A duplicate of this permit must be continuously posted during the event. Please be aware that use of a tent will also require an inspection and approvals at least three days before the event, from the Building Department(765-1802). There are several conditions written into the permit. Please be aware that under the State Fire Code,the number of persons occupying the building and/or tent area is limited. By acceptance of this permit, Applicant agrees to adequately supervise and direct all parking to be on this site, and Applicant agrees to provide additional traffic controls necessary for this event. 2. One "on-premises” sign not larger than six (6) square feet in size may be displayed not longer than thirty (30) days before this event, and removed immediately after the event. Directional parking signs shall be adequately displayed. 3. Applicant indemnifies and holds harmless the Town of Southold from all claims, damages, expenses, suits and losses including but not limited to attorney's fees arising from activities under this permit. Tent proposals must receive prior written approval from the Southold Town Building Inspector before placement on the property and must meet all fire and safety codes. 5. This permit is valid only for the time, date, place and use specified above, and for the designated event. Each additional day will require a separate permit application, fee, and related documents for review, etc. at least 45 days prior to this event. Adequate temporary sanitary facilities must be provided by applicant for this event, and Applicant agrees to remove the temporary facilities from the premises within 48 hours of the day of the event. 7. No on-site food preparation is permitted, although food may be catered subject to all health regulations. 8. Events for three hundred (300) or more people require submission and approval of a traffic control plan, acceptable to the Town. 9. Violations in connection with this event will terminate this permit. 10. Issuance of this permit does not authorize in any manner occupancy of the principal building exceeding the legal limitations under the fire code, or other codes which would prohibit such increased occupancy. 11. Two fire exits shall remain open and unobstructed at all times to building(s) on the property. 12. Music, when outdoors, is required to stop at 10:30 p.m. 13. Placement of the speakers must be approved by the winery management. 14. Where possible, live bands rather than disc jockeys will be encouraged. 15. When disc jockeys are used, the decibel levels will be monitored to ensure acceptable levels. 16. Organizers of the events will be required to use an approved disc jockey recommended by the winery or have their own disc jockey sign a contract agreeing to the above. If they do not honor the contract, the winery will have the right to remove the disc jockey from the premises. 17. Off-road parking will be provided, either on the winery premises or at another site that is off of the road. Parking assistants will be provided by the winery for this event, when appropriate. 18. For events over 300 guests, a qualified traffic controller will be provided. 19. The following must be submitted by the applicant in writing and/or with sketch plan to the Office of the Zoning Board of Appeals a minimum of three business days before commencement of the first day of the event, no later than 3PM on that day: a. Hours of operation both daylight and after dusk; b. Lighting plan for both the "haunted house structure" and field/parking operations directed away from adjacent properties and C.R. 48; c. As proposed the event will be in operation for 21 days throughout the month of October from the hours of 7pm – 11 pm Thursday and Fridays and 1 pm – 11 pm on weekend. The attraction will consist of four trailers on a 5-acre parcel with a maximum capacity of 200 guests at one time and having an area for event parking. The above- mentioned has been reviewed for site development and the following comments are for the Boards consideration. Parking area & Lighting 1. The applicant has designated an area closest to the North Road for the parking of 171 vehicles for the attraction surrounded by a snow fence. There are eight parking rows proposed perpendicular to the North road with access only onto the North Road. It would appear that the applicant has demonstrated adequate on site parking and site circulation for the proposed event however, the Planning Board would recommend that the parking area maintain a 25 foot setback from the North Road so there could be some buffer between the parking area and R.O.W. In addition access to the attraction would be preferable on Youngs avenue rather than the North road. / i6/ orle- • • 2. The applicant is proposing 8 light poles in the middle of the centerline of parking stalls. Proposed lighting should be positioned or shielded so as to illuminate only the subject parcel and not shine onto adjacent properties and or the North Road. 3. The area designated for parking is a grass area therefore for drainage purposes the pervious surface is acceptable. Our recommendation is to ensure that the grass area is maintained/mowed and that garbage cans for customers be provided on site for trash. 4. As per the applicant, there will be staff directing traffic to assist in the effort to promote traffic safety, good site circulation and to ensure that there be no parking in the Town Right of Way or on adjacent sites. It would be helpful if the applicant would submit a traffic plan to demonstrate the above. 5. As part of the applicant's proposal, there will be four trailers for the attraction having a facade to appear as a haunted house. It is recommended that the applicant maintain permits from the building department, fire marshal or other agency as applicable as part of the permit. Summary: It should be noted that at this time there is not a permit process in place for a month long event as proposed by the applicant. Unlike similar tourist attractions in the Town of Southold, they are on agricultural land therefore promoting agriculture and have an approved site plan. The concern of the Planning Board would be precedent, although it appears the most significant issues are those that can be mitigated by conditions as part of the permit. As a suggestion, there should be a permit process to follow for applications of this nature to use as a guideline for future applications that include site plan review. At this time the applicant has demonstrated on the proposed plan that the developed parking area will meet the needs of the use, maintain run-off on site and that all outdoor lighting can be arranged as to minimize the projection of direct light and glare onto adjoining properties and streets. By acceptance of this permit, Applicant agrees to adequately supervise and direct all parking to be on this site, and Applicant agrees to provide additional traffic controls necessary for this event. 2. One "on-premises" sign not larger than six (6) square feet in size may be displayed not longer than thirty (30) days before this event, and removed immediately after the event. Directional parking signs shall be adequately displayed. 3. Applicant indemnifies and holds harmless the Town of Southold from all claims, damages, expenses, suits and losses including but not limited to attorney's fees arising from activities under this permit. No on-site food preparation is permitted, although food may be catered subject to all health regulations. 8. Events for three hundred (300) or more people require submission and approval of a traffic control plan, acceptable to the Town. 9. Violations in connection with this event will terminate this permit. 10. Issuance of this permit does not authorize in any manner occupancy of the principal building exceeding the legal limitations under the fire code, or other codes which would prohibit such increased occupancy. 11. Two fire exits shall remain open and unobstructed at all times to building(s) on the property. 12. Music, when outdoors, is required to stop at 10:30 p.m. 13. Placement of the speakers must be approved by the winery management. 14. Where possible, live bands rather than disc jockeys will be encouraged. 15. When disc jockeys are used, the decibel levels will be monitored to ensure acceptable levels. 16. Organizers of the events will be required to use an approved disc jockey recommended by the winery or have their own disc jockey sign a contract agreeing to the above. If they do not honor the contract, the winery will have the right to remove the disc jockey from the premises. 17. Off-road parking will be provided, either on the winery premises or at another site that is off of the road. Parking assistants will be provided by the winery for this event, when appropriate. 18.
