Relief is requested from: i 19 NYCRR Part 1220, The Residential Cade of New York State, Section AG 105.3, which requires that an outdoor swimming pool, including an in-ground, above-ground or on-ground pool, I hot tub or spa be pro ided with a complying harrier. [The petitioner requests that swimming pool not be completely enclosed within a co 11n plying barrier.] FINDINGS OF FACT I I The code rec uires that a swimming pool be enclosed with a barrier tat is at least 48" in height and meets certain design criteria. 2. The swimming pool that is the subject of this petition is an accessory structure to a single family dwelling. It is located in the rear yard, but has not been entirely enclosed wi�h a code-compliant i barrier. The dwelling serves s part of the barrier and there are fences on the east and west side of the I rear yard. I I 1 3. The southerr edge of the rear yard faces a bluff overlooking Long Island Sound, approximately 45 feet above 1he shoreline and the stairway leading to the beach is protected by a 5 foot high self-closing, self-latching,gate with child proof safety locks. i 4. CONCLUSION OF LAW The proposed variance will not substantially adversely affect the Code's provisions for health, safety and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties, economic hardship, or would other\A ise be unwarranted because such would be unn cessary in light of alternatives which, without a loss ir the level of safety, achieve the intended purpose of the code. Boar Tr Tax Map 1000-33-01-16 2200 Sound Drive Greenport, NY 11971 This project began at our first preliminary site inspection on October 9, 2013,after meeting with the Board of Trustees at the above site we discussed the placement of a proposed swimming pool. With further investigation we went into the Zoning Board of Appeals to apply for a variance since we wanted to build the pool closer than the allowed 50'from the top of the bluff. Zoning Board of Appeals already granted a swimming pool 30'from top of the bluff back in 1986 when the required distance was 100'from the top of the bluff. Our first hearing with the Trustees was on February 19`h 2014 and we appeared before the board with a 18x40 inground proposed pool with a 5'wide walkway and a 20x30 permeable paver patio. At the meeting the trustees tabled the pool and requested an Engineers report to discuss if the job site could handle a pool and patio at the job site. They also requested a test hole be performed and have an Engineer discuss the findings. Homeowner was present and representative from Swim King Pools. On March 19`h we met with the Trustees and brought our Engineers report and test hole information. This was sent to the Town a week prior to the meeting. The Trustees didn't discuss the Engineers report or test hole but rather requested the pool be moved farther away from the top of the bluff by changing the pool size and changing the walkway. It was tabled again for April 23, 2014. After careful consideration the homeowner has agreed to change the size of the pool to what was exactly granted before the Zoning Board of Appeals, an 18x36 proposed pool. Due to the fact that the screened in porch has a roof and is attached the house the 5'walkway between the house and the pool will remain but the walkway closer to the bluff we will shorten to 3'. We will keep with what was granted in 1986 and increase what was granted by another 3 feet. The test hole and Engineers report shows that the soil conditions have suitable bearing capacity and stability at this location for the proposed work. Located: 2200 Sound Drive, Greenport. SCTM# 33-1-16 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT provided that: 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The Zoning Board of Appeals granted a variance (Appeal No 3507) in 1986 to allow the construction of a pool 30' from the top-of- bank/bluff. Aerial analysis shows that the bluff surface is heavily vegetated and relatively stable at this time, however,with consideration of the recent intensity of storm events that have caused the Town's shoreline to experience severe erosion (even when hardened) it is recommended that the pool be redesigned or relocated to maximize the distance from the Coastal Erosion Hazard Area. The location of the subject parcel is show in Figure 1. below. Note that the dimensions of the pool approved in the 1986 Zoning Board of Appeals decision do not match the plans submitted to the Board. In the decision the pool is proposed at 18'x36', the current proposal proposes an 18'x40' pool. The walkway needs to be also verified that it complies with the decision. z ! v a t a Pi a '« Figure 1. The Board assess that the loading of the equipment to construct the pool and the pool itself will not compromise the stability of soils. 2. In addition, verify how the drywell would be connected to the pool system. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
