NOTICE TO BIDDERS
NOTICE IS HEREBY GIVEN in accordance with the provisions of
Section 103 of the General Municipal Law that sealed bids are sought and
requested for the Removal and Disposal of Household Hazardous Waste for
Calendar Year 1992, from the Southold Town Collection Center, Route 48,
Cutchogue, New York, in accordance with all Federal, State and local
regulations. Specifications may be obtained at the Office of the Town
Clerk, Southold Town Hall, Main Road, Southold, New York 11971.
The sealed bids, together with a Non-Collusive Bid Certificate will be
received by the Town Clerk, at the Southold Town Hall, Main Road,
Southold, New York, until 11 :00 a.m., Wednesday, November 6, 1991, at
which time they will be opened and read aloud in public. The Town Board
of the Town of Southold- reserves the right to reject any and all bids and
waive any and all informality in any bid should it be deemed in the best
interest of the Town of Southold to do so.

STATEMENT OF INTENT AND SPECIFICATIONS
CHEMICAL WASTE HAULER FOR TOWN' OF SOUTHOLD
PERMANENT HOUSEHOLD HAZARDOUS WASTE STORAGE FACILITY
1. INTENT
The intent of this bid proposal is to secure one (1) chemical waste hauler
contractor to provide services in conjunction with the Permanent Household
Hazardous Waste Storage Facility and the corresponding program for the
Town of Southold.
11. DEFINITIONS
A. Contractor The chemical waste hauler who is providing the services
for the Permanent Household` .Hazardous Waste Storage Facility
(PHHWSF) .
B. HHW The acronym for Household Hazardous Waste and is the term
which shall include all pesticides and other chemicals or otherwise
harmful or potentially harmful wastes originating only from
residential homes ,as defined in 6 NYCRR Part 366. Such HHW
items shall only ' be accepted from the residents, not from
commercial establishments.
C. PHHWSF - The acronym for Permanent Household Hazardous Waste
Storage Facility, which is where the HHW will be stored, is
located at the Landfill Site, CR 48, Cutchogue, New York.
D. RCRA - The acronym for the Resource Conservation and Recovery Act
of 1976 of the Federal Regulations.
111. SCOPE
A. HANDLING PROCEDURES AND ASSURANCES.
The Contractor shall guarantee to provide all the professional services,
including, but no limited to, supervision, labor, equipment and
materials necessary to:
1 . Revise the existing manual of "Standard Operating
Procedures" which will include emergency procedures so that
any potential problem regarding a chemical hazard can be
quickly and efficiently taken care of.
2. Inspect and remove the drums of HHW at intervals_dependent
on the rate of collection.
3. Transport and dispose of said rums of HHW to the
appropriate hazardous waste treatment, storage, or disposal
facility (TSDF) in accordance with all Town, County, NYS-
DEC and US Department of Transportation standards, rules
and regulations.
4. Guarantee that all containers supplied to the PHHWSF and
used for packaging and 'transporting of HHW received are
fully in accordance with any and all laws.
5. Guarantee to come and pick up all of the filled rums within
five (5) working days of being notified by the Town.
6. Guarantee the presence of qualified employees trained in the
proper handling at the time of removal of the HHW at the
Town's designated site.
7. Provide on or before two (2) weeks prior to the execution
of contract, proof of all necessary local, state and federal
permits and identification numbers pursuant to the handling,
transportation disposal of HHW.

8. The Contractor shall:
a) Indemnify, save and hold harmless the Town of
Southold and any and all individuals present at the
PHHWSF from any and all liability for bodily injury,
property damage, and pollution contamination arising
directly from the Contractor's activities.
b) Provide the Town of Southold with a Certificate of
Insurance on or before two (2) weeks prior to execution
of contract, which indicates Contractor's insurance
coverage for its employees, equipment and all incidents
related to the handling, transport and disposal of
household hazardous wastes in an amount satisfactory
to the Town of Southold.
c) Be in compliance with the insurance requirements of
the Motor Carrier Act of 1980 for the transportation
of hazardous wastes (if applicable) and provide the
Town with a Certificate of Insurance naming the Town
as an additional insured on any policy required by the
Act.
B. TRAINING
Train the Town's operators of the facility in an eight (8) hour update
training course which will include the proper procedures for:
a) identifying and segregating the in-coming HHW;
b) labeling and preparing the drums of HHW for inspection by
chemical waste hauler prior to shipment; and
c) completing the forms for the corresponding waste collected
within the fifty-five gallon storage drums.
Training for the Town's personnel shall be provided pursuant to State
and. Federal regulations. It shall include the technical proceduees for
handling all waste that is accepted as well as the proper use of the
safety -equipment in a manner that is protective of the public health
and welfare and the environment.
C. SAFETY EQUIPMENT
Provide the additional safety equipment required, as well, as instruction
on how to use it. this shall include all items noted in "Schedule A".
D. EQUIPMENT INVENTORY
The Contractor shall take an inventory of all items and equipment
associated with the town's existing household hazardous waste
(S.T.O.P.) program and shall determine if such equipment is adequate
to meet current applicable permit and regulatory requirements.
Inventory shall be taken of items including, but not limited to, all
safety and protective equipment, spill control material, necessary signs
and notices, hazardous substance lists, and record-keeping forms.
The Contractor shall provide additional inventory as needed to meet
applicable requirements.
E. ADDITIONAL SPECIFICATIONS
The Contractor shall review all operating plans and procedures
associated with the Town's existing S.T.O.P. program for compliance
with all applicable permit and regulatory requirements, including those
requirements that may have been enacted since the Town received its
current S.T.O.P. operating permit in June of 1991 .
The Contractor will inform the Town of any and all revisions to
current operating procedures that may be necessary and meet revised
permit requirements enacted since the Town received its cureent
S.T.O.P. operating permit.

F. While the contractor and the Town agree that the Federal Resource
Conservation and Recovery Act (RCRA) specifically exempts household
waste from classification as a hazardous waste, both parties agree that
all HHW accepted by the Contractor pursuant to this program will be
handled, transported and disposed of to the extent required of
contractors handling HHW from under NYS DEC as if such waste was
classified as hazardous or acutely hazardous waste.
Since the PHHWSF is only for collection of household hazardous waste
received from the residents of the Town of Southold and will not be
the recipient of any commercial wastes, the facility is exempt from the
requirements of the NYS Solid and Hazardous Waste Facility permits
pursuant to 6 NYCRR 373-1 .1 (d) (1) (xvii) . All HHW collected shall
be manifested as "exempt" wastes on Hazardous Materials Shipping
Order Form #8-BLS-C4 ("red manifests") pursuant to Title 40 CFR
Section 261 .5. The Contractor shall enter the words "Exempt per 40
CFR 261 .5" in the space for "shipper's no.".
Duties include the following:
1 . Initial preparation of the facility includes supplying:
a. twenty empty fifty-five gallon rums;
b. "Standard Operating Procedures" Manual that will give
details regarding the proper. procedures the operators
shall follow in handling all acceptable material; and
C. proper forms for compliance with State and Federal
regulations.
2. RCA Duties:
a. to complete necessary RCRA paperwork for the disposal
of the drums.
3. Disposal Duties
a. inspecting contents of drums to assure proper packaging
labeling of the drums as well as to properly seal the
drums for transport.
b. loading drums on truck for removal.
C. replacing filled drums with empty ones.
d. providing the Town with the appropriate shipping forms
as well as the final method of disposal and the
designated disposal site for each drum.

STATEMENT OF INTENT AND SPECIFICATIONS
CHEMICAL WASTE HAULER FOR TOWN OF SOUTHOLD
PERMANENT HOUSEHOLD HAZARDOUS WASTE STORAGE FACILITY
1. INTENT
The intent of this bid proposal is to secure one (1) chemical waste hauler
contractor to provide services in conjunction with the Permanent Household
Hazardous Waste Storage Facility and the corresponding program for the
Town of Southold.
11. DEFINITIONS
A. Contractor - The chemical waste hauler who is providing the services
for the Permanent Household Hazardous Waste Storage Facility
(PHHWSF) .
B. HHW - The acronym for Household Hazardous Waste and is the term
which shall include all pesticides and other chemicals or otherwise
harmful or potentially harmful wastes originating only from
residential ` homes as defined in 6 NYCRR Part 366. Such HHW
'items shall only , be accepted from the residents, not from
commercial establishments.
C. PHHWSF The acronym for Permanent Household Hazardous Waste
Storage Facility, which is where the HHW will be stored, is
located at the Landfill Site, CR 48, Cutchogue, New York.
D. RCRA The acronym for the Resource Conservation and Recovery Act
of 1976 of the Federal Regulations.
Ill. SCOPE
A. HANDLING PROCEDURES AND ASSURANCES.
The Contractor shall guarantee to provide all the professional services,
including, but no limited to, supervision, labor, equipment and
materials necessary to:
1 . Revise the existing manual of "Standard Operating
Procedures" which will include emergency procedures so that
any potential problem regarding a chemical hazard can be
quickly and efficiently taken care of.
2. Inspect and remove the drums of HHW at intervals dependent
on the rate of collection.
3. Transport and dispose of said rums of HHW to the
appropriate hazardous waste treatment, storage, or disposal
facility (TSDF) in accordance with all Town, County, NYS-
DEC and US :Department of Transportation standards, rules
and regulations.
4. Guarantee that all containers supplied to the PHHWSF and
used for packaging and transporting of HHW received are
fully in accordance with any and all laws.
5. Guarantee to come and pick up all of the filled rums within
five (5) working days of being notified by the Town.
6. Guarantee the presence of qualified employees trained in the
proper handling at the time of removal of the HHW at the
Town's designated site.
7. Provide on or before two (2) weeks prior to the execution
of contract, proof of all necessary local, state and federal
permits and identification numbers pursuant to the handling,
transportation disposal of HHW.

8. The Contractor shall:
a) Indemnify, save and hold harmless the Town of
Southold and any and all individuals present at the
PHHWSF from any and all liability for bodily- injury,
property damage, and pollution contamination arising
directly from the Contractor's activities.
b) Provide the Town of Southold with a Certificate of
Insurance on or before two (2) weeks prior to execution
of contract, which indicates Contractor's insurance
coverage for its employees, equipment and all incidents
related to the handling, transport and disposal of
household hazardous wastes in an amount satisfactory
to the Town of Southold.
c) Be in compliance with the insurance requirements of
the Motor Carrier Act of 1980 for the transportation
of hazardous wastes (if applicable) and provide the
Town with a Certificate of Insurance naming the Town
as an additional insured on any policy required by the
Act.
B. _ TRAINING
Train the Town's operators of the facility in an eight (8) hour update
training course which will include the proper procedures for:
a) identifying and segregating the in-coming HHW;
b) labeling and preparing the drums of HHW for inspection by
chemical waste hauler prior to shipment; and
c) completing the forms for the corresponding waste collected
within the fifty-five gallon storage drums.
Training for the Town's personnel shall be provided pursuant to State
and Federal regulations. It shall include the technical procedures for
handling all waste that is accepted as well as the proper use of the
safety equipment in a manner that is protective of the public health
and welfare and the environment.
C. SAFETY EQUIPMENT
Provide the additional safety equipment required, as well. as instruction
on how to use it. this shall include all items noted in "Schedule A".
D. EQUIPMENT INVENTORY
The Contractor shall take an inventory of all items and equipment
associated with the town's existing household hazardous waste
(S.T.O.P.) program and shall determine if such equipment is adequate
to meet current applicable permit and regulatory requirements.
Inventory shall be taken of items including, but not limited to, all
safety and protective equipment, spill control material, necessary signs
and notices, hazardous substance lists, and record-keeping forms.
The Contractor shall provide additional inventory as needed to meet
applicable requirements.
E. ADDITIONAL SPECIFICATIONS
The Contractor shall review all operating plans and procedures
associated with the Town's existing S.T.O.P. program for compliance
with all applicable permit and regulatory requirements, including those
requirements that may have been enacted since the Town received its
current S.T.O.P. operating permit in June of 1991 .
The Contractor will inform the Town of any and all revisions to
current operating procedures that may be necessary and meet revised
permit requirements enacted since the Town received its cureent
S.T.O.P. operating permit.

F. While the contractor and the Town agree that the Federal Resource
Conservation and Recovery Act (RCRA) specifically exempts household
waste from classification as a hazardous waste, both parties agree that
all HHW accepted by the Contractor pursuant to this program will be
handled, transported and disposed of to the extent required of
contractors handling HHW from under NYS DEC as if such waste was
classified as hazardous or acutely hazardous waste.
Since the PHHWSF is only for collection of household hazardous waste
received from the residents of the Town of-Southold and will not be
the recipient of any commercial wastes, the facility is exempt from the
requirements of the NYS Solid and Hazardous Waste Facility permits
pursuant to 6 NYCRR 373-1 .1 (d) (1) (xvii) . All HHW collected shall
be manifested as "exempt" wastes on Hazardous Materials Shipping
Order Form #8-BLS-C4 ("red manifests") pursuant to Title 40 CFR
Section 261 .5. The Contractor shall enter the words "Exempt per 40
CFR 261 .5" in the space for "shipper's no.".
Duties include the following:
1 . Initial preparation of the facility includes supplying:
a. twenty empty fifty-five gallon rums;
b. "Standard Operating Procedures" Manual that will give
details regarding the proper procedures the operators
shall follow in handling all acceptable material; and
C. proper forms for compliance with State and Federal
regulations.
2. RCA Duties:
a. to complete necessary RCRA paperwork for the disposal
of the drums.
3. Disposal Duties:
a. inspecting contents of drums to assure proper packaging
labeling of the drums as well as to properly seal the
drums for transport.
b. loading drums on truck for removal.
C. replacing filled drums with empty ones.
d. providing the Town with the appropriate shipping forms
as well as the final method of disposal and the
designated disposal site for each drum.
