Present were: Leslie Kanes Weisman, Chairperson/Member Gerard P. Goehringer, Member George Horning, Member, via Skype Ken Schneider, Member Eric Dantes, Member Vicki Toth, Zoning Board Assistant Call to Order at 5:02 P.M. by Chairperson Weisman. STATE ENVIRONMENTAL QUALITY REVIEWS: A. New Applications: reviews (pending)—None. The Board proceeded with the Agenda as follows: EXECUTIVE SESSION: 5:02 P.M. Motion was offered by Chairperson Weisman seconded by Member Dantes to enter into Executive Session for Attorney/client privilege. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). 5:22 P.M. Motion was offered by Chairperson Weisman seconded by Member Schneider, to exit Executive Session. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). Page 2—Minutes Special Meeting held May 15, 2014 Southold Town Zoning Board of Appeals POSSIBLE BOARD RESOLUTION TO CLOSE THE FOLLOWING HEARINGS: RALPH M. CARBONS JR. and LAURYN F. CARBONE#6746 - Request for Variances from Articles III and XXII, Sections 280-15, 280-13 and 280-116A(1) and the Building Inspector's January 10, 2014, amended January 14 2014, March 17, 2014 and April 2, 2014 Notice of Disapproval based on a building permit application for an`as built' accessory in-ground swimming pool and proposed accessory pool house, at; 1) `as built' swimming pool and proposed pool house location in other than the code required rear yard, 2) more than the code permitted one dwelling on each lot, pool house by design constitutes as a second dwelling unit, 3) `as built'in-ground swimming pool located at less than the code required bluff setback of 100 feet, 4)proposed pool house at less than the code required bluff setback of 100 feet, located at: No#East End Road, (aka Castle Road) (adj. to Block Island Sound) Fishers Island, NY. This Resolution was duly adopted (5-0). STEPHAN KALAIJIAN#6744 - Request for Variance from Article III Section 280-14 (Bulk Schedule) and the Building Inspector's February 19, 2014 Notice of Disapproval based on an application for building permit for conversion of an`as built' 3rd floor space to habitable space, at; 1) more than the code permitted 2.5 stories, located at: 1977 Bergen Road (aka Private Road#12) (adj. to Long Island Sound) Mattituck, NY. SCTM#1000-112-1-18 BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Goehringer to close the hearing reserving decision. Vote of the Board: Ayes:All. This Resolution was duly adopted (5-0). DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following applications. The original determinations of each of the following applications as decided are filed with the Southold Town Clerk: APPROVED AS APPLIED: PETER M. BOGER#6741 JOHN FORESTIERI#6740 APPROVED WITH CONDITIONS: CHERYL MEDDLES-TORRES#6742 ANTHONY ASCH#6738 STEPHAN KALAIJIAN#6744 DENIED. GRANT ALTERNATIVE RELIEF CHRISTINA QUARTY#6739 Page 3—Minutes Special Meeting held May 15, 2014 Southold Town Zoning Board of Appeals GRANT IN PART/DENY IN PART; GRANT ALTERNATIVE RELIEF GARY and KATHLEEN ZUAR#6743 WORK SESSION A. Requests from Board Members for future Agenda items. B. Time limits on variances. RESOLUTIONS/UPDATED REVIEWS/OTHER A. RESOLUTION ADOPTED:Motion offered by Chairperson Weisman, seconded by Member Goehringer, to authorize advertising of hearings for the next Regular Meeting to be held June 5, 2014 at 8:30 AM.Vote of the Board:Ayes:All. This Resolution was duly adopted(5-0). B. RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by Member Goehringer, to approve minutes from Regular Meeting held May 1, 2014. Vote of the Board: Ayes:All. This Resolution was duly adopted (5-0). WORK SESSION C. Code Section 280-A and berms, landscaping, hardscape in town right of way. There being no other business properly coming before the Board at this time, Chairperson declared the meeting adjourned. The meeting was adjourned at 7:26 P.M.
