That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit,and the said Permittee will,at his or her own expense,defend any and all such suits initiated by third parties,and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents,and non-compliance with the provisions of the originating application may be cause for,revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. , 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or,alterations in the location of the.work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title,or interest in real or personal property held or vested in a person not a party to the permit. Sanders oy Southold, NY 11971 �►0 ao� Telephone (631) 765-1892 Fax (631) 765-6641 BOARD OF TOWN TRUSTEES January 22, 2014 TOWN OF SOUTHOLD Mr. Christopher Tartaglia High Point Engineering 521 Conklin Street Farmingdale, NY 11735 RE: BREWER YACHT YARD AT GREENPORT 1410 MANHASSET AVENUE, GREENPORT SCTM# 36-1-1 Dear Mr. Tartaglia: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, January 22, 2014 regarding the above matter: WHEREAS, High Point Engineering on behalf of BREWER YACHT YARD AT GREENPORT applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 25, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: issuance of permit on structures; and the installation of drywells to contain roof runoff; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 22, 2014, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of BREWER YACHT YARD AT GREENPORT for the replacement of+/-205 linear feet of existing timber bulkhead with proposed vinyl bulkhead raised 18" higher to match existing adjacent bulkhead elevation to the south; demolish and reconstruct existing restroom building within existing footprint with roof runoff to drain to grade and discharge to the Eastern Basin via NYSDEC Approved Outfall 003 to the north per existing conditions; existing timber docks to be replaced in-kind as follows: 125 linear feet of 6'-8' wide fixed dock fronting building/bulkhead, 75' of 3'-4' wide fixed dock fronting bulkhead to the north; for the existing two (2) 4'x53' fixed docks perpendicular to bulkhead, and one (1) 6'x48' floating dock with 15' ramp perpendicular to bulkhead; with the conditions that drywells be installed to contain roof runoff of restroom building; the use of untreated lumber on all decking; and that the sewage pump-station alarm be checked for functionality; and as depicted on the site plan prepared by High Point Engineering, last dated February 10, 2014, and stamped approved on February 21, 2014. SCIM#1000-36-1-1 RELIEF REQUESTED: The applicant requests a variance to demolish and construct a new restroom building with a bulkhead setback of 0 feet where the code requires 75 feet. ADDITK?NAL INFORMATION: At the Public Hearing the Zoning Board of Appeals requested; 1)copy of DEC permit, 2) location of sanitary system. On November 25, 2013 the Board received a Ietter from High Point Engineering responding to the LWRP concerns,a copy of the Notice of Intent to the NYSDEC under the existing permit, site plan of the bulkhead/dock/restroom replacement plan with the existing septic system shown and a site plan of the storm-water prevention plan. The Zoning Board requested comments from the Planning Board on this application. In a memo dated October 23,2013 the Planning Board states,"they have no objection so long as the use of the proposed building remains the same and no additional parking is required or proposed. The subject parcel is zoned M-11 and is located in Greenport where the proposed uses of a marina are consistent with the Town Code and the Town's Comprehensive Plan. The proposed restroom and shower building appears to not cause concern since this proposed area has historically been used for restrooms and showers accessory to the existing marina. The above-referenced proposals would fiuther the goal of the Town's Comprehensive Plan to enhance the Town's waterfront while maintaining its fundamental characteristics." Additionally, this applicant was granted a prior variance file#6581 in 2012 for the demolition and construction of boat storage and office building noting 3 feet+/-from the bulkhead. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7,2013 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wants to update the restrooms and laundry room which is made up of three separate rooms which is at"0"feet from the bulkhead. The building has been in existence for more than 45 years with no apparent adverse impact on the neighborhood and no change in location, footprint or use is proposed. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. AIthough the applicant could conceivably relocate the new up to date restroom building elsewhere on the subject property, in reality the actual buildable area within the marina compound is extremely tight and does not lend itself for new additional waterfront or inland buildings. 3. Town Law 5267-b(3)(b)(3). The variance granted herein is mathematically substantial based upon 100% setback relief from a bulkhead. However, the applicant is proposing only to replace the building within the same footprint. In addition there does not appear to be another location on this property that could accommodate a building of this size. 4. Town Law 4267-b(3)(b)(4) No Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5.
