SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 4, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is located in the R40 Zone District, it is non-conforming containing 13,416 sq. ft. It is improved with a 1 and 2 story single family dwelling and an accessory shed. The property has 77.63 feet of frontage on State Street(Skipper Lane), 178.59 feet along Oyster Ponds Lane, 72.56 feet on the northern property line and 178.87 feet along the eastern property line as shown on the site plan dated February 13, 2014 prepared by Nancy L. Steelman, R.A. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's March 4, 2014 Notice of Disapproval based on an application for building permit for a screened porch addition to an existing single family seasonal dwelling, at; 1) less than the code required front yard setback of 35 feet(Skippers Lane), 2) less than the code required front yard setback of 35 feet(Oyster Ponds Lane), 3)more than the code permitted maximum lot coverage of 20%, located at: 290 Skippers (aka State Street) Lane (corner Oyster Ponds Lane)Orient,NY. SCTM#1000-25-1-1 RELIEF REQUESTED: The applicant requests variances to; 1)construct a seasonal wrap-around screened front porch having 1)an 11.8 foot front yard setback from Oyster Ponds Lane and 2)a 14.8 foot front yard setback from Skippers Lane,where the code requires a minimum of 35 feet from each front yard, and 3)propose new construction creating a 20.6%total lot coverage,where the code permits a maximum of 20%. All as shown on the architectural drawings entitled"Renovations&Additions to the Asch Residence"prepared by Nancy L. Steelman, R.A., Sheets: SP, 1, 2 and 3 dated Feb. 13, 2014. ADDITIONAL INFORMATION: As requested by the Board of Appeals at the public hearing, on May 8, 2014 the applicant's architect/agent submitted a "Neighborhood Site Plan" showing the existing front yard setback Page 2 of 3—May 15,2014 ZBA#6738—Asch SCTM#1000-25-1-1 dimensions of 30 other dwellings in the applicant's neighborhood. In comparison to what the applicant proposes, this site plan shows 2 dwellings with smaller front yard setbacks, 4 dwellings with similar front yard setbacks and the majority with greater front yard setbacks to what the applicant proposes. However only 3 (10%) of the dwellings in this neighborhood have an existing conforming front yard setback. The proposed construction also requires approval by the Town of Southold Landmarks Preservation Commission. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 1, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed first floor seasonal screened front porch addition is characteristic of other residential properties in this neighborhood. Furthermore, the proposed construction is reviewed by the Landmarks Preservation Commission for its approval, whose mission is to protect historic landmarks from incompatible architectural alterations. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling exists in its non-conforming front yard setback locations, therefore any proposed additions such as the first floor screened front porch will require front yard setback variances. 3. Town Law 4267-b(3)(b)(3). The variances granted herein for an 11.8 foot front yard setback form Oyster Ponds Lane and a 14.8 foot front yard setback from Skippers Lane are both mathematically substantial, representing 66% and 58% relief from the code, respectively. However, with respect to the Skippers Lane requested relief, the dwelling has an existing screened front porch with an existing 14.8 foot front yard setback. With respect to the proposed front yard setback on Oyster Pond, the applicant's agent provided documentation showing that only 3 out of 30 homes in the neighborhood have conforming front yard setbacks, and 4 have similar setbacks and 2 have smaller front yard setbacks to what the applicant proposes. The variance granted herein for a 20.6%total lot coverage is not mathematically substantial,representing 3%relief from the code. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing a first floor screened front porch, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Horning, and duly carried, to GRANT, the variances as applied for, and shown on the architectural drawings entitled "Renovations & Additions to the Asch Residence" prepared by Nancy L.
