BOARD OF SOUTHOLD TO~N TRUSTEES
Meeting of March 5, 1973
A regular meeting of the Board of Southold Town Trustees was
held at 7:30 P.M., Monday, March 5, 1973 at the Town Clerk's
Office, Main Road, Southold, New York, with the following present:
Alvah B. Goldsmith, Chairman, Douglas~M. Robertson,
Philip G. Horton, Rudolph Johnson, Frederick E.
Gordon, and Judith T. Boken, Secretary.
Al-so present: Mrs. Evelyn S. Gordon, North Fork
Taxpayers Association, William ¥. T~erry, and C. W.
Gregory.
Mr. Gordon, a new member of the Board, and this being his
first meeting, asked that he be given an opportunity to study
the applications before voting~o~ them.
Mr.. Edward H-allihan appeared before the Board for information
relative to mooring a float, he was instructed to file an
application and was given the necessary forms.
Mr. William Bo~cola Jr., President of Mattituck Holding Co.
(Mattituck Inlet Marina & Shipyard Inc.), Mill Road, Mattituck,
New York, appeared before the Board to present his application
for an additional 15 floats and 43 pilings at the Mattituck
Inlet Marina & Shipyard. The purpose of the application is to
move dockage customers to the south end of the marina and free
existing gas dock and dockage area for use as repair facility,
sales of new boats and gas. The Board advised Mr. Boscola they
would investigate the site on March 8th.
Mr. Patrick Carrig present the applications of Arthur Sauer and
John Lusk, Riley Avenue, Mattituck, who wish to build a ramp and
floating dock at their joint propert.~ line on James Creek.
60 ft. walkway presently exists~. The-Board is familiar with the
property, and advised Mr. Carrig 'they-would'~s~udy ~the applications
and make~a decision before the end of the-~meeting.
On motion of Mr. Horton, seconded by Mr. Johnson, it was
RESOLVED that A thur S~ r and John Lusk_, be granted permission to
build a ramp 3 ft. by 10 ft., and floating dock 5 ft. by 75 ft.,
with 8 pilings at their joint property line-on-James Creek, off
Riley Av~enue, Mattituck, New York, all-.-info,accordance ~ith the
detailed specifications as presented in the originating application.
Fee $48.50.

Richard Lark, Esq. appeared before the Bo~rd~0 present application
of Henry F. Praas$ Syosset, New York, for permission to bulkhead
185 ft. across his property on Hay~aters ~o~e, ~{aywaters Road,
Cutchogue. The bulkhead will be entirely on Mr. Praus' property.
The Board advised Mr. Lark that they would study the application
and make a decision before the end of the meeting.
On motion of Mr. Robertsen, seconded by Mr. Hor~on, i~ Was
RESOLVED that Henry F. Praus, R.D. k, Kirby Lane, Syosset~ New
York, be granted permission to bulkhead k85 ft. across, his
property on Haywaters Cove, Haywaters Road, Cutchogue, New Y~rk,
Lot 29 and part of Lot 30 at Nassau Point, known and designated
as "Fisherma~s Beach", Subdivision map "Peconic Ba~ Properties,
Inc." Bulkhead entirely on the applicant's property,: all in
accordance with the detaiied specifications as presented in the
originating application. $5.00 fee paid.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr.
Horton, Mr. Johnson, Mr. Gordon.
Mr. Lark suggested that the Board draw up regulations requiring
individuals who dig soft clams restore the land under the water
to its prior condition, rather than leaving po~Lhol~s Wh~ch~are
hazardous to bathers, etc. Mr. Lark was asked if he would
submit a suggested regulation for the Board's consideration.
Mr. Thomas Samuels, represent~ing James H. Rambo, Inc.. appeared
before the Board to present applications of: (1) Julius Juttner,
Westview Drive, Mattituck Creek, Mattituck, for a 130 ft. bulk-
head with a 10 ft. return on the north property line, and a
3~ ft. by 40 ft. walkway, 3 ft. b~ 16 ft. ramp, and 8 ft. by 16 ft.
f~oating dock, with 6 piling.s. (2) WaLter Silleck, Westview Drive,
Mattituck, for a ll0 ft. bulkhead on Mattituck ~reek adjoining
the Juttner property. (3) Theodore and Marqaret Chanoux, South
Drive, Mattituck, for a 2 ft. 10 in. by ~2 ft. ramp, 50 ft. by
3 ft. catwalk, 2 ft. by 10 ft. ramp, and 8 ft. by ~6 ft. floating
dock, with 5 pilings at their property on Mattituck Creek, South
Drive, Mattituck, New York. -- The Board advised Mr. Samuels that
they would study the Juttner and Silleck applications (they had
previously investigated the site) and ~reach a decision t~e~ore the
end of the meeting. The Chanoux application they would study and
investigate the site and make a decision at their next meeting.
On motion of Mr. Robertson, 's'ec~onded by Mr. Horton, it was
RESOLVED that .Walter Sil~leck, Westview Drive, Mattituck, New
York, be granted permission to build a bulkhead il0 ft. across
the ordinary high water mark in front of his property on Mattituck
Creek at Westview Drive, all in accordance with the detailed
specifications as presented in the originating application. Fee
$ 10.00

On motion Of Mr. Horton, seconded by Mr. Robertson, it was
RESOLVED that Julius Juttner, Westvie~ Drive, Mattituckr New
York, be granted permission to construct a bulkhead 141 ft. across
the ordinary high water _mark iR front of his property on Mattituck
Creek, at Westview-Drive, and build-a walkway 3½ ft. by 40 ft., ramp
3 ft. by 16.ft., and.floating dock 8~ft. by 16~ ft~ with~6 pilings,
all in accordance, with the detailed specifications as presented, in
the originating~application. Fee $172.60.

Mr. John-C. Kiffer, Jr. of Mitlburn Holding.Corp., 66 Lewis Lane,
Syosset~ N~w York, appeared before the Board to present his~applica-
tion for permission to dredge' a~ MattitUck Inlet off Luthers Road.
Mr. Killer proposes to,lease the land for the pUrpose of installing'
a conveyor to load sand on barges, which is being brought from~out-
side Southold Town, and transported to ConnecticUt. The Board
looked favorably upon ~the dredging project, as there is a need for
maintenance dredging in that area, however, the ma~n question arose
as to the strength oY the bulkhead to withstand the weight of the
barges~against it~ The Board-~will investigate the. sit,.on March.8th.
Mr. Roger Tabor appeared before the Board to present the application
of Howard A. Brown,. 17~0 .North Bayview Road, Southold, for: permission
to dredge approximate%y~50 cu~b%c yards in?front of!his~proper~ty at
Goose Creek to widen the channel and allow for the installation Of
a floatin-g dock. Mr~ Tabor advi.sed the Board that the property is
all bu%kheaded along %he Creek, but has shoaled off and Mr. Brown
cannot bring his boat up to the bulkhead. The Board advised Mr.
Tabor they wo~ld S%udy~ the appli~a~ion-~and investigate the site on
March 8th
The Board discussed the. question of. the $5~00. filing fee for .
mooring, appticationB~ and whether.a reduced~fee, should'be~charged
for renewals of all'the n~w moor.lng permits when~thmy come due in
one year~. No de:cision was made arc,th'is time.
A further question was rai~ed as to-the $§~00~fiting fee being~too
great for a minor who wishes to moor his boat. This question was
resolved due t~ the fact the-~Board of Town Trustees cannot enter
into a, contra~t-'with .a mmnor,~and~should not?make a sepa~at~ category

The Board again reviewed the application of Edward R. Burke, 1925
Bay Avenue, Mattituck, for two mushroom ~nohor moorings to be
placed on the east side-of James~Creek opposite Mr. Burke's
proper~y. The Board williinvestigate the site on March 8th.
An application was received from Theodore Bak.~idy, 183 Captain
Kidd Drive, Mattituc~, requesting a boat mooring in Mattituck
Creek at a point near Route 27A and Westphalia Road. The Board
will ~each a decks±on atr~heir next meeting-.
An application was received from Joseph P. Ulrich, 2345 Mill
~Creek Drive West, Southold; requesting permission to erect a
dock on the waterfront of his prpperty at Arshamomaque Pond.
The sketch cf the float~ ramp and permanent dock submitted
with the application is not complete and the Secretary was
instructed to request Mr. Ulrich to submit~_.a~more detailed
sketch.
Mrs. WarrEn M. McGregor, 75 Long-Ridge Road,. Plandome, New York,
and Minnehaha Boulevard, Southold, submitted an application for
permission to place a.mooring in Corey Creek, Southold, at the
foot,of Opeche Avenue. ~he Board will investigate the site on
March~ 8th and make a decision: at the next meeting.
An application was received from Borge Espensen, Woodcliff Drive,
Mattituck, New York, requesting permission to bui.ld a fixed dock,
ramp, and float with-2 pilings at Mattituck Creek off Woodcliff
Drive. The~B~ard will inve'S.tigate the site ~n March 8th and make
a decision ~ their next meeting.
The Board received~an application from Stanley Gould, submitted
by Lawrence Tuthill, requestin~ permission to dredge an area
30 ft. by l0 ft., removingl5 cu'. yds~.~of fill and backfilT'behind
the bu~khead with 15-cu. yds., on Mr~ Gould's. property at Ha~waters
Cove, F~sherman ~each Road, Cutchogue~ and to build a platform
6 ft. by 6 ft., ramp 2~ ft. by 12 ft., and floati~ dock 6 ft. by
20 ft~ with 2 pilings. The Board will investigate the site on
March 8th and make a decision at their next meeting.
The Secretary was instructed to send a~letter to Mrs. Mary Edelmann,
Mat~ituck Creek, requesting-a reply i~ writing; ....... giving~the date her
original dock was constructed and. dimensions at that time, and. the
extent of the repair or reconstruction of her dock wi~h the new
dimensions at this time. (The Building Inspector found ~hat
appeared to be new construction of a .dock~in~January.)
New applications were received~f.~om Robert E~ Crane, Southold
Harbor Road, Southold for a mooring in Richmond Creek, and
Frank Begora, Main Road, East Marion, for a mooring in Narrow
River Orient. -- The Board tabled the applications until their

next meeting, when the time has expired for renewing existing
moorings.
An application was received from James Homan, Fisherman's Beach,
Cutchogue, for permission to construct a floating dock with ~ilings
at Haywaters Cove, Cut~hogue. The Board stud~ed the application,
and reached the fol. lowin~ decision later in the meeting:

a ramp and floating dock at Haywaters Cove, CutCh~gue. 'The Board
investigated this site following the presentation of this application
at their last meeting.

RESOLVED that Henry J. Steinbrecher, t525' Haywaters Road, Cutchogue,
New York, be granted 'permission to ~ebuitd a dock located oh-his
own property, and'add a 10 ft~ b~ 3 ft. ramp an~ 12 ft. ~by 8 ft.
floating dock with 4 ~ilings ~n Haywaters Cove off Haywaters Road,
Cutchogue., all in accordance with the detailed specifications as
presente~ in the originating application. Fee $16.'60.

On motion of Mr. ~o~ton, seconded by Mr.~ R~bertson, it was'
RESOLVED that'John~and Hen~ietta~ McAlonan-be.~ denied permission to
place 35 ft. jetties in front of their property' &~=East Creek, off
Stillwater Avenue, Cutchogue, New York, as there is no evidence of
erosion to necessitate such ~constrUction .....

The Board received a letter from George S; Case, Cutchogue, referring
them to U. S. Ar~y.Corps of,~Eng~neers_Pu.blic Nogice No. 7193,
application of Dominick Barbera to construct ~groins and a pier
in Hoq Neck Bay, ~ittle Peconic Bay, Cutchogue. Mr. Case felt
the T~ustees would-be interested in maintaining a common right-
or-way) along the~beac~., 'Wh~ch'~wQuld be threatened by ~onstr~uction
of this groin. The Board expressed t,~eir agreement wi~h M~.~ Case's
letter, however, it is their bekief such a plan b~ Mr. Barbera
has been abandoned.

A copy of a letter from Howard Terry, Building Inspector, to the
Southold Town Board was received. The letter referred to the
barrier beach washing out on the southwest side of the creek at
Fanning Point, west GreenP0rt~_~as? 0f~he~Walter Sage property.
Mr. Terry stated that the area in question ~s wetland, but that
the channel should be reopened to prevent further erosion of the
barrier beach which is forming a new channel.
On motion of Mr. Robertson, seconded by Mr. Horton, it was
RESOLVED that the meeting of the Board of Southold Town Trustees
adjourn at~10:45
