party of the first part, and -FRANK MAIETTA and JANET MAIETTA, his wife, residing at
1333 Park Avenue, Merrick, Nassau County, New York
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con-
sideration paid by the party of the second part, 'does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party for the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the-Town of Southold; at Cutchogue, County of Suffolk and State of New
York, bounded and described as follows-
BEGINNING at a point on the North side of Stillwater Avenue distant South 590 32' 00"
East 149.38 feet from an angle point in Stillwater Avenue where its Northerly and Westerly
lines intersect and at the Southwest corner of a parcel designated as "Plot B Reserved" on
Map of Section Two, property of M.S. Hand, filed in Suffolk County Clerk's office as Map
No. 1280; running thence South 590 32' 00" East 100 feet along the Northerly side of
Stillwater Avenue to a point; running thence North 440 31' East 200 feet, to the Southerly
Iine of a gutter'-, running thence North 640 57' 40" West along the Southerly line of said
gutter to a point which is distant North 440 31' 00" East 190 feet from the point of beginning
herein; running thence South 440 31 ' West 190 feet to the point or place of BEGINNING.

a� TOGETHER with the right to use the canal leading to Eugene's Creek in common with
others; however, mooring privileges are limited to that portion of the canal within the
_f lines of the grantee's property and are further limited so as not to block passage of others
having passage privileges on th(at part of the canal.
BEING the same premises heretofore conveyed to the grantees by deed dated June 24,
3 1980 recorded in deed liber 8851, page 259, County Clerk Suffolk County on July 14, 1980.

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of
the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
