LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property consists of 46,175 sq. ft. and is located in the AC Zone District. It is improved with a one story building. It has 257.92 feet of frontage on Cases Lane Extension, 179.75 feet along the northern property line, 257.92 feet along the eastern property line and 179.75 feet on the southern property line as shown on the survey dated March 4, 2014 prepared by Barrett, Bonacci &VanWeele, PC. BASIS OF APPLICATION: Applicant request a Special Exception under Article III Section 280- 13B(7). The Applicant is the owner requesting authorization to continue the use of an existing golf club house in conjunction with the adjoining golf course. RELIEF REQUESTED: The applicant proposes to continue the use of the existing utility building and office/club room as accessory to the existing golf course. The applicant also proposes to enclose the attached existing 375 square foot concrete patio in order to create a room in which to set up an indoor golf training simulator. As shown on the architectural drawings prepared by BBV, Site Plan dated 3/4/2014 stamped by Martin Read, L.S., sheets A-1 and A-2 dated 3/11/2014. ADDITIONAL INFORMATION: A Planning Board Memorandum to the Zoning Board, dated April 22, 2014, stated that "The continuation and modest expansion of this business is consistent with the Town's Comprehensive Plan to ensure that existing businesses are supported by town policies." The subject building has a 1965 CO for a "utility building and office, club room etc. for golf course." Upon inspection of the subject building the Board discovered the existence of an Page 2 of 3—June 5,2014 ZBA#6745—Cedars Golf Club SCTM#1000-109-5-16.2 apartment inside the building, currently being occupied by an employee of the golf course. The floor plan of this part of the building was not submitted by the applicant. At the public hearing the applicant agreed to remove the apartment entirely from the building (kitchen, full bathroom and sleeping/living room space) and said he would ask the occupant to vacate the premises immediately. Also at the hearing,the adjacent property owner to the north asked the applicant if he could prevent patrons of the golf course from driving on/accessing her property. The applicant agreed to install a low fence or evergreen screening to create a barrier to prevent this from occurring. The proposed Golf Club use of this existing building, with the proposed addition, will be a continuation of the existing Golf Club use that was originally established in 1965. There was no evidence presented that the existing Golf Club use had prevented or may prevent the orderly or reasonable use of adjacent properties and/or properties in adjacent use districts. Therefore, the Board has concluded that,with the conditions imposed herein,the continued Golf Club use will not adversely affect adjacent properties and/or properties in adjacent use districts. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 1, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. The subject building and golf course is split zoned in R40 and AC districts and the Town of Southold owns the development rights for all but the one acre reserved for the existing club house building. The applicant agreed to install a low fence or evergreen screening as an obstacle to prevent patrons of the golf course from driving on the adjacent residential property, as requested by that property owner. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed use and its location. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. Page 3 of 3—June 5,2014 ZBA#6745—Cedars Golf Club SCTM#1000-109-5-16.2 G. That the proposal shall comply with the requirements of Chapter 236, Storm Water Management. BOARD RESOLUTION: In considering all of the above factors, motion was offered by Member Schneider, seconded by Member Weisman, Chairperson, and duly carried to GRANT, a Special Exception, as applied for, and shown on the Survey prepared by Martin A. Read, L.S., dated 3/4/2014 and the architectural drawings by BBV, Sheets A-1 and A-2, dated 3/11/2014. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The proposed addition to the clubhouse building cited herein requires a building permit. Therefore, as a condition of approval,the applicant must contact the Building Department to obtain a building permit and to ensure that all construction will be NYS Code compliant. 2. The existing apartment shall be completely removed from the clubhouse building (kitchen, full bathroom, and sleeping/living space), and no habitable space shall be permitted in association with the Special Exception Permit use granted herein. 3. Only one half bathroom shall be permitted in the clubhouse building. 4. The applicant shall install a low fence or evergreen screening to prevent golf course patrons from driving on or accessing the adjacent residential property to the north. 5. The applicant shall submit a complete final floor plan of the entire clubhouse building showing the total removal of the existing apartment and all interior spaces including the proposed addition. 6. The Board of Appeals shall conduct an interior inspection of the subject building prior to the issuance of a CO by the Building Department to insure the complete removal of the apartment from the clubhouse building. 7. Failure to remove the apartment completely from the clubhouse and failure to secure a new CO for the addition nullifies this Special Exception Permit. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. NOTE: This Special Exception permit cannot be transferred to new owners Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. We have determined that this condition is now fulfilled. I will inform the Building Department accordingly. However, please be advised that your 1965 CO was issued for a "utility building and office, club room etc. for golf course" and that your current Special Exception permit was granted by the Board of Appeals to continue the use of this building only in association with the golf course. It has come to our attention that 3 ads have been placed in the Suffolk Times informing the general public that your newly renovated private lounge (in the former apartment space) can "accommodate up to 50 people" and is available for booking "private events including children's and holiday parties featuring video gaming, movies and sporting events on the big screen," presumably your new golf simulator. These activities are not associated with the golf course use and are therefore not permitted. In addition, we noticed a large sign affixed to the exterior.of the golf club building near the front entrance advertising kayak and paddle board rentals and instruction. These activates are also not permitted on the subject property, and, pursuant to Chapter 280- 84 of the Town Code, "Information displayed on signs shall be limited to the name, address, logo and nature of the business and products available or activity for which the building or premises is used. " Please be aware that, as cited in ZBA #6745, "any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Board of Appeals to review potential action to revoke the Special Exception permit as granted herein." The golf club is a pre existing use and is still currently run as a golf club and clubhouse. We would like to add an addition to the club that is 15'x25'which would take the place of a current patio. This addition is to enhance or services at the public golf course. We would like to put in an indoor golf simulator that would allow us to do the following operations -golf lessons when it is raining -rent out the simulator to people that want to play when it is raining or in the winter This addition would be consistent of what a golf club does and the operations that it performs. The addition would look like the current building and is small enough that there would no change the character of the property, neighborhood and surrounding areas. The simulator can only accommodate a small amount of people so it would not is any way change traffic flow in the area. If a site plan is required for this expansion, we strongly recommend that a Site Plan Application be run concurrent with the ZBA's application so that the Planning Board is in a better position to conduct a detailed review. Another benefit to running the applications concurrent is that the application is reviewed by the Building Department to identify any other issues, thereby avoiding the applicant having to apply twice to the ZBA if a variance is identified later in the process. This 13.6 acre golf club/golf course is split-zoned R-40 and A-C, and the Town holds the development rights on all but one acre around the clubhouse. The continuation and modest expansion of this business is consistent with the Town's Comprehensive Plan to ensure that existing businesses are supported by Town policies. On the other hand, the quality of life for nearby residents is also a priority in the Town's plan, and any potential impacts to the neighbors that might result from this expansion must be examined. Potential impacts include noise from parties and other activities to be held in the expanded clubhouse, as well as traffic and parking. Thank you for this opportunity to provide comments.
