THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON SEPTEMBER 8, 1992:
WHEREAS, the Southold Town Board, on March 10, 1992, accepted the bid
of Harbour Excavation for supplying the Town with soil for covering
purposes at the Landfill; and
WHEREAS, on August 27, 1992 Douglas Standley, proprietor of Harbour
Excavation, notified Superintendent of Highways Jacobs that due to poor
health, he is unable to complete the contract for supplying soil for covering
purposes at the Landfill; now, therefore, be it
RESOLVED that the Town Board hereby accepts the proposal of James C.
Donald, J & K Trucking & Major Materials, Riverhead, the next lowest
bidder for the aforesaid project, in the amount of $4.24 per cubic yard,
to complete the contract for soil for covering purposes at the Landfill; and
be it further
RESOLVED that the Town Clerk be and she hereby is authorized and
directed to return Mr. Standley's $100.00 bid deposit check for the
aforesaid bid.

town landfill. I understand and fully
position, however, I would like to request that you
reconsider your decision.
As you know, there is an ongoing problem due to the
existence of many illegal transfer stations on Long Island..
These transfer stations invariably operate
ty outdoors

disregard for environmental, health,
regulations. some of these transfer stations may be
illegally dumping or landfilling the C&D material. The
Department and townships have been taking enforcement action
against these illegal facilities to bring them into
compliance with-the=law•-or close•-•them:
Rapid Demolition Inc. applied for and constructed a
transfer station in accordance with 6NYCRR Part 360 solid

the Town landfill .
If the Town Board' s decision after reading
the above mentioned attachment is- to use C & D
for daily cover, I would strongly advise the Town
attorneys to expedite writing a stringent specif-
ication for a new bid announcement . I fully expected
a bid award on the 25th of February to continue proper
covering as per D . E .C . regulation . We will be out of
cover by March 18th which will put us in violation and
create many angry neighbors .

As per our telephone conversation today,

1 . We define "screened C&D material" as that residue remaining
after the recyclable components, such as wood, metal, glass

screen size. In other words, it would be unacceptable to

"Screened C&D material"; All recyclables must be
of the waste stream before shreddin of out

2 . Landfill accepting the "screened c&d material" can only
accept same from facilities permitted under 6NYCRR 3602 ,
or under Department executed consent orders ,
3 The "Screened C&D material" must closely resemble soil with
some recognizable small pieces of masonary and wood present
and appeared the criteria for daily cover, i . e . controlling
fire, odor, vectors, blowing litter and scavenging,
4 . To be acceptable, the material should be held to that

SUBJECT: Use of C&D Screenings as Landfill Cover
As you requested, I have contacted Brookhaven Town regarding
their experience in using ground, screened C&D debris as daily
landfill cover . According to Robert Reichert, Deputy
Commissioner of Waste Management for Brookhaven Town, this
experience is extensive .
Brookhaven had arranged with Rapid Demolition of Medford, NY, to
take screened C&D from Rapid at a charge of $12/ton that Rapid
agreed to pay to the Town. At one point, Rapid was bringing in
15,000 tons of material per month to Brookhaven, which needed as
much as 500 tons per day as landfill cover . With some of
Brookhaven's waste going to an incinerator, coupled with problems
with the screened C&D, the Town now uses only about 2, 500 tons
per month of C&D as cover, and intends to phase it out
completely.
The problems with screened C&D experienced by Brookhaven include:
o Odors . Some months after applying the screened C&D,
excessive gas odors started being emitted from the
landfill, causing numerous complaints from nearby
residents . These odors were caused by hydrogen sulfide
gas, which is produced when the screened wood waste
that makes up much of C&D debris is exposed to water .
A similar odor caused the North Hempstead landfill in
Port Washington to be shut down by the DEC.
o Cost of Testing. Brookhaven Town paid approximately
$1, 500 per week to test the C&D brought in by Rapid
Demolition to make sure it was free from hazardous
waste or other contaminants . Regulations hold landfill
owners and operators liable for ensuring such wastes
are not disposed in their facilities . Also, some of
the C&D originated outside of Brookhaven Town,
providing an increased chance that unwanted material
might find its way into the loads . While the C&D
tested did not prove to contain hazardous substances,
tests were performed on only one portion of one load
each week . With hundreds of loads entering the
landfill each week, it is impossible to know for sure
that contaminants did not make .there way into the
landfill .

o Size of Screenings . Under its arrangement with
Brookhaven Town, Rapid Demolition was supposed to
screen its C&D to a size of 2-inch pieces or less .
Landfill officials repeatedly found screenings to be of
larger, less useful sizes .
o Problems With Permit Compliance . Due to the huge
supply of screened C&D and the ease with which it can
hide contaminants, legal C&D operations are heavily
regulated . Since Rapid Demolition is one of only a few
permitted facilities, it is, according to Mr . Reichert,
inundated with C&D material well beyond its permitted
capacity. Town officials feel uncomfortable dealing
with an operation that may not be in compliance with
permit conditions .
Mr . Reichert said he would welcome a visit by any Town Board
member or other official of the Town of Southold to look at the
Brookhaven landfill and discuss further the matter of using C&D
screenings as cover material .

Dear Mr. Jacobs:
As per your request, I have contacted the Stony Brook Office of the
New Yrok State Department of Environmental Conservation concerning the
above referenced subject. Existing Permitted Landfills on Long Island
have been given permission by the D.E.C. to use screened C & D material
for cover. However, the D.E.C. will not be held responsible for the quality
of the material. All Laboratory testing as well as the frequency of those
tests, which would be used to determine the relative cleanliness of the
material, will be the responsibility of the landfill operator or in our case
the Town of Southold. The Lab tests required are very costly & would be
cost prohibitive .on a truck by truck basis. If a spot check is done by
the State D.E.C. (this would be considered a routine operation) and
laboratory tests find evidence of harmful contaminants in the material it
would be the Town's responsibility to clean up the site. This could also
be very costly.
I have been told that permission to use the C & D material has been
given on a case by case basis. Since the Town's Landfill is not permitted
by the State it would be next to impossible to obtain the D.E.C. 's approvals
in this matter. It is my understanding that the Brookhaven Town Landfill
is currently using this type of material for cover. I have also been told
that the Town of Southampton had been using the material but have recently
decided not to continue to do so. The Town of Islip has also been given
approvals to use this material at there closed Sayville Landfill on at least
one ocassion in the recent past.

SUBJECT: Contact With Southampton Town Re: Using C&D
Screenings as Landfill Cover
As you requested, I have contacted Southampton Town regarding their,
experience using C&D screenings as landfill cover. In a conversation
with Brian Gilbride, Southampton's Sanitation Supervisor, on February
27, I learned that Southampton has stopped using C&D screenings for this
purpose. Mr. Gilbride said that they had experienced problems with foul
odors as a result of C&D screenings applied over garbage being exposed to
moisture. The Town received numerous resident complaints .about the odors.
While Mr. Gilbride could not say exactly how much screened C&D material
came in to the landfill (there was no contract or formal agreement between
Southampton Tom and its supplier on how much material to supply) , he
routinely had enough at the landfill to cover each day's garbage. This would.
probably have amounted to 50 - 100 yards of cover per day. This is much
less than that used by Brookhaven Town (see earlier memo) , and more in
line with the amount we would use here in Southold.
Based on my conversation with Mr. Gilbride and Brookhaven's experience with
C&D as described previously, I would strongly recommend not using screened
C&D material for daily landfill cover at the Cutchogue landfill. The risk
of potential contamination, odors, and public complaints is significant, as
is the cost of proper testing of the material.

as I was told that the Town had decided not to use const-
ruction and demolition screenings and were going to award
to the lowest bidder for cleanfill. However, I am now
told that the people from Rapid Transfer Station who bid
in conjunction with a local trucker B.P. Wreckers, were
in attendance and after speaking to the Town Board, there
is a possibility that you may use this material and the
awarding of the bid was put off until your next meeting.
If this is the case, I would like to have the
opportunity to speak with the Town Board as my company
was the low bidder offering to pay you $2-00 per cubic
,yard. Rapid's bid was to pay $1 .00 per cubic yard.

We will supply the :Landfill with material generated from our
DEC licensed transfer station classified as screenings.
We will deliver this material to the landfill and Pay
Southold Town a fee of $2.00 per cubic yard. This material is
an after product generated from sorting out all recyclables,
garbage, and wood. We then grind the remainder and screen to
size out 2" minus material which would be used for daily
cover. This material would not be imported from any other
site as sometimes is a concern. This material is basically
the same construction debris you currently accept, only it
has been put thru our system to remove recyclables and
garbage. Enclosed is a current Lab test to show composition
of material.. We will supply you with tests on a monthly basis

GENERAL PROVISIONS 1-6 360-1.2(b)(17)
(17) "Bird hazard" means an increase in the likelihood of
bird/aircraft collisions that may cause damage to the aircraft or injury to
its occupants, attributable to the solid waste management facility
attracting birds.
(18) "Bottom ash" means the ash residue remaining after
combustion of solid waste or solid waste in combination with fossil fuel in
a solid waste incinerator that is discharged through and from the grates,
combustor, or stoker.
(19) "Bypass waste" means any solid waste that is either within
the control of the operator of a solid waste incinerator or processing
facility or within the control of another person, that is destined for
treatment at the facility but cannot be so treated, and includes:
(i) "downtime waste", meaning any treatable or burnable
solid waste accumulated during a scheduled or unscheduled maintenance
period of the facility; or
(ii) "excess waste", meaning solid waste which cannot be
treated because the facility is operating at the approved design capacity.
For purposes of this definition, "control" means control exercised by
contract, local law, or any other means.
(20) "Cathodic protection" means corrosion protection for a metal
tank or pipe caused by a continuous electrical current flowing from one or
more electrodes or a sacrificial anode to the protected structure.
(21) "Certification" means a statement of professional opinion
based upon knowledge and belief.
(22) "Clean fill" means material consisting of concrete, steel ,
wood, sand, dirt, soil , glass, construction and demolition debris, and
other inert material designated by the department.
(23) "Closed portion" means that portion of a solid waste
management facility which has been closed in accordance with the approved
closure plan for such facility and all applicable closure requirements.
(24) "Coefficient of permeability" and "hydraulic conductivity"
mean the rate of laminar flow of water through a unit cross-sectional area
of a porous medium under a unit hydraulic gradient at a standard
temperature.
(25) "Combined ash" means the mixture of bottom ash and fly ash.
(26) "Combustion" means the thermal treatment of solid waste in a
device which uses elevated temperatures as the primary means to change the
chemical , physical , or biological character or composition of the waste.

(37) "Contingency plan" means a document describing organized,
planned, and technically coordinated and financially feasible courses of
action to be followed in case of emergency or other special conditions,
including, but not limited to, equipment breakdowns, fire, odor, vectors,
explosion, spills, receipt or release of hazardous or, toxic materials or
substances, groundwater, surface water or air contamination attributable to
a solid waste management facility and other incidents that could threaten
human health or safety or the environment.
(38) "Contingency water quality" means the chemical composition
of ground or surface water when contamination has been detected in
environmental monitoring points at a solid waste management facility.
(39) "Cover material" means soil or other suitable material , or a
combination of same, acceptable to the department that is used to cover
compacted solid waste in a landfill .
(40) "Critical stratigraphic section" means all stratigraphic
units, both unconsolidated deposits and bedrock, into which contaminants
that escape from the solid waste management facility might reasonably be
expected to enter and cause contamination.
(41) "Daily cover" means a compacted layer of at least six inches
of cover material that is placed on all exposed solid waste at the end of
each working day of operation at a landfill .
(42) "Department" means the New York State Department of
Environmental Conservation.
(43) "Dike" means an embankment or ridge of either natural or
man-made materials used to prevent, control , or confine the movement of
liquids or solids.

BP Roll-Off Services, a division of BP Wreckers Ltd. of 510 Yennecott
Drive, Southold, NY 11971 proposes to provide the Town of Southold with
10,000 cubic yards, more or less of substitute for sand material as a
daily cover for garbage at the town landfill facility.
The New York State D.E.C. approves this material for landfill cover.
You will receive a letter directly from the D.E.C. on this material. The
substitute material will be provided by Rapid Recycling Corporation of
Medford, New York, a New York State D.E.C. licensed recycling facility,
operating permit #10-87-0730. Rapid Recycling Corporation will provide
the Town of Southold with monthly E.P. Toxicity tests on cover material.
The material will be delivered by BP Roll-Off Services to the Town of
Southold landfill as required and with two days notice from the town as
specified in the bid notice dated January 21, 1992.
Rapid Recycling Corporation will pay the Town of Southold $1.00
per cubic yard to accept delivery of this material. Rapid Recycling will
also post a $10,000 bond.

bank draft or certified check in the amount of $100.00, will be received
