MARTINEZ 280 SOUNDVIEW AVE., PECONIC SCTM#67-1-7 Dear Mr. Ivans: The Board of Trustees reviewed the survey prepared by John C. Ehlers Land Surveyor last revised on April 30, 2012 and determined the proposed 525.25 sf. second-story addition atop the existing single-family dwelling; reconstruction of railing to the attached rear deck; removal of 2,260 sf. concrete padding surrounding the dwelling and replacement with native plantings; and installation of a 320 sf. wood walkway from the parking area along the southwestern side of the dwelling to the existing wood walk around the perimeter of the rear attached deck to ut of the Wetland iurisdiction� under Chapter 275 of the Town Wetland Code an ap er 11 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff and/or wetlands jurisdictional boundary, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary best management practices are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Failure to Meet Permit Conditions Failure of the permittee to meet all the conditions of this permit is a violation of this permit and grounds for an order to immediately cease the ermitted activity at the project site. 6. Accessory Structures Must Be At Least 75 Feet Landward Of The Wetland Boundary This permit authorizes the construction of new accessory structures located in the a 'acent area at the prescribed minimum setback only. Structures located in tidal wetlands, or strut res in the adjacent area but located less than 75 feet from the wetland boundary, are not authorized. 7. DevelopmentRestrictions New accessory structure construction projects uthorized by this permit must meet all of the applicable development restrictions of 6 NYCRR Part 661 6(a)(1), (4) and (7): -The 75 foot minimum wetland setback requirement for all principal structures and all non-water- dependent structures exceeding 100 square feet in area. -The 20%maximum adjacent area coverage limitation for impervious structures and surfaces. -The 75 foot minimum wetland setback requirement for all hard surface driveways,roads,parking areas and similar impervious surfaces exceeding 500 square feet in area. 8. No Changes to Septic System This permit does not authorize any alteratio i, expansion or replacement of existing septic systems. 9. Area of Disturbance for Structures Disturbance to the natural vegetation or topography greater than 25 feet seaward of the approved structure is-prohibited. 10. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion control devices shall be placed at the landward edge of the buffer area or 75 lin ar feet from the tidal wetland boundary, or as per the NYSDEC-approved plan,prior to commencement of any regulated activities and remain in place and in good, functional condition until the project is completed and all disturbed areas are stabilized with vegetation. 11. Contain Exposed,Stockpiled Soils All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained by a continuous line of stiked haybales/silt curtains (or other NYSDEC approved devices)placed on the seaward side between the fill'and the wetland or protected buffer area. Roof Runoff Directed to Drywells Roof runoff shall be directed to dryw Us with the capacity to store/recharge the runoff from a 2 inch/24 hours precipitation event. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 50 lineaj feet from the tidal wetland boundary. 18. Concrete Leachate During construction,no wet or fresh concrete or leact ate shall be allowed to escape into any wetlands or waters of New York State,nor shall washings from ready-mixed concrete trucks,mixers,or other devices be allowed to enter any wetland or waters. Town Law§267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There was no evidence presented that the proposed increase in nonconformance may cause a detriment to nearby properties. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant's proposed second story addition requires the addition of structural components in the first floor ceiling which are creating the subject increase in degree of nonconformance. 3. Town Law 4267-b(3)(b)(3). The variances granted herein for an "increase in the degree of nonconformance" of a nonconforming single side yard setback and a nonconforming combined side yard setback, based upon the addition of a second story with inaccessible balconies are mathematically substantial, representing 100% relief from the code based upon the Walz (5039) interpretation. However, the proposed second story side yard setbacks are conforming to code and the increase in the degree of nonconformance caused by the addition of second story decorative exterior balconies are small in scale.1he variance granted herein for a single side yard setback of 9.2 feet, where the code requires 10 feet, is not mathematically substantial, representing 8% relief from the Code. The variance granted herein for a combined side yard setback of 21.4 feet, where the code requires 25 feet,-is mathematically substantial, representing 14.5% relief from the Code. However, both are existing side yard setbacks that will be maintained. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. i 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the proposed alterations and second story addition,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The real estate ' marketplace indicated increased inventory, lower prices and declined sales. Unemployment is approximately 8%. The county real estate marketplace is witnessing a slight reduction in values for residential real estate. There are bank foreclosures still playing a major role in this region. However,more sales are occurring compared to last year and the market may be beginning to bottom out. This trend ' should continue to next year. The commercial marketplace in the county is rated as fair. There are a few more vacancies compared to last year,but sales of commercial property remain fairly strong. This trend continued through 2013. 6 1 H. Township and Neiahborhood Analysis ' A Brief History of the Town of Southold and Hamlet of Peconic ' The Town of Southold was settled in 1640 with the lands purchased from the Indians a little at a time. By 1646,the final borders were established as they are today. Southold Town adjoins the Town of Riverhead on its west border. The north border fronts on the Long Island Sound,the south border on Great Peconic Bay, and the easternmost point, Orient, borders on the easternmost point of the North Fork at Plum ' Gut. As of the census of 2010,there were 21,968 people, 8,461 households,and 5,804 families residing in the town. The population density was 383.5 people per square mile. There were 13,769 housing units at an average density of 256.3 units per square mile. The median income for a household in the town was $49,898, and the median income for a family was$61,108. ' The area is well known for its excellent beaches, farmlands, and fishing. There are three major school districts,volunteer fire departments, and an 80 bed hospital. The mayor industries are farming,fishing,and tourism. ' The unemployment rate is approximately 7%. The area major industries such as vegetable farming,wineries and retail appear to be in better condition than the last two ' years. Commercial vacancies are still slightly higher than last year but the retail and offices in business are mostly reporting an increase in business this year. The North Fork is still a popular destination for day trippers and weekenders. This area is not just ' a summer resort only-the weekends are busy mostly throughout the year now. This trend should continue into the next year. ' Hamlet of Peconic The Hamlet of Peconic is among the smallest in Southold Town. It is a strip ' running from the Long Island Sound to the north to Hog Neck Bay at the southern portion,then easterly to Carroll Lane and westerly in an irregular line to the east of Bridge Lane. Waterfront homes on both the north and south boundaries are, for the most part, large and expansive. Tucked in between are a variety of properties varying from bed&breakfasts,multifamily homes,unheated summer cottages,and year-round residences of various architectural design. Maintenance is good. There are working ' farms in the hamlet as well as wineries and vineyards. Economic Trends ' In the early part of 1987 we witnessed a peak in real estate market activity and prices. In 1988 through 1990 we saw a down trend in real estate market value mainly due to an oversupply of listings, lack of motivated sellers, few buyers and poor economic conditions. ' The end of 1990 and the early part of 1991 had indicated a bottoming out of prices and a slight increase in market activity. The early part of 1992 to the current time has continued to indicate more market activity mainly due to more realistic pricing of ' sellers and an increase of buyer interest. In 1993,the East End of Long Island generated its most sales since 1988. A combination of low bank interest rates and motivated sellers were the mayor reasons. 1994 was similar. ' In 1995, and 1996 in particular,the market activity increased and was rated as good for low priced homes and home-sites and fair to good for other price ranges depending on the offering prices. Vacant acreage and farms indicated an increase in number of sales. Commercial properties had a similar trend based on asking prices. The overall marketplace was rated as"active market"and the trend for 1997 was a ' seller's market with an increase in the number of sales and sellers receiving at or near asking prices. 1998 continued to be a very active marketplace. The number of sales increased and inventory dropped. The residential market was very strong,the vacant ' land marketplace was strong and the commercial marketplace fair but improved. 1999 continued as a very strong buyer's market for residential property. Commercial property was not as strong as the residential market. 2000 through 2006 continued to be ' a very strong seller's market for all types of residential properties. Commercial properties showed more activity and indicated a fair to good marketplace. ' 2007 continued to indicate a good marketplace for the area. The listing base increased for residential and commercial properties and there were many qualified buyers. 2008 indicated an increase in real estate inventory, a reduction in the number of ' sales and a slight decrease in market value. The residential marketplace has indicated larger reductions in value than commercial property. This trend continued from 2009 through 2011. 2012 and 2013 started slowly,but the number of sales has increased from the prior years on the North Fork. 12 Part 1I.—Economic Trends—cont'd. The number of foreclosures on the North Fork has had an insignificant effect the ' marketplace. Mortgages are available and the interest rates are attractive. The economic trends for the East End of Long Island are favorable. Interest rates are declining and there is more buyer interest. Owners willing to negotiate are finding ' qualified buyers. The financial crisis from the last two years appears to be waning especially on the North Fork. There are very few homes in foreclosure now and these numbers will dwindle further into the next year. The prices for residential and ' commercial properties appear to be bottoming out-more sales being made due to increased buyer interest and owners willing to negotiate. Description of the Subject's Building Improvements ' The subject is a one story, frame ranch with vinyl siding, asphalt shin le roof, ' aluminum gutters and thermo pane windows. The home was originally built approximately 1960,there have been recent renovations and the home is considered to be in very good condition. The dwelling is 29'x 59'. There is a 16' x 29' wood deck. ' The subject interior is finished with wood floors,wood panel walls,tiled ceiling. The home is insulated and heated with electric baseboard heat and there is central air conditioning with a reverse cycle for heat. There are four bedrooms,2 full bathrooms with file floors,breakfast nook, and a kitchen with refrigerator,range, dishwasher and microwave. There is a dining room i with fireplace and a living room. There is a full finished basement with heat. There is an outside entrance. ' Subject Site Description The subject is located on Long Island Sound. The site has 50' of waterfront. The site measures .2 acre according to the property data information from the Town of Southold. 20 ' Part 2. ' B. Zoning ' The subject is zoned Residential—40. The purpose is to provide for single family homes. The subject would be considered to be non-conforming,pre-existing ' use. ' C. Taxes and Assessed Valuation ' According to the Suffolk County Real Property Tax Service Agency and the Office of the County Treasurer,the total 2012/2013 taxes are: Land Value $ 1,100.00 Improved Value 5,300.00 Total Value $ 6,400.00 ' One Year Tax $ 7,276.00 21 ' Part 2. ' A Highest and Best Use Highest and Best Use is defined as: The reasonable and probable use that supports the highest present value of vacant land or improved property, as defined as of the date of the appraisal. The reasonably probable and legal use of land or sites as though vacant,found to ' be physically possible, appropriately supported,financially feasible and that results in the highest present land use. ' There are four stages of analysis: 1)Physically Possible Uses ' 2)Permissible Use(legal) 3)Financially Feasible Use 4)Maximally Productive Use ' The subject's highest and best use is the current use as a single family dwelling. There is a pre-existing certificate of occupancy issued 12/13/11. 22 Part 2. ' E. Three Approaches to Value ' Indicated Value by the Income Approach The Income Approach is that approach which converts anticipated benefits to be derived from the ownership of property into a value estimate widely used in appraising income producing properties. ' The Income Approach will not be used. ' Indicated Value by the Cost Approach ' The Cost Approach is that approach in the appraisal analysis which is based on the supposition that the informed purchaser would pay no more than the cost of producing a substitute property with the same utility as the subject property. ' The Cost Approach will be used for the building improvements only. ' Indicated Value by the Market Data Sales Comparison Approach The analysis includes a dollar adjustment reflecting market reaction to those ' items of significant variation between the subject and comparable properties. If a significant item in the comparable property is superior to, or more favorable ' than,the subject property,a minus(-) adjustment is made,thus reducing the indicated value of the subject. If a significant item in the comparable is inferior to, or less ' favorable than,the subject property,a plus(+)adjustment is made,thus increasing the indicated value of the subject. The Sales Comparison Approach will not be used. ' 23 Part 2. ' F. Valuation Process ' The valuation process is an orderly logical and concise method of reaching an estimate of value. The major steps are: ■ Definition of the valuation problem ' ■ Preliminary study ■ Data collection and analysis ' ■ Application of the three approaches ' ■ Reconciliation of value indications. ■ Final estimate of value ' Following this procedure assists the appraiser in reaching a sound value conclusion. The house is in very good condition(2013 pictures included). Depreciation is estimated at 11%- 8 years effective/70 years economic life. ' Subject Dwelling: 1,711 square feet x $275.
