11. Board and Office Policies, Practices, and Activities:
Time Limits on Variances
All variance relief granted by the ZBA in Southold Town runs with the land in
perpetuity and is transferable to other owners. Recently the ZBA was made aware of
two prior variance decisions that have just been activated in order to start
construction. Appeal # 3507 (made 28 years ago inl9 6) granted the right to build a
swimming pool 30 feet from the top of the bluff/bank on Sound Avenue in
Greenport, and is now before the ward of Town Trustees. The other, Appeal # 4071.
(made 22 years ago in 1992) granted the right to build a large commercial storage
building with very substantial setback and lot coverage relief on Kerwin. Blvd. in
Greenport, and is now before the planning Board. "These two examples led the ZBA
members to re-visit a previous discussion about placing reasonable time limits on
variances. We feel this subject is particularly timely because the Town is about to
adopt a. comprehensive plan. Moreover, our Town Trustees, planning Board and
Building Department all have time limits on their approvals, and the Members of the
Board.of Appeals are unanimous in the belief that the ZBA should be consistent with
these other Town agencies to promote sound planning practices in the future. We
have investigated how other nearby municipalities deal with time limits on :coning
variances and we are in the process of preparing a report and proposal to the Town
Board. When completed, we will request time on a work session agenda to discuss
the report and to ask that the matter be referred to the Code Committee.
