WILLIAM D. MOORE AND PATRICIA C. MOORE, husband and wife,
residing at 51020 Main Road, Southold, New York 11971, party of the second part,
WITNESSETH,that the party of the first part, in consideration of Four Hundred Thirty-Five Thousand and
00/100--($435,000.00)--dollars, and to effect the distribution of the decedent's estate, and other good and
valuable consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part,the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land,with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of New York, bounded and described
as follows:
BEGINNING at a monument on the southwesterly side of a 25 foot wide Right-of-Way where the
northwesterly line of the hereinafter described premises and the southeasterly line of land now or formerly
of Nicholas J. Cutrone intersects said southwesterly side of said Right-of-Way;
RUNNING THENCE South 55 degrees 15 minutes East along said 25 foot wide Right-of-Way, 50.00 feet
to a monument and land now or formerly of Albert W. Schilke;
THENCE South 34 degrees 45 minutes West along last mentioned land and passing through a monument
155.62 feet to the high water line of Arshamomaque Bay;
THENCE westerly along the high water line of Arshamomaque Bay on a tie line course and distance of
North 52 degrees 06 minutes 50 seconds West 50.07 feet to land now or formerly of Nicholas J. Cutrone;
THENCE North 34 degrees 45 minutes East along last mentioned land and passing through a monument,
152.88 feet to the monument at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises as conveyed to Thomas F. Higgins and Caroline B.
Higgins, by deed recorded in Liber 7201 page 598.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part,the heirs or successors and assigns of the party of the second part forever.
AND the parry of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any other purpose.The word"party"
shall be construed as if it read"parties"when ever the sense of this indenture so requires.
