buffer area seaward of the non-turf buffer area and no further than 50' off of seaward side of dwelling to edge of wetlands; install approximately 657 linear feet of 4' high black iron fencing separating the non-turf buffer area and the Non- Disturbance buffer area; and install six (6) 8'-10' tall Juniperus virginiana 10' on center along the northeast side of property; and as depicted on the project plan prepared by C. SCTM# 116-1-9.1 It is my recommendation that the proposed actions is INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. Two permits were issued in the past(4106 in 1992 and 5007 in 1999) for the construction of a single family residence. Both permits required a 50' buffer to mitigate the construction on a single-family residence due to the severe environmental constraints of the parcel and potential environmental impacts to Downs Creek. The later permit issued in 1999 required a 50' wide "non-disturbance" buffer. The action does not proposed to re-vegetate the area to pre-disturbance conditions by planting native vegetation to attempt to restore the area to a natural state. Therefore, the proposed action does not meet permit conditions. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Box 1179 Southold, NY 11971 RE: Pre-Submission Letter Dear Board of Trustees, I am writing this pre-submission letter after speaking with both Ms. Amanda Nunemaker and Ms. Lori Hulse regarding a situation at our home that we recently purchased at 4370 Moores Lane in Cutchogue, NY on September 19, 2013. My partner and I bought our home on 6.5 acres of beautiful wetlands by Down's Creek. After reviewing the survey with our contractor, we all believed we could make improvements, do work on the land up to the landward edge of the marked line dividing the "usable" areas with the brush leading up to the wetlands. It wasn't until after we began the work that a landscaper informed us that the wooden fence that was put up may have required a permit. We immediately removed the fence and began our research. Constable Joe O'Leary came out on Friday the 18th to give us a summons for putting down sod and grass. It was at that point we contacted your office. Firstly, we want to offer our sincere apology for our ignorance in not knowing what we apparently should have known (but were not informed by the previous owner, the brokers, nor either attorney who all knew what our intentions were). We were unfamiliar with the terms setback and non-disturbance until my conversation with Amanda earlier this week (who, by the way, was tremendously helpful and kind). We knew nothing about requesting permission for any type of work done within 100 feet from the wetland and were mortified to learn from Amanda that we were in fact in a 50 foot non disturbance zone. After speaking at length with Lori Hulse (also extremely helpful and generally fantastic) she advised me to write this pre-submission letter to inform you of what we have already done, what our intentions were, what we would like to do and have you come out to review the property. 0 Our original intention was to immediately put up a fence as we have a 2 year old son and wanted to ensure his safety from the street and the wetlands. The fence company began putting up a wood fence along the sides of the house. The path they cleared was larger than we anticipated but they argued that there was quite a bit of dead brush that most likely occurred due to Sandy. No trees were touched. Regardless, it appears that it is partially in the non-disturbance zone and some within the 100 ft perimeter. We also began to put grass in the back of the house. Once Constable O'Leary came by to inform us that we could not put down sod and grass either, we stopped immediately and it is unfinished and sitting on the driveway. We would very much like for you to come out to the property to take a look at what has been done thus far and to advise us if we can in fact put up a fence and if so, where.
