SCTM#1000-50-1-15 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is located in the R40 Zone and contains 29,202 sq. ft. It is improved with a 2 '/2 story dwelling, accessory garage,two accessory sheds and accessory solar panels. It has 95.25 feet of frontage on Anderson Road, 235.00 feet along the southern property line, 125.06 feet along the western property line and 235.00 along the northern property line as shown on the survey dated February 23, 2014 prepared by John Gallacher, LLS. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's March 7, 2014 Notice of Disapproval based on an application for building permit for an `as built' accessory solar array, at; 1) location other than the code required rear yard. RELIEF REQUESTED: Applicant is requesting a variance for the `as built' location of the accessory solar panels located in the front yard where the code requires accessory structures be located in the rear yard. ADDITIONAL INFORMATION The agent for the applicant from Solar Energy Company, and the applicant indicated at the hearing that the application for the building permit was submitted in the present front yard location. However, the survey submitted was an old survey and it did not clearly show where the road frontage was. The Building Department relied on the information submitted by the applicant as to the location being conforming. Upon inspection by the Building Inspector it was discovered that the accessory solar panels were placed in the front yard. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 1, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 2 of 2—May 15,2014 ZBA#6740—Forestieri SCTM#1000-50-1-15 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's property is located on a 20 foot Right of Way,which is the only road frontage to the dwelling. It is private and used by the residents of the area, and is not a heavily travelled roadway. The structure is approximately 5+/- feet in height and is located approximately 36 feet from the front property line. 2. Town Law&267-b(3)(b)(2).The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue, other than an area variance. The applicant could move the solar structure to the technical rear yard of this home. However,the applicant's agent testified that the conforming rear yard location would provide practical difficulties for the correct functioning of solar collection in this shaded area of the property. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, there is no visual impact to nearby property owners since the subject property is at the dead end of a private dirt road, an adjacent parcel is undeveloped, and the solar collectors cannot be seen by the neighbors of the homes to the west and north of the subject parcel. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Solar collection is a benign activity with no unhealthy consequences. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant submitted incorrect information to the Building Department regarding the proposed location of the accessory structure. 6. Town Law 4267-b. Grant of variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of accessory solar panel array while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried,to GRANT, the variance as applied for, and shown on the survey dated February 23, 2014 prepared by John Gallacher,LLS. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
