The Planning Board received your request for comments regarding the above
application for a special exception permit to reopen a restaurant located at 64755
Main Road, Greenport in the M-II zoning District.
Section 280-55B(1) "Uses permitted by special exception", Restaurants,
excluding outdoor counter service, drive-ins or curbside service
establishments:
As you are aware, the restaurant use was reviewed in 1985 by the Planning
Board and received site plan approval where the following comments are for the
Board's consideration:
1. The property, which is subject of this applcaiton, is zoned MII and the
proposed use a restaurant is permitted by Special Exception.
2. According to building Department records the use of the site has been
a restaurant prior to 1969.
3. The subject parcel was previously reviewed for the same use as
currently proposed where the development of the site, use and parking
where reviewed and approved by the Planning Board.

4. Provided there is no change in the number of seats or intensity of use,
the Planning Board has no issue with the use.
5. Last, provided there is no change to the site other than what was
approved by the Planning Board, there is no issue. It should be noted
that any future requested change to the site plan should include a copy
of the relevant section the approved stamped site plan noting the
location of the requested change to be reviewed by the Planning
Board.

The plans which you submitted are very helpful; however, for us to commence our review and
provide meaningful feedback, we require four (4) copies of drawings that include all of the items
noted on the attached checklist. We also recommend that you consult our driveway policy manual
which is available on our website at www.nysdot.gov. On the NYSDOT A-Z bar click on "H",
then click on Highway Work Permits and then click on Policy and Standards for the Design of
Entrances to State Highways. All work and material details shall be shown referenced to
NYSDOT specification item numbers.
This application should be sensitive to the unique visual and historic setting of the Long Island
North Shore Heritage Area, which runs from the Queens/Nassau County line to Orient Point, and
from Route 25 or I495, whichever is farther south, north to Long Island Sound.
In all future correspondence, please refer to the subject case number.
Review of the subject material is being coordinated by Mr. Mark Wolfgang. He can be contacted

The applicant alleges that the approval of this exception would be in harmony
with the intent and purpose of said zoning ordinance and that the proposed use
conforms to the standards prescribed therefore in said ordinance and would not be
detrimental to property or persons in the neighborhood for the following reasons:
The building has been a restaurant since prior to 1969 (building dept. records
describe use as tavern). In 1985 the restaurant was completely renovated and
expanded with site plan approval and properly issued certificate of
occupancy. In 1994 the zoning map was amended and the property re-zoned
from B to M-II. Restaurant is a permitted use, by Special Exception. Due to
personal circumstances the restaurant use was not continued and the pre-
existing, as of right, restaurant use discontinued . A special exception permit
is required to re-open the restaurant.
The applicant is the owner of the Sea Food Barge, their lease is due to expire
and the business must relocate. The owner wishes to reopen his business at
this site without any interruption of business and loss of jobs to his employees,
therefore, immediate and expedited review of the application and a special
exception approval is requested.
The property which is the subject of this application is zoned M-II and
[ X ] is consistent with the use(s) described in the Certificate of Occupancy(copy
attached). A building permit was issued in 1969 for addition to existing tavern
(permit#4533) and permit #13918 issued 1985 for remodel and addition to
existing restaurant [ ] is not consistent with the Certificate of Occupancy being

I. All applicants for permits* including Town of Southold agencies,shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency.*Except minor exempt actions including Building
Permits and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C,the preparer of this form should review the exempt
minor action list,policies and explanations of each policy contained in the Town of Southold
Local Waterfront Revitalization Program.A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).

the achievement of the LWRP policy standards and conditions contained in the consistency review
