The proposed use on this conforming 1.12 acre lot located in the B (Business) zone is not
permitted pursuant to Article XI, Section 280-49, which states;
"Except as otherwise provided herein, no buildings or premises shall be used and
no building or part thereof shall be erected or altered in B District zone unless the
same conforms to the Bulk Schedule and Parking and loading Schedules
incorporated into this chapter by reference, with the same force and effect as if
such regulations were set forth herein in full."
Pursuant to the Bulk Schedule, one use per 30,000 square feet is allowed in the B District
zone. The proposed uses on the property would require the property to be 60,000 square
feet.
Additionally, the existing front structure with a proposed conforming use, is not allowed
pursuant to Article XI, Section 280-50 which states; structures shall be set back at least
100 feet from the right of way.
The existing structure has a front yard setback of 53.44 feet.
Furthermore, the proposed change of use is a permitted use on this 1.12 acre lot located in
the B zone.
Pursuant to Article XXIII, Section 208-127, the proposed uses require site plan approval
from the Southold Town Planning Board.
This disapproval was based on the proposed site plan survey by, Luigi Pascarella, P.E.,
PLLC, dated 9-10-08.

INSTRUCTIONS
a.This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans,accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises,relationship to adjoining premises or public streets or
areas,and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date.If no zoning amendments or other regulations affecting the
property have been enacted in the interim,the Building Inspector may authorize,in writing,the extension of the permit for an
addition six months.Thereafter,a new permit shall be required.
