V U -- U u V • TERMS AND CONDITIONS The Permittee Estate of Fred Adler, residing at 415 Lakeside Drive, Southold,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. MAY 202014 Richard and Anne Pinicara 150 Lakeside Drive North,Southold, NY 1117 -`' • Tr': Board of Trustees Re:Adler SCTM#1000-90.3-13 We are longtime residents of the Cedar Beach community.We are writing to the Trustees to object to the variance to allow the construction of a 1600-square-foot residential dwelling with a 15'x20'attached deck,only 50'from the water and to present additional information regarding the application_ The lot in question is adjacent to property owned by the Adler Estate,whose Theirs live in Canada and inherited both properties when the parents died.The adjacent property with a house and dock was sold by the estate over two years ago;the lot in question did not sell and he has been on the market since they inherited it. We assume that the lot will be more marketable if the variance is in place, but we neighbors will bear the consequences of this speculative development if the variance is approved. The other fact which we wish to bring to your attention regards the"Mapped but Unbuilt Street" adjacent to the applicant's lot. We wish to know what if any building constraints—side yards,setbacks-- are placed on the development due to this adjacency and if so,will the Trustees consider these constraints or if the Trustees will flag these issues to the relevant review agencies during the building permit process.Again,the variance for new construction should be considered comprehensively,by all review agencies,since the development is inappropriate on so many levels. Our objections to the variance are based on the following factors and the environmental and social costs to the Cedar Beach community: We cherish the beauty and serenity of the creek and the wildlife it attracts as they pass between the Cedar Beach wildlife refuge(for piping plovers)and Sweetwater Lake –egrets,ducks and swans feed there and kingfishers and cormorants nest in the trees along the creek and turtles rest along its banks. The proposed structure will be built 50-feet from the banks of the creek at its NARROWEST part, disrupting long-established wildlife movement patterns and disturbing the land during construction.And if the structure is built as proposed,chemical seepage from the septic system and runoff from the deck and rooftop will damage the creek forever after. We also oppose the variance on the grounds that the proposed development, 50-feet from the water's edge,is at odds with public policy governing new construction on the waterfront.
