HomeMy WebLinkAboutTR-05/07/197365 MINUTES BOARD OF SOUTHOLD TOWN TRUSTEES Meeting of May 7~, 1973 A regular meeting of the Board of Southqld Town Trustees was~ held Monday, May 7, 1973 at the Town Clerk's.Office, Main Road, Southold~ New York. The meeting was called to order at 8:15 P.M. with the following present: Atvah B. Goldsmith, Chairman Douglas M. Robertson Philip G. Hor%on Rudolph Johnson Frederick E. Gordon Judith T. Boken, Secretary . Mr. William Brady, President of the Laughing Waters Property Owner's Association, Southold, appeared before the Board with another Association member and Mr,. Patrick Carrig, to apprise the Board of their construction of a bulkhead.. This bulkhead is 6 ft,. further back on the association property at Corey Creek from where there ~ad been 15 boat stakes, and the same number of boats will be moored at the bulkhead~ -- The Board thanked Mr. Brady for keeping the Board informed, but advised him that since this bulkhead is entirely on the Association property, and although~the Board looks favorably ~n such~a project, it is outside their jurisdiction. Mr. Carrig asked the Board,s opinion on the extension of a bulkhead on the property~of William Albinson, North Bayview Road, Southold. He had previously~constructed a bulkhead entirely on Mr. Albinson's property in 1971, and now wishes to extend it along the same line, still entirely on his-own property. The Board advised Mr. Carr~g that the proposed extension is outside the jurisdiction of the Trustees and a permit is not required. Mr. Carrig next~i'discussed the~a~plication~of~Robert~_Brown, Beachwood Lane,~ Southold, for permission to construct a dock~a~of~oat in front of his property on Goose Creek. On motion of Mr. Robertson, seconded by Mr. Gordon, it was RESOLVED that Robert Brown, Beachwood Lane, Lot 19, Map of South~ood, 66 Southold, New York, be granted permission to place a 3 ft. by 15 ft. dock, 3 ft. by 10 ft. ramp, and 5 ft. by 16 ft. float with two piles in front of his property on Goose Creek, all in accordance with the detailed spedifications as presented in the originating application. The mouth of the basin is now closed at low tide, due to shoaling which resulted from clamming along the edge of the mouth of the basin. On motion of Mr. Horton, seconded by Mr. Johnson, it was RESOLVED that~Nanc~ G~raham, Hickory Drive, Cutchogue~ New, York, be~granted permission to dredge an 8 ft~ by t8-ft, area~ removing 50 cu. yds.. of fill from-the mouth of the boat. basin on her. property off Broadwaters Cove, at Hickory Drive, Cutchogue~ all in accordance with the d~tail~d~specifications as presented in the originating application. It was the determination of the Board that Mary Edelmann, Mattituck, New York beck,quested to submit an~application for her dock, which was constructed in 1915 and~.recently c~mpletely rebuilt. Lajda, 600..Ea~w00d Drive, Cutchogue, New York,. be granted a temporary permit to place a second onshore- offshore mooring in Richmond Creek, on the east side of Town launching ramp.off Indian NecktLane, ~econic, New York, all in accordance with the detailed specifications as presented in the originating~application. Fee paid on Permit~No~ 775. Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton, Mr. Johnson, Mr. Gordon. (Mr~ Lajda's permit is temporary.and may be~w~t~rawn at a later date if the area becomes crowded, as the Board has only~ allowed an individual one mooring site at a public landing.) Foster~ ~315 South ~Street, Greenpor%, for two moorings. Qne moor~ng~.in Sterling Creek, Greenport, is within the boundaries of the~ncorporate~ Villag9 of Greenport, and a/permit should be.~ob~ained from~th~ Village rather than the Southold Town Trustees. The second mooring is for the end of Bayview Avenue north of Colony Road, Southold. All the mooring area is occupied a~ ~hat ~ite, and it was indicated the Board would look favorably on a mooring site at the end of Bayview Avenue south of Colony Road. At 9:45 P.M. the Board met with Richard Lark, Esq., attorney for Thomas Samuels, President of James H. Rambo, Inc., Wunneweta Road, Nassau Point, Cutchogue, and with Charles Guioz, Mr. Samuels' partner. Mr. Lark explained that Mr. Samuels had been ordered by s representative of the New York State Department of Environmental Conservation to stop work on s walkway, ramp and floating dock for Mr. Julius Juttner, on Mattituck Creek (Town Trustees Permit No. 772), under threat of criminal legal action, as a permit for the project must be secured from the State. Mr. L~rk was advised by the Board that: (1) The authority of t~e Board of Southold Town Trustees stems from the Andros Patent granted to the Town of Southold in 1676; confirmed in the New York State Constitution when originally adopted; organized and established in its present form by act of Legislature in 1893; and re-affirmed by act of Legislature as late as 1952. (2) The validity of the permit issued is as complete at present as it has been in the more than 770 permits previously issued by this Board under which work has been accompl~dover this long span of years without contest. (3) The authority granted to this Board has never been terminated or abrogated within any recent scope of our knowledge. (4) Although the permit h~as been issued to Mr. Juttner, we intend that it extend to any contractor employed by Mr. Juttner acting as his agent ~n carrying out the specifics of the permit. After lengthy discussion relative to Town, State and Federal authority, the Board assured Mr. Lark that they would speak to the Town Board immediately regarding the situation, and attempt to set up a meeting with John J.
