SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 4, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section280- 13B(14) of the Zoning Code, to operate a Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their residential occupancy under the Building Department's Certificate of Occupancy-Z-22948 dated April 14, 1994. Three of the bedrooms will be used for lodging and serving of breakfast to 6 B & B casual, transient roomers. The previous owner of the subject dwelling was granted a Special Exception to operate a Bed&Breakfast. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 1, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Cheryl Meddles-Torres, the applicant herein, is the owner of the property, at 26350 Main Rd., Cutchogue. It is improved with a 2 story dwelling and accessory garage, as shown on the survey prepared by Martin Read, L.S., dated May 7, 2013. The owner/applicant will continue to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and Page 2 of 3—May 15,2014 ZBA#672—Meddles-Torres SCTM#1000-109-4-5 operated. 2. The applicants' plans comply with the on-site parking requirements and provide for 5 parking spaces, two for the principal single-family use and one (1) for each of the Accessory Bed and Breakfast bedroom(s). 3. The applicant complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code. 4. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. 5. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 6. This accessory will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 7. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 8. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 9. No adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Zoning Code. 10. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member Schneider, seconded by Member Goehringer,and duly carried to; GRANT, the Special Exception permit for an Accessory Bed and Breakfast, to be used only in conjunction with the applicants-owners residence, as applied for and shown on the survey prepared by Martin Read, L.S. dated May 7, 2014 and floor plans prepared by Cheryl Meddles-Torres. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an operating permit and inspection by a Code Enforcement Officer from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department on an annual basis to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. There shall be no sleeping area on third level. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. NOTE: This Special Exception permit cannot be transferred to new owners. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. A fire safety notice shall be affixed to the occupied side of the entrance door of each bedroom for B&B use indicating; 1)means of egress, 2) location of means for transmitting fire alarms, if any;and 3) evacuation procedures to be followed in the event of a fire or smoke condition or upon activation of a fire or smoke-detecting or other alarm device. 4. No sleeping rooms for B&B use shall be located above the second story. 5. The dwelling shall have at least two(2)exits and there shall be a window to code to provide emergency egress in every sleeping room for B&B use. Means of egress shall include at least one of the following alternatives: 1)A portable escape ladder that attached securely to the sill, shall be provided for second story rooms for B&B use,constructed with rigid rungs designed to stand off from the building wall,it shall be capable of sustaining a minimum load of 1,000 pounds,and shall extend to and provide unobstructed egress to open space at grade,2)an exterior stair per code,3)or limited area sprinkler system per code. 6. A survey by Stanley J. Isaksen dated February 16, 2000 shows an area of 12,384.6 sq. ft., improved with a frame residence, with a porch in front and a large deck at the rear, and a detached garage in the rear yard. BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated July 26, 2000, denying a permit to build an addition onto the east side of the house for two reasons: (1) the addition would reduce the easterly setback at the closest point to the lot line from 24.8 feet to 13 feet and this, together with the existing nonconforming westerly yard of 8.2 feet, would result in combined side yards of 21.2 feet, whereas Code Section 100-244 requires a combined total of 25 feet; (2) the addition would increase lot coverage from the existing 21 percent to 25 percent, whereas Code Section 100-244 allows no more than 20 percent. RELIEF REQUESTED: Applicant requests a variance authorizing the project as proposed with combined side yards of 21.2 feet (13 feet and existing 8,2 feet) and lot coverage of 25 percent of the total lot, or 3,096.15 sq. ft. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicants operate a bed-and-breakfast in their home, with two guest bedrooms. They wish to expand their home for three guest bedrooms, and to do so requires an addition to the house for their own private quarters. The presence of a large deck precludes an addition at the rear. Because the lot is narrow, and the existing westerly side yard is only 8.2 feet at its narrowest point, applicant's proposed expansion to the east requires a variance for combined side yards. Because the lot coverage already exceeds the allowable 20 percent, any addition to the house requires a lot coverage variance. (2) Applicants' property benefits from the fact that it is bordered by the open space of a golf course on the west and south. Because of this, an increase in the lot coverage is less likely to create a crowded appearance than would be the case in a more conventional setting. The survey of February 16, 2000 in fact shows the driveway extends two feet over the easterly lot line. The Board concludes that the proposed reduction of the combined side yards to 21.2 feet would have a visual impact that threatened to produce an undesirable change in the character of the neighborhood and detriment to nearby properties. (4)There is no evidence that the action set forth below will have an adverse effect or impact on physical or environmental conditions. (5)The action set forth below is the minimum necessary and adequate to enable applicants to expand their house while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. (6) The Board notes that applicant obtained authorization for a two-bedroom Accessory B&B Use in Special Exception No. 4403, dated August 21, 1996. The action by the Board herein does not amend that Special Exception. If applicant intends to operate a three-bedroom B&B, he must apply to the Board for a Special Exception expressly covering three guest bedrooms.
