PROPERTY LOCATION: 475 Golf View Court, East Marion,NY S.C.T.M. # 1000-35-2-16.4 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 25, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The parcel is a conforming 81,605 square foot parcel located in an R-80 Zone. The parcel runs 175.18 along a 50 foot wide right of way named Golf View Court. The parcel runs 462.35 feet on the South side, 175 feet on the West side, and 470.28 feet on the North side. The property is currently under construction with a building permit for a single family dwelling with two attached garages, and is currently improved with a large concrete dwelling and two accessory concrete garages. The two garages are located 75 feet off of the Golf View Right of Way. At the rear property line is a 25 foot right of way owned by the Suffolk County Water Authority. Bordering the rear property line is the Island's End Golf Course. The property is part of the Golf View subdivision. All is shown on a survey by John T. Metzger L.L.S. on October 5, 2009 and last updated on January 9, 2014. BASIS OF APPLICATION: Request for Variances from Sections 280-15 and the Building Inspector's November 15, 2013 Notice of Disapproval based on an application for building permit for "as built" accessory garages, at; 1) proposed location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variance to construct two accessory garages in the front yard where code requires that accessory garages, on non-waterfront properties, be located in the rear yard. ADDITIONAL INFORMATION: During the hearing the applicant testified that he has a building permit to construct two- code conforming attached garages in the front yard of his property. The applicant constructed both garages but testified that he did not construct the two enclosed and conditioned "gallery" corridors proposed to Page 2 of 3—May 1,2014 Pan Brothers Management,Inc. SCTM#1000-35-2-I 6.4 connect the garages to the dwelling, per his building permit. The applicant further testified that the property is in a sub-division which consists of four building lots. Two of the lots have been previously developed; the applicant's lot is in the process of being developed; and one lot remains vacant. Testimony was taken that there are no other accessory garages located in the front yards on any of the other lots in the sub-division. The applicant also testified that the sub-division is surrounded by undeveloped land. Island's End Golf Course is on the West side of the sub- division. Pebble Beach farms sub-division is on the North and East sides of the sub-division. Testimony was taken that the vacant land in Pebble Beach farms is undevelopable due to a conservation easement. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 3, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a small neighborhood consisting of three single family homes located on large building lots. There are no other non-conforming accessory garages in the Golf View sub-division. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant was issued a building permit to construct a new dwelling with attached garages. The applicant could attach the garages to the house per the plan or he could build accessory garages in a code conforming location. There are no hardships which excuse the applicant from conforming to current building codes. 3. Town Law 4267-b(3)(b)(3). The variances requested herein are mathematically substantial, representing 100% relief from the code for each of the two `as built' accessory garages. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Moreover, the applicant's building permit was granted with two garages attached to the principal dwelling, 6. Town Law 4267-b. Denial of the requested relief is the minimum action necessary and adequate to preserve and protect the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried,to DENY, the variances as applied for, and shown on the survey by John T. Metzger L.L.S. on October 5, 2009 and last updated on January 9, 2014 and on the Architectural plans by David Marc Loftus dated June 6,2009. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals.
