That the said Board of Trustees and the Town of Southold are released from any and all damages,or claims for damages,of suits arising directly or indirectly as a result of any operation performed pursuant to this permit,and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties,and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. This project was granted a Town of Southold Trustee Wetland permit (7666) and NYSDEC wetland permit in 2011. At this time we are reapplying for the permit and a small modification is being requested. Permeable pavers will be utilized in place of the existing impervious surface on the boat ramp itself. The installation of drainage structures will collect and recharge water prior to reaching the wetlands. Ten catch basins and seven leaching pools will be installed (see plans). This project was granted a Town of Southold Trustee Wetland permit(7666) and NYSDEC wetland permit in 2011. At this time we are reapplying for the permit and a small modification is being requested. Permeable pavers will be utilized in place of the existing impervious surface on the boat ramp itself. The installation of drainage structures will collect and recharge water prior to reaching the wetlands. Ten catch basins and seven leaching pools will be installed (see plans). The project also includes native plantings to the area landward of the wetland boundary to filter additional pollutants. Concrete curb border will be added to the new ramp in addition to removing a tree stump. Developed Coast Policy Policy 1.Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of coastal location,and minimizes adverse effects of development The proposed project aims to protect and preserve"environmentally sensitive coastal resources"and enhances"stable residential areas,"by modifying the existing boat ramp to improve poor drainage to prevent the harmful effects of stormwater runoff in Spring Pond and the greater Peconic Estuary system. The existing boat ramp has provided service to the Gardiners Bay Estates Homeowners Association for over 40 years and allows the 100+ residences to appreciate and utilize the Town's coastal waters. Additionally,the alteration to the existing boat ramp makes efficient use of the existing infrastructure. Policy 3.Enhance visual quality and protect scenic resources throughout the Town of Southold Particularly,the proposed project enhances goal E.to, "Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality." The alteration of the existing boat ramp includes the reclamation of portions of the existing paved site to create vegetated swales inclusive of native plant species. These swales will present a more natural appearance than exists today while dually acting as natural drainage. Natural Coast Policies Policy S.Protect and improve water quality and supply in the Town of Southold The existing boat ramp accesses Spring Pond,a tributary to Gardiners Bay. In August 2009, the New York State Department of Environmental Conservation closed Spring Pond for shellfishing due to poor water quality. Currently,the existing boat ramp allows stormwater runoff to drain into Spring Pond,thus acting as a conduit for non-point source pollution. The proposed project will mitigate the existing factors by installing pervious material,creating vegetated swales and installing proper drainage. The proposed mitigation measures will tremendously help to reduce the volume of stormwater runoff from entering Spring Pond. This will help to improve the Pond's overall water quality. Particularly,the Policy Objectives outlined within 5.2, "Minimize non-point pollution of coastal waters and manage activities causing non-point pollution,"are achieved by the proposed project. Policy 6.Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. According to the Atlantic/Long Island Sound Basin Waterbody Inventory- priority Waterbodies List Report, Gardiners Bay Waters are primarily impacted segments,while Orient Harbor is a designated Significant Coastal Fish and Wildlife Habitat. The proposed project will help to improve and protect surface and groundwater by preventing stormwater runoff from entering this system from the project site's immediate area. The proposed project exemplifies an extraordinary improvement over existing conditions. Additionally,the project will fulfill Section 6.3 and comply with the statutory and regulatory requirements of the Southold Town Trustees as well as with the regulatory requirements of the Tidal Wetlands Act.
