(631)765-1809-Fax (631) 765.9064 �7 ] �—Q r FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF OCTOBER 18, 2007 ZBA File No. 6067—WENDY LOMAS and CHARLOTTE GREENE Property Location: 500 Stephensons Road, Orient CTM 17-1-6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The May 22, 2006 survey confirms the property size to be 39,231 square foot parcel with 308.56 feet along Birds Eye Road (private road), 100 feet along the northwestern lot line, 160.6 feet along the southwestern lot line, and 271.19 feet along the western lot line. The property is currently improved with a two and one story accessory building in disrepair. The accessory building is shown on the May 22, 2006 survey at 20.2 feet from the northern lot line and 1.2 feet from the eastern lot line. BASIS OF APPLICATION: Zoning Code Sections 280-15 (C), based on the Building Inspector's June 18, 2007 Notice of Disapproval concerning proposed construction/replacement of an accessory building in the same nonconforming location at less than the code required 10 feet from any property line. CHAPTER 280 (formerly Chapter 100) - ZONING CODE PROVISION: Zoning Code Section 280-15 (C), which states that an accessory building shall not be constructed less than 10 feet from any lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 13, 2007, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The relief requested by the applicant is permission to rebuild an accessory building 15.7 ft. by 15.4 ft. in its current location 1.2 feet from the (eastern) lot line.
